ORDINANCE NO. 10-598
AN ORDINANCE AMENDING THE ZONING ATLAS OF
ORDINANCE NO. 9500, THE ZONING ORDINANCE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY
APPLYING THE HC-1: GENERAL USE HERITAGE
CONSERVATION OVERLAY DISTRICT TO THE MARJORY
STONEMAN DOUGLAS HOUSE, LOCATED AT
APPROXIMATELY 3744 STEWART AVENUE, MIAMI,
FLORIDA (MORE PARTICULARLY DESCRIBED HEREIN);
MAKING FINDINGS; AND MAKING ALL NECESSARY
CHANGES ON PAGE NUMBER 48 OF SAID ZONING
ATLAS; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board at its meeting of
April 5, 1989, Item No. 1, following an advertised public
hearing, adopted Resolution No. PAB 17-89, by a 8 to 1 vote,
RECOMMENDING APPROVAL of the request to amend the Zoning Atlas as
hereinafter set .forth; and
WHEREAS, the Miami Heritage Conservation Board, at its
meeting of November 15, 1988, following an advertised public
hearing, adopted Resolution No. HC 79-88, by a 7 to 0 vote,
RECOMMENDING APPROVAL of the herein historical designation; and
WHEREAS, the City Commission, after careful consideration of
this matter deems it advisable and in the best interest crf the
general welfare of the City of Miami and its inhabitants to amend
the zoning atlas as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF THE CITY OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
Zoning Ordinance of the City of Miami, Florida, as amended, is
hereby further amended by applying the HC-1: General Use Heritage
Conservation Overlay District to the Marjory Stoneman Douglas
House, which is located at approximately 3744 Stewart Avenue,
Miami, Florida, and more particularly described as An unplatted
parcel of land .located in Section 29, Township 54, Range 41, of
Dade County Florida, more particularly described as follows:

Beginning 418 feet North and 175 West of. the Southeast corner of
the Northeast 1/4 of the Southeast 1/4 of said Section 29; thence
running North 165.9 feet; thence running West along the southerly
right-of-way line of Stewart Avenue for 50 feet, more or less;
thence running South 166.5 feet; thence running East 50 feet to
the Point of Beginning.
Section 2. it is hereby found that this zoning
classification change:
(a) Is in conformity with the adopted Miami
Comprehensive Neighborhood Plan;
(b) Is not contrary to the established land use
pattern;
(c) Will not create an isolated district unrelated to
adjacent and nearby districts;
(d) Is not out of scale with the needs of the
neighborhood or the City;
(e) Will not materially alter the population density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets,
etc.;
(f) Will not adversely influence living conditions in
the neighborhood;
(g) Will not create or excessively increase traffic
congestion or otherwise affect public safety;
(h) Will not create a drainage problem;
(i) Will not seriously reduce light and air to
adjacent area;
(j) Will not adversely affect property values in the
adjacent area;
(k) Will not be a deterrent to the improvement or
development of adjacent property in accord with
existing regulations; and
(1) Will not constitute a grant of special privilege
to an individual owner as contrasted with
protection of the public welfare.

Section 3. It is hereby found that the subject property is
eligible for this historic designation under criteria numbers 1
and 2, as set forth in Section 1604.1 of Article 16 of Ordinance
No. 9500, the Zoning Ordinance of the City of Miami, Florida.
Section 4. The "Designation Report," accepted by the
Chairman of the Miami Heritage Conservation Board, on
November 15, 1988, is hereby adopted and incorporated herein by
reference.
Section 5. Page No. 48 of the Zoning Atlas, incorporated in
said ordinance by reference and description in Article 3, Section
300 thereof, is hereby amended to reflect the herein zoning
changes.
Section 6. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
Ordinance are hereby repealed.
Section 7. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 8. This Ordinance shall become effective thirty
(30) days after final reading and adoption hereof, pursuant to
law.

