A RESOLUTION AMENDING SECTION 1 AND SECTION 4 OF RESOLUTION NO. 89-66, ADOPTED JANUARY 12, 1989 CONCERNING THE BANYAN FESTIVAL TO BE CONDUCTED BY THE COCONUT GROVE CHAMBER OF COMMERCE ON OCTOBER 21-22, 1989, THEREBY REFLECTING STREET CLOSURE FROM 6:00 A.M. SATURDAY, OCTOBER 21, 1989 THROUGH 8:00 P.M. SUNDAY, OCTOBER 22, 1989. WHEREAS, the Coconut Grove Chamber of Commerce has requested that the streets be closed all Saturday night to through vehicular traffic for the Banyan Festival from 6:00 A.M. Saturday, October 21, 1989 through 8:00 P.M. Sunday, October 22, 1989; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 1 and Section 4 of Resolution 89-66, adopted January 12, 1989, are hereby amended in the following particulars "Section 1. In order to effectuate safe passage and establish a temporary pedestrian mall during the Banyan Festival, to be conducted by the Coconut Grove Chamber of Commerce, the following streets are hereby closed to through vehicular traffic from 6:00 A.M. Saturday RsOO-P.m. a October 21, 1989 and f-Fem 6soo -e� through 8:00 P.M. Sunday ei+ October 22, 1989 as specified below: Main Highway from McFarlane Road to Charles Avenue. Commodore Plaza from Grand Avenue to Main Highway. Fuller Street from Grand Avenue to Main Highway. Included in the herein closure are all streets, avenues, alleys, ways and thoroughfares which intersect the enumerated areas delineated in this Section. Section 4. Pursuant to the provision of City Code Section 39-13, all retail peddlers' occupational 1/ Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. Odio City Manager RECOMMENDATION: DATE: MAY 30 1989 FILE: SUBJECT: Amendment to street closure Resolution for Banyan Festival REFERENCES: ENCLOSURES: Commission Agenda Item June 7, 1989 It is respectfully recommended that the City Commission adopt the attached resolution which amends Resolution No. 89-66, reflecting that the streets will be closed from 6:00 A.M. Saturday, October 21, 1989 through 8:00 P.M. Sunday, October 22, 1989 in connection with the Banyan Festival to be conducted by the Coconut Grove Chamber of Commerce. BACKGROUND: The Department of Community Development has prepared the appropriate legislation to amend the street closure resolution in connection with the Banyan Festival. The Coconut Grove Chamber of Commerce has requested that the streets be closed overnight on Saturday, October 21, 1989 to allow vendors to leave the booths at the festival site during Saturday night. Section 2. Such closing of streets is subject to State approval and issuance of permits by the Departments of Police and Fire, Rescue and Inspection Services. Said permit from the Department of Police is to be issued upon full approval of the CITY COMMISSION1 MEETING OF 89-" 525 JAN 12 1289 RESOLUTION No. ���' Chief of Police after giving all due consideration to the safety and traffic needs of residents# businesses, and religious institutions in the area for entering and crossing through said arterials and upon the favorable exercise of the City Manager's judgement predicated upon all factors set forth herein. Section 3. Upon the issuance of a temporary permit by the Florida Department of Business Regulation# Division of Alcoholic Beverages and Tobacco# to sell beer and wine pursuant to City Code 54-12.1# the request of the Coconut Grove Chamber of Commerce to sell beer and wine for a two-day period in connection with the Banyan Festival to be held October 21 and 22 # 1989 # is hereby granted subject to the issuance of all permits required by law. Section. 4. Pursuant to the provision of City Code Section 39-13, all' retail peddlers' occupational licenses issued under the provisions of Chapter 31 of the City Code, as amended, will not be valid during the hours of 8:00 A.M. to 8:00 P.M. on October 21-22, 1989 on the above designated streets and on all intersecting streets for two blocks in all directions. Section S. The herein authorization are hereby conditioned upon traffic concern being resolved and approved by the Police Department,., Section 6. Such authorizations are hereby subject to the organizers obtaining insurance requirements as mandated by the City of Miami and paying for all necessary costs of City services. Section 7.
