A RESOLUTION AFFIRMING THE DECISION OF THE
20NING BOARD AND GRANTING THE SPECIAL,
EXCEPTION AS LISTED IN ORDINANCE 9500, AS
AMENDED, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, ARTICLE 15, SECTION 1523, SUBSECTION
1523.1(5), PERMISSIBLE PRINCIPAL USES AND
STRUCTURES, TO ALLOW THE CONVERSION OF THE
EXISTING BAR TO A SUPPER CLUB WITHOUT LIVE
ENTERTAINMENT FOR THE. PROPERTY LOCATED AT
2721 BIRD AVENUE, MIAMI, FLORIDA (MORE
PARTICULARLY DESCRIBED HEREIN) AS PER PLANS
ON FILE; ZONED SP I-2 COCONUT GROVE CENTRAL
COMMERCIAL DISTRICT. THIS SPECIAL EXCEPTION
HAS A TIME LIMITATION OF TWELVE MONTHS IN
WHICH TO OBTAIN A BUILDING PERMIT AND A
REQUIREMENT THAT APPLICANT RETURN TO THE CITY
COMMISSION FOR REVIEW IN ONE YEAR.
WHEREAS, the Miami Zoning Board at its meeting of May 1,
1989, Item No. 21 following an advertised hearing, adopted
Resolution ZB 49-89 by an eight to zero vote (8-0), granting the
Special Exception as listed in Ordinance 9500, as amended, the
Zoning Ordinance of the City of Miami, Article 15, Section 1523,
Subsection 1523.1(5), Permissible Principal Uses and Structures,
to allow the conversion of the existing bar to a supper club
without live entertainment for the property located at 2721 Bird
Avenue, Miami, Florida, also described as Lots 3, 4, and 5,
CHARLES M. MUNDY'S SUBDIVISION, according to the Plat thereof, as
recorded in Plat Book 3, at Page 15, of the Public Records of
Dade County, Florida; as per plans on file, and subject to a time
limitation of twelve (12) months for this Special Exception in
which a building permit must be obtained, zoned SP I-2 Coconut
Grove Central Commercial District; and
WHEREAS, citizens have taken an appeal to the City
Commission from the granting of the Special Exception; and
WHEREAS, the City Commission, after careful consideration of.
this matter, finds that the application for a Special Exception
does meet the applicable requirements of Zoning Ordinance 9500;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The decision of the Zoning Board in granting the
Special Exception as listed in Ordinance 9500, as amendedi the
Zoning Ordinance of the City of Miami? Article 15, Section 1523i
Subsection 1523.1(5), Permissible Principal Uses and Structures,
to allow the conversion of the existing bar to a supper club
without live entertainment for the property located at 2721 Bird
Avenue, Miami, Florida, also described as Lots 3, 4 and 5,
CHARLES M. MUNDY'S SUBDIVISION, according to the Plat thereof, as
recorded in Plat Book 3, at Page 15, of the Public Records of
Dade County, Florida; as per plans on file, zoned SP I-2 Coconut
Grove Central Commercial District, and subject to a time
limitation of twelve months in which a building permit must be
obtained and to a requirement that the applicant/owner return to
the City Commission for review in one year relative to the
applicant/owner's compliance with all conditions and limitations
upon the Special Exception imposed herein or provided by law, is
affirmed and the Special Exception is hereby granted.
