J-89-288 6/22/89 ORDINANCE NO. 1.() 1.519S AN ORDINANCE AMENDING ORDINANCE NO. 9500, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, BY ELIMINATING TRANSITIONAL USES IN, RESIDENTIAL, SPI-9 AND SPI-14.2 DISTRICTS AND AMENDING SECTIONS 1591, 1595, 1596, 15145.1, 2018.2.1, AND 2018.2.2., AS REQUIRED, TO EFFECTUATE SAID CHANGES; FURTHER, AMENDING THE SCHEDULE OF DISTRICT REGULATIONS, PAGES 1 AND 2, BY DELETING COLUMNS ENTITLED "TRANSITIONAL USES, STRUCTURES AND REQUIREMENTS" FOR RESIDENTIAL DISTRICTS; PROVIDING FOR PENDING APPLICATIONS; CONTAINING A REPEALER PROVISION, SEVERABILITY CLAUSE, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Miami Planning Advisory Board, at its meeting of March 15, 1989, Item No. 2b, following an advertised hearing adopted Resolution No. PAB 15-89 by a 4 to 4 tie vote, therefore constituting a technical recommendation of DENIAL of this request to amend Ordinance No. 9500 as hereinafter set forth; and WHEREAS, the City Commission after careful consideration of this matter, notwithstanding the Planning Board's recommendation, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend Ordinance No. 9500 as hereinafter set forth: NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 9500, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by amending the text of said ordinance as follows:/ "ARTICLE 15. SPECIAL PUBLIC INTEREST DISTRICTS Sec. 1590. SPI-9 Biscayne Boulevard North overlay district. Words and/or figures stricken through sbalI be deleted. Underscored words and/or figures sha11 be added. Biscayne Boulevard North is one of the major gateways to the City of Miami. This overlay district is of special and substantial public interest because of the need to upgrade the amenities and visual qualities of the boulevard. It is intended that future public and private development shall respect and enhance this gateway role by providing well landscaped residential and/or commercial development along the boulevard. GENERAL AND SUPPLEMENTARY REGULATIONS Sec. 2018. Offsite parking. 2018.2. Offsite parking on adjoining or abutting lots. Except as provided at section 2017.9, "Joint parking facilities for contiguous use," offsite parking on lots in separate ownership or abutting lots containing principal uses served, in the same frontage without an intervening street, but with or without an intervening alley, shall require permits and be subject to requirements and limitations as follows: 2018.2.1. Special exception required where lots are in or other areas of residential districts and parking is for uses other than residential within the same residential district. A special exception shall be required where such adjoining or abutting lots are in yr other areas of residential districts and the proposed parking facility is to serve uses other than residential within the same residential district. In connection with such exception, the following particular limitations and requirements shall apply: 2018.2.2. Class C special permit required where lots are in branstbtonut or other areas of residential districts and parking is for residential uses within the same district or the adjoining district. A Class C special permit shall be required where such adjoining or abutting lots are in the transt btollat Or other areas of a residential district and the proposed parking is - 4 - al )-59!' to serve residential uses within the same district or the adjoining district. in such oases, the same special limitations shall apply as set forth in section 2018.2.1, except that access to such lots may be from within the residential district. Section 2. The Schedule of District Regulations, pages 1 and 2, is hereby amended by completely deleting the below described colums as follows: "USES AND STRUCTURES TRANSITIONAt USES, STRUCTURES AND REQUIREMENTS" (delete, completely, everything under this column heading, pages 1 and 2). Section 3. No permit for a transitional use herein eliminated shall be granted unless a complete application for same was on file upon this ordinance taking effect. If such a permit is the subject of an appeal on the effective dated of this Ordinance, the permittee, if the prevailing party upon conclusion of appeal proceedings, may utilize such permit as approved and/or amended during said proceedings. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 5. If any part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance shall become effective ninety (90) days (on September 20, 1989) after adoption pursuant to Law. BACKGROUND The concept of transitional uses in residential districts in the City of Miami started with Ordinance 7381; January 5, 1966, as an amendment to Comprehensive Zoning Ordinance 6871. This ordinance provided only for side transition within 100 feet of the zoning district boundary, by right. Zoning Ordinance 9500, in 1983, instituted both side and rear transition uses in the residential districts by special permit and transitional eauiremeits and limitations in -the corresponding commercial and industrial districts. In 1986, the Commission sponsored a public hearing on transitional uses, but no leg islition resulted. The audience Sias divided: neighborhood groups expressed opposition to transitional uses, while development interests expressed support. PAB 3/15/89 Item #2b Page 1 of 2 1 ()599 On February 9, 1989, the Commission passed Motion 89-122, which directed the Administration to initiate an application to eliminate transitional uses. ANALYSIS "Transitional uses" refers to a limited number of non-residential uses, permissible in a residential zoning district, within 100 feet of a zoning boundary with commercial and industrial uses. — "Transitional requirements and limitations" refers to constraints, with a commercial or industrial zoning district immediately proximate to a boundary with a residential district. In this alternative, these amendments would: 1. Eliminate side and rear transitional uses in residential zoning districts, includin certain Special Public Interest (SPI� districts. 2. Retain transitional requirements and limitations in commercial and industrial zoning districts, including the remaining SgeEia.l Public Interest (SPI) districts.... RECOMMENDATIONS PLANNING DEPT. Approval of this recommendation as a first -choice; it eliminates all transitional uses in residential districts; retains transitional requirements and limitations in commercial and industrial districts. PLANNING ADVISORY BOARD At its meeting of March 15, 1989, the Planning Advisory Board adopted Resolution PAB 15-89, by a 4 to 4 vote, a tie vote which constitutes a technical denial of the above. Traffic and parking problems exist because present standards do not call for enough parking spaces for clients, customers and workers in commercial establishments. Even when parking garages are available many choose to park on the residential streets around such a facility. PG 1 (Slide 1). This is exemplified by Madison Circle. 3159 SW 21 Terrace is the address of a home. Yet in the middle of the afternoon the street in front of this home is filled with parked cars. (Slide 2). Even though the home owner must- suffer the sight of a parking garage, it does not provide relief from congested streets. Because commercial development does not represent "home" to the owners, management or staff of the facility, upkeep and maintenance of the grounds is more often than not neglected. PG 2 (Slide 3). The residents of 3536 S.W. 22 Terr. are treated to an offensive view of trash and weeds from the parking lot of commercial interest on Coral Way. PG 3 (Slide 4). While in the Miami -Roads section the International Bank building s trash bin sits outside the walled parking lot and faces -he entrance to the home located at 244 S.W. 22 Road. During non -business hours and days, empty parking lots and buildings bring vagrants, gangs, and other undesirables into the residential neighborhoods. PG 2 (Slide 5). The graffiti on these walls behind Stern Brothers Plumbing are a graphic illustration of trouble coming into the neighborhood. (Slide 6). Further down the street, E.R. Brownell and Associates had so much trouble with break-ins and destruction of private property that they had to fence in their walls. In addition, residents do not feel safe knowing that non-residents cars are parked on their streets. Any thief can be "casing" a home and use the excuse that they are waiting for a friend who is in a nearby office. Even though restrictions are imposed on transitional conversions maintenance is lax. Examples abound in many of the city s neighborhoods. On the south side of the Coral Way corridor: PG 2 (Slide 8). The parking lot for The Antiques Center is an unpaved jumble of weeds. (Slide 9). The residents of 3620 S.W. 22 Terrace. experience this view of strange cars, weeds and an unpainted walls from their front door. (Slide 10). Close by, down the street these screening walls are crumbling away. (Slide 11). As they are also crumbling further east on S.W. 22 Terrace. PG 4 (Slide 12). On the north side of the Coral Way corridor the residents of 1675 S.W. 21 St. face this un-walled parking lot. PG 5 (Slide 13). In the Douglas Park area an abandoned car sits outside of the transitional office located at 3721 S.W. 28 Street. (Slide 14). 