Consideration of recommendations concerning an
amendment to the Official Zoning Atlas of,
Ordinance 9500, Zoning Ordinance of the City of
Miami, Florida, as amended, to apply Section
1610. HC-I: General Use Heritage Conservation
Overlay District to the subject property, as
described in the designation report, and
retaining the underlying zoning district,
REQUEST To apply the HC-1 overlay to this historic site
as described in the designation report.
ANALYSIS The Marjory Stoneman Douglas House is primarily
significant as the long-term residence of
Mrs. Douglas, well-known Florida author,
historian, conservationist and civic activist.
Mrs. Douglas is best known for her role in
protecting the Florida Everglades through the
authorship of "The Everglades: River of Grass"
in 1947. She formed Friends of the Everglades
several decades later to continue to restore and
maintain the area's natural state. At age 98,
Mrs. Douglas is still active in conservation
efforts and has been nationally recognized for
them. She has been named a "Great Floridian." by
the Florida Cabinet.

The Florida Department of Natural Resources has
expressed an interest in purchasing Mrs.
Douglas' house. Whereupon the house would
become a public museum upon her demise, open by
appointment only. Application of the HC-1
overlay would require that all future
alterations to -the house and site be approved by
the Heritage Conservation Board.
The Marjory Stoneman Douglas House has been
included in the .Future. Land Use Map series of
the Miami Comprehensive Neighborhood
Plan 1989-2000 as a potential historic site.
RECOMMENDATIONS (See designation report).
HERITAGE CONSERVATION Approval, 7 to 0.
PLANNING DEPT. Approval.
PLANNING ADVISORY BOARD At its meeting of April 5, 1989, the Planning
Advisory Board adopted Resolution PAB 17-89, by
an 8 to 1 vote, recommending approval. of the
above to the City Commission.
Five replies in favor and three objections were
received by mail.
CITY COMMISSION At its meeting of May 25, 1988, the City Commission
passed the above on First Reading.

SIGNIFICANCE
Statement of Significance:
The Marjory Stoneman Douglas House is significant for its association
with Marjory Stoneman Douglas, well-known Florida author, historian,
conservationist, and civic activist. The building is also a fine
example of Masonry Vernacular architecture in Dade County in the
1920's.
Marjory Stoneman Douglas is best known for her role in promoting the
protection of Florida's critical environments, particularly • the
Everglades. The publication of her book The Everglades: River of
Grass in 1947 focused national attention on this unique resource, and
she became the guiding force behind the creation of Everglades
National Park. She formed Friends of the Everglades several decades
later to continue to restore and maintain the area's natural state.
Marjory Stoneman Douglas arrived in Miami in 1915. She came here to
obtain a divorce to end a brief and unhappy marriage and to. visit her
father, Judge Frank B. Stoneman, the editor of the Miami Herald since
its inception.
Marjory Stoneman Douglas worked at the Herald until World War I, when
she left to enlist in the Navy. She spent some time overseas and
later returned to the Herald as associate editor and columnist. A few
years later she left the Herald and began to free=lance.
In 1926, she began the construction of a house in Coconut Grove for
herself. Mrs. Douglas refers to the house as "the house that Saturday
Evening Post built," because every time she sold a story, she added on
to it. The 1926 hurricane did no severe damage to the house because
it was in a rough state of completion at the time the storm struck.
Marjory Stoneman Douglas has lived and worked in her Stewart Avenue
home for over 60 years. During this time she has written several
books of regional and national importance, including: The Everglades:
River of Grass, Voice of the River (her autobiography), Alligator
Crossing, Florida: The Long Frontier, Road to the Sun. and Hurricane,
as well as short stories and a play, "The Gallows." At .age 98,Mrs.
Douglas is still active in conservation efforts and has been
nationally recognized for them. She has been named a "Great
Floridian" by the Florida Cabinet.

Relationship to Criteria for Designation:
The Marjory Stoneman Douglas house is eligible for designation under
the following criteria:
1. Is associated in a significant way with the life of a person
important in the past.
The Marjory Stoneman Douglas house has been the primary residence
for Mrs. Douglas for over 60 years. She is a nationally
recognized conservationist and author.
2. Embodies those distinguishing characteristics of an architectural
style, or period, or method of construction.
The Marjory Stoneman Douglas House is a fine example of Masonry
Vernacular architecture in Dade County in the 1920's. It is
noteworthy for its roof type, use of materials, and half-timber
details.

