S9- - (; 37 A RESOLUTION AUTHORIZING AN INCREASE IN THE CONTRACT AMOUNT OF $180,000.00 IN THE CONTRACT BETWEEN THE CITY OF MIAMI, FLORIDA AND DANVILLE-FINDORFF, INC., DATED JUNE 19, 1987 FOR THE CONSTRUCTION OF BAYFRONT PARK REDEVELOPMENT PH. III CIP PROJECT NO 331302, SAID FUNDS TO BE PROVIDED FROM THE CAPITAL IMPROVEMENTS ORDINANCE NO. 10521, WITH FUNDS ALREADY ALLOCATED TO THE PROJECT; FURTHER RATIFYING THE CITY MANAGER'S WRITTEN FINDING THAT THE HEREIN INCREASE RESULTED FROM EMERGENCY CIRCUMSTANCES BY AN AFFIRMATIVE VOTE OF FOUR -FIFTHS OF THE MEMBERS OF THE CITY COMMISSION, AND ADOPTING THE FINDINGS AND CONCLUSIONS SET FORTH IN THE PREAMBLE OF THIS RESOLUTION. WHEREAS, there exists a contract dated June 19, 1987 between the City of Miami, Florida and Danville-Findorff, Inc., for BAYFRONT PARK REDEVELOPMENT PH. III CIP Project No. 331302; and WHEREAS, an increase in contract of $180,000.00 is required to cover the cost of additional modifications and work not contemplated on the original plans and specifications. This work was particularly important and covered the construction of handicap facilities and ramps, as mandated by federal standards; and WHEREAS, the City Manager has made a written finding that a valid emergency existed for the work to be done; and a _r WHEREAS, the Director of the Department of Public Works recommends the herein increase in contract to cover the additional costs; and WHEREAS, funds to cover the increase are available from - money already appropriated to the project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The written finding of the City Manager set forth in the Preamble to this Resolution is hereby ratified by an affirmative vote of four -fifths of the City Commission, and adopted as if fully set forth in this section. Section 2. The contract between the City of Miami, Florida and Danville-Findorff, Inc. for the construction of Bayfront Park Redevelopment Ph. III CIP Project No. 331302 dated June 19, 1987 is hereby increased by $180,000.00 with funds for the increase being hereby allocated from monies already appropriated to the Project. Section 3. III CIP Project No. 331302 Resolution for Increase in Contract REFERENCES: ENCLOSURES: It is respectfully recommended that the City Commission adopt the attached resolution authorizing an increase in contract in the amount of $180,000.00 in the contract between the City of Miami, Florida and Danville-Findorff, Inc, for the construction of BAYFRONT PARK REDEVELOPMENT - PH. III CIP Project No. 331302; said funds to be provided from the Capital Improvements Ordinance No. 10521 with funds already allocated to the project; further ratifying the City Manager's written finding that the herein increase resulted from emergency circumstances by an affirmative vote of four -fifths of the members of the City Commission and adopting the finding and conclusions set forth in the preamble of this resolution. BACKGROUND: The Department of Public Works evaluated the elements which remained to be constructed as part of the Bayfront Park Redevelopment project, and determined that there existed a real need for the construction of these items under the existing contract and that it is in the best interest of the City to increase the contract amount on this project by an amount not to exceed $180,000.00 The plans and specifications for the redevelopment of the Bayfront Park did not include design for construction of handicap facilities and ramps, as mandated by federal standards. 11 11 Honorable Mayor and Members of the City Commission Page 2 The design professionals involved with the project and City Staff have concurred that having this work performed by the contractor already on the job was in the best interest of the City. Closing out this project and re -bidding it to other contractors would have created a substantial delay in completion of the park. In addition to this, a new contractor at the site would have resulted in more mobilization charges and a potential weakening in guarantees and accountability, since the second- contractor would have interfaced with the original contractor's work. Funding to cover this increase in contract is available in the gayfront Park Redevelopment Ph. III Project, CIP No. 331302. As required by City ordinances, an increase of $10,000 or more in a City contract must be accompanied by a finding by the City Manager that the increase resulted from emergency circumstances, and such a finding has been prepared and signed. III CIP Project No. 331302 Emergency Need for Increase REFERENCESI n Contract ENCLOSURES Based on information supplied to me by the Director of the Department of Public Works, I have found that there exists an emergency need for an increase in contract amount of $180,000.00 in the contract between the City of Miami, Florida and Danville-Findorff, Inc. for the construction of Bayfront Park Redevelopment Ph. III. The reason for the emergency need is as follows: The plans and specifications for the redevelopment of Bayfront Park did not include extensive unforeseen modifications that arose during the construction phase of the project. These included construction of handicap facilities as mandated by federal standards. This work needed to be accomplished by the contractor working on the project in order to save time and adhere to City commitments for the completion of the park. The design professionals involved with the project and City Staff concurred that including this work under the existing contract was to be in the best interest of the City. EMP:emp
