' _ AN EMERGENCY ORDINANCE AMENDING SECTIONS 3 AND 5 OF ORDINANCE NO. 10484, ADOPTED SEPTEMBER 27, 1988, THE ANNUAL APPROPRIATIONS ORDINANCE FOR FISCAL YEAR ENDING SEPTEMBER 30, 1989, BY INCREASING THE APPROPRIATIONS IN THE INTERNAL SERVICE FUND: GENERAL SERVICES ADMINISTRATION: COMMUNICATIONS DIVISION BY $978,880, INCREASING REVENUES IN THE SAME AMOUNT FROM THE EMERGENCY 911 SYSTEM SERVICE FEES; ESTABLISHING DEFINITIONS FOR RECURRING AND NONRECURRING FEES RELATED TO SAID SYSTEM; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Department of General Service Administration has prepared a Budget Estimate of expenditures for Emergency 911 System Service Fees and the Department of Budget has prepared a Revenue Estimate for Fiscal Year 1989; and WHEREAS, the City of Miami in order to be in compliance with Chapter 365 of the Florida Statutes must place all recurring and nonrecurring fees in separate accounts; and WHEREAS, the proposed ordinance satisfies said requirement; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Sections 3 and 5 of the Ordinance No. 10484, adopted September 27, 1988, the Annual Appropriations Ordinance for Fiscal Year ending September 30 1989, is hereby amended in the following particulars: 1/ "Section 3. The following activities, which are carried on for the service and convenience of other funds, shall be operated by the City Manager within the limits of the appropriations provided in the foregoing Departments, Boards, Offices, and accounts of the City of Miami and other revenues or receipts which may be received: Internal Service Funds Appropriations Communications Services $ 2,813,155 S 3,792,035 Total Internal Service Funds 22,873,662 S 23,852,542 Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Astericks indicate omitted and unchanged material. 1_0593 "Section 5. The above appropriations are made based on the following sources of revenues for the 1988-89 Fiscal Year: Internal Service Funds Revenues Communications Services $ 2,813,155 S 3,792J35 Total Internal Service Funds , $ 23,852,542 Section 2. In order to leave proper audit trails, separate revenue and expenditure accounts shall be established for recurring and nonrecurring Emergency 911 System Fees in accordance with the following definitions: (1) recurring charges means all expenses relating to the operation and maintenance of the "911" system. (2) nonrecurring charges means all expenses relating to the purchase of equipment for the "911" system. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on grounds of urgent public health, safety and property of the City of Miami and upon the further ground of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the function and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 7. Od City Manage Recommendation: DATE: MAY 3 j 1989 FILE: SUBJECT: proposed Amendment to the FY'89 Annual Appropriation Ordinance REFERENCES: ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached emergency ordinance increasing appropriations in the Internal Service Fund, General Services Administration, Communications Division by $978,880 'increasing revenues in the same amount from the Emergency 911 System Service Fee. Background: The Department of General Services Administration prepared a Budget Estimate of revenues and expenditures for Emergency 911 System Service Fees for FY'89. The City of Miami in order to be in compliance with Chapter 365 of the Florida Statutes must place these revenues and related expenditures in separate accounts.