III. HISTORICAL INFORMATION

istorical Context:
Marjory Stoneman Douglas was born in .1890 in Minneapolis, Minnesota.
Her parents separated when she was an early age, and she was raised in
Taunton, Massachusetts by her maternal grandmother. Her mother
suffered mental illness and died in 1912, the year Mrs. Douglas
graduated from Wellesley.College.
After a brief and unhappy marriage, Mrs. Douglas joined her father,.
Judge Frank B. Stoneman, in Miami in 1915. Her father had just
founded the Miami Herald and Mrs. Douglas joined the staff as society
columnist. She left the paper in 1918 to join the Navy in World War
I. She lived overseas and worked with the Red Cross. When she
returned to Miami in 1920, she rejoined the erald and worked as
associate editor. Once again, she resigned and began a career as a
short story writer and novelist.
Mrs. Douglas built her house in 1926 with the intention of it being
her "workshop" with small sleeping quarters attached. The lot was
originally part of a piece of land known as "The Patch." Henry
Schultz divided the parcels into four sections, keeping one for
himself and selling the others to Mrs. Douglas and other friends.
Mrs. Douglas has lived and worked in .the house for over 60 years. She
has written all her major novels and short stories at this house and
has organized her conservation efforts there.

IV. ARCHITECTURAL INFORMATION
Description of Buildin
The Marjory Stoneman Douglas House is a one-story, irregular -shaped
structure of wood frame construction. The primary facades of the
building are faced with stucco with wood half-timber details, while
the remainder is board and batten. The house is topped with a hipped
roof, with a rear gable roof, both of which are covered with
composition shingles. The wide, rounded eaves of the roof and the
half timbering are reminiscent of English country houses.
The main entrance to the house is located on the northwest corner and
is offset from the north (front) facade. The entrance features a wood
pouch door with plain stucco and vertical beam surrounds. A masonry
fireplace is located on the north (front) facade.
A small addition housing a kitchen and storage room was constructed on
the west facade in 1948.
Description of Site:
The Marjory Stoneman Douglas House is located just west of S. W. 37
Avenue in Coconut Grove. The house faces north and is recessed on a.
narrow, long lot.

V. PLANNING CONTEXT
Present Trends and Conditions:
The Marjory Stoneman Douglas house has been occupied and owned by Mrs.
Douglas since its construction in 1926. The house is in good
condition, and Mrs. Douglas intends to reside in the house until her
death.
The house is located in a quiet, stable residential neighborhood' in
south Coconut Grove.
Conservation bjectives:
The Florida Department of Natural Resources has expressed interest in
the purchase of the Marjory Stoneman Douglas House. Mrs. Douglas
would continue to reside in her home until her death, whereupon the
house would become a public museum, open by appointment only. The
Land Trust of Dade County, Inc. is interested in acting as curator.
If the house is acquired by the State, the following actions will have
to be taken in order to accommodate the visitors and their vehicles:
1.- Acquisition of the adjoining house to serve as a visitor center,
small bookstore (for Mrs. Douglas' books only) and rest rooms.
2. Installation of a parking area sufficient for seven vehicles,
which may require a cul-de-sac or the paving of the front yard of
the visitor center.
3. As the Douglas House and visitor center would be owned by the
State, rezoning of the underlying zoning to GU Government Use
would be appropriate.
4. To separate the compound from the adjacent residences, a thick
hedge would be planted both to maintain the ambiance of the
Douglas House and reduce whatever the visitor impact may be on
surrounding houses.

VI. HC ZONING ELEMENTS
Boundaries:
The boundaries of the HC zoning district have been drawn to include
the entire tract owned by Mrs. Douglas.
Maior Exterior Surfaces Sub.iect to Review:
The north, west, and east facades shall be considered major exterior
surfaces subject to review.
Major Landsca'oe Features Subject to Review:
The major landscape features subject to review shall include all
features which are subject to requirements for tree removal permits,
as set forth in Chapter 11 of the City Code.
