A RESOLUTION ESTABLISHING SPECIAL CHARGES,
TERMS AND CONDITIONS FOR THE USE OF THE
MARINE STADIUM THAT WILL SERVE AS A GRANT IN
SUPPORT OF THE EVENT ENTITLED "POPS BY THE
BAY" CONCERT SERIES TO BE PRESENTED BY THE
PHILHARMONIC ORCHESTRA OF FLORIDA AND THE
MIAMI HERALD LEND -A -HAND FUND AS COSPONSORS,
TO BE HELD AT SAID STADIUM ON JULY 4, 15, AND
22, 1989; AUTHORIZING THE CITY MANAGER TO
EXECUTE AN AGREEMENT, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, WHICH AGREEMENT SHALL
CONTAIN PROVISIONS FOR SAID SPONSORS' PAYMENT
OF ALL EXPENSES, INCLUDING POLICE, FOR
PAYMENT OF APPLICABLE SURCHARGES, AND FOR AN
INCREASE IN THE NUMBER OF COMPLIMENTARY
TICKETS TO FIVE PERCENT (5%) OF ALL TICKETS
AUTHORIZED TO BE PRINTED, SUBJECT TO SUCH
CONDITIONS AND LIMITATIONS AS MAY BE
PRESCRIBED BY THE CITY OF MIAMI.
WHEREAS, for the past several years the City of Miami has
provided financial and other support for the "Pops by the Bay
Concerts" series conducted by the Philharmonic Orchestra of
Florida and the Miami Herald Lend -a -Hand Fund; and
WHEREAS, last year, the City provided a grant in the amount
of $15,000 to cover the cost of the use fee of the Marine Stadium
by adoption of Resolution No. 88-563 on June 9, 1988; and
WHEREAS, said event series will be conducted again at the
Marine Stadium on July 4, 15 and 22, 1989; and
WHEREAS, in lieu of direct financial aid, the City wishes to
establish special charges, terms and conditions for the 1989
event which will serve as a grant; and
WHEREAS, it is recommended that said sponsors be required to
pay all event and personnel expenses, excluding the use fee, and
to collect the applicable surcharges for the City in accordance
with Ordinance No. 10439, as amended; and
WHEREAS, it is also recommended that said sponsors be
allowed an increase in the number of complimentary tickets to
five percent (5%) of all tickets to be printed, in order to
promote this community event in the City;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY =_
OF MIAMI, FLORIDA:
Section 1. The special charges, terms and conditions -_
referred to in Section 2 of this Resolution are hereby
established for the use of the Marine Stadium as a grant in
support of the "Pops by the Bay" Concert Series to be presented
by the Philharmonic Orchestra of Florida and the Miami Herald
Lend -a -Hand Fund to be held at said stadium July 4, 15, and 22,
m. .
Section 2. The City Manager is hereby authorized to execute
an agreement, in a form acceptable to the City Attorney, with
said sponsors for said event, which agreement shall contain
provision for said sponsors' payment of all expenses, including
Police and excluding use fees, for payment of all applicable
surcharges, and for an increase in the number of complimentary
tickets to five percent (5%) of all tickets authorized to be
printed.
Section 3. The aforementioned authorizations are hereby
subject to and contingent upon the sponsors' compliance with any
and all additional conditions and/or requirements as may be
prescribed by the administration of the City of Miami.
® Section 4. This Resolution shall become effective
immediately upon its adoption pursuant to law.

This year will mark the fifth year of the Pops by the Bay,
concert series at the Marine Stadium. We are requesting
for"the`City of`Miami Commission to please waive the fee
for'the renting of the Marine Stadium for the Pops By the
.,,Bay Concert Series. This fee amounts to $15,000 ($5,000
for ,each concert).

As a continuing co-sponsor of Pops by the Bay you will

enjoy the following benefits:
1) The .City of Miami will be listed as a co-sponsor in
all publicity for the concert series. This includes over
$100,000 in Herald advertising, $25,000 in radio advertising,
and over $25,000 in television advertising.
2) The'City of Miami will be listed as a co-sponsor in
the concert program for each Paps concert and be
recognized on stage at each concert;

3) A banner with the City of Miami logo will be
displayed at the Marine Stadium for all three
concerts; and
4) The City of Miami will receive 200 free tickets for
each Pops concert.
It has been a pleasure working with the City of Miami, as
a sponsor of these concert series for the past four years
and I will look forward to your continued commitment.