3700 S.W. 28 Street provides an example of the abuse homeowners have to experience when faced with commercial development in their front yards. PG 6 (Slide 15). North of N.W. 7th Street, 750 N.W. 35 Ave. has been granted transitional office use but the grass is uncut and the plainly visible No Parking sign is ignored. PG 7 (Slide 16). In Little Havana, the Navarro Discount has removed the back wall of their parking lot and customers now drive through to the residential S.W. 7 Street, adding to the already heavy traffic. While in Flagami, the transitional office at 711 S.W. 63. Avenue has cars double parked in front. While these may be enforcement problems, we feel that residents are placed in undue hardship by having to police and report non- compliance with the conditions of transitional use. Further, we ask you to consider the fact that many residents are unaware of their rights. In short, if transitional use did not exist these enforcement problems would also not exist. In addition transitional use encourages the deliberate degeneration and destruction of middle class homes and neighborhoods. A favorite tactic of commercial interests is to let houses decay and deteriorate to.such a state that the neighbors prefer to see the house removed and a parking lot take its place. PG 9 (Slides 19 & 20). In Shenandoah, 1818 and 1828 SW 21 Terrace, are left to decay. PG 6 (Slide 21). On NW 7 Street and 36 Court trash sits in front of a transitional property. PG 10 (Slide 22). The corner of SW 41 Avenue and Flagler Street is piled with trash and debris while awaiting the completion of a now bankrupt project. (Slide 23). On NW 7 Street, another empty transitional lot sits with parked trucks. PG 11 (Slide 24). The transitional lot at 2969 SW 37 Court is an overgrown jungle. PG 12 (Slides 25, 26 & 27). In Coconut Grove, transitional use turned 3 houses on Florida Avenue into boarded up shacks. PG 13 (Slide 28). 2101 SW 33 Avenue, in Coral Gate, has been rented out to more than one family while it waits to be turned into a transitional office. Presently there are efforts to make this property part of an assembly of all the homes on the south side of 21 Street between 32 and 33 Avenues. This assemblage will then be presented to the new buyers of the Triple Gables Theater property for additional parking. This is an illegal beauty supply outlet on a rear transitional lot which could only be used for parking. It is not surprising that residents are confused. For example, 736 NW 33 Avenue has been granted transitional office use, yet it is 720 NW 33 Avenue that abuts commercial. Meanwhile, 2631 SW 27 Street, has also been granted transitional office status. Yet the corner 2665 SW 27 Street faces commercial development on 2 streets but is zoned residential. PG 14 (Slide 29A). In Flagami 31 Tamiami Canal Road has been granted transitional office use, however, it is next door to an apartment building and it is not a corner lot. Transitional use eats away at residential neighborhoods, because as commercial grows, so does transitional. PG 15 (Slides 30 & 31). In Little Havanna the commercial properties on SW 12 Avenue between 3rd and 4th Streets have extended to an unfinished parking garage behind the shopping center. Note the re - enforcement bars jutting into the sky, this faces the residents across the street. (Slide 32). Further down the same congested street, a now empty lot is filled with even more cars. Commercial interests have taken over a once residential block. PG 16 (Slide 33). Behind the old Studio Restaurant, citizens await the completion of a larger restaurant while living with the construction noise and dust for months on end. PG 17 (Slide 34). Because the lot next door has been granted transitional use as an office, 41 Tamiami Canal Road is being advertised with the same possibility, further eroding the supply of available middle class homes and promoting the intrusion of commercial usage into residential neighborhoods PG 18 (Slides 35 & 36). If the practice of transitional use continues, the residents of these homes on the north side of SW 7 Street in the Coral Nook Subdivision will soon face a parking lot across their street (Slide 36A). PAGE -4- 1 0-599 Eventually, in order to protect ourselves from office buildings next door, (Slide 37), intrusive parking structures, (Slide 38), dirt, trash and unkept areas (Slide 39) and crime we will a].1 have to wall in our homes (Slide 40). In conclusion transitional use is unacceptable to us because it only brings problems. The practice of granting variances whittles away any buffers for the residential districts. You are getting more requests every day, that the transitional 50 foot buffer be reduced to 20 feet or less. We urge you to accept Plan B as considered by the Planning Department. This will allow for orderly zoning changes to be considered and decided, not behind some closed door by some un-named administrator, but here, out in the open, and by you, our elected representatives.
