VILA & ASSOCIATES, INC. DATED OCTOBER 280 1987 FOR THE CONSTRUCTION OF S.E. OVERTOWN/PARK WEST PAVING PROJECT - PHASE I CIP PROJECT NO 341105, SAID FUNDS TO BE PROVIDED FROM THE CAPITAL IMPROVEMENTS ORDINANCE NO. 10521, WITH FUNDS ALREADY ALLOCATED TO THE PROJECT; FURTHER RATIFYING THE CITY MANAGER'S WRITTEN FINDING THAT THE HEREIN INCREASE RESULTED FROM EMERGENCY CIRCUMSTANCES BY AN AFFIRMATIVE VOTE OF FOUR - FIFTHS OF THE MEMBERS OF THE CITY COMMISSION, AND ADOPTING THE FINDINGS AND CONCLUSIONS SET FORTH IN THE PREAMBLE OF THIS RESOLUTION. WHEREAS, there exists a contract dated October 28, 1987 between the City of Miami, Florida and M. Vila & Associates, Inc. for S.E. OVERTOWN/PARK WEST PAVING PROJECT - PHASE I CIP Project No. 341105; and WHEREAS, an increase in contract of $48,496.74 is required to cover the cost of modifications to the Overtown Metrorail Station, required by Dade County, removal and disposal of concrete road base and extra thick asphaltic concrete surface; _t and WHEREAS, the City Manager has made a written finding that a valid emergency existed for the work to be done; and WHEREAS, the Director of the Department of Public Works 4 recommends the increase in contract to cover the additional costs; and WHEREAS, funds to cover the increase are available from money already allocated to the project; and WHEREAS, all of the work included in the contract and the proposed increase in contract has been satisfactorily completed by M. Vila & Associates, Inc. and they have furnished the required documents certifying that all bills for labor and materials have been paid in full in connection with the aforesaid contract; CITY COMMISSION MEETING OF JUL 13 1989 1N Nn VAl 561 i �i sa NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. After a duly held public hearing, the finding of the City Manager set forth in the preamble to this resolution is hereby ratified by an affirmative vote of four - fifths of the City Commission, and adopted as if fully set forth in this section. Section 2. The contract between the City of Miami, Florida and M. Vila & Associates, Inc. for the construction of S. E. Overtown/Park West Paving Project - Phase I CIP Project No. 341105 dated October 28, 1987 is hereby increased by $48,496.74 with funds for the increase to be provided from monies already allocated in the Capital Improvements Ordinance No. 10521, adopted November 17, 1988. Odio Contract City Manager ENCLOSURES RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached resolution authorizing an increase in contract in the amount of $48,496.74 in the contract between the City of Miami, Florida and M. Vila b Associates, Inc. for the construction of S.E. OVERTOWN/PARK WEST PAVING PROJECT - PHASE I CIP Project No. 341105; said funds to be provided from the Capital Improvements Ordinance No. 10521 with funds already allocated to the project; further ratifying the City Manager's written finding that the herein increase resulted from emergency circumstances by an affirmative vote of four -fifths of the members of the City Commission and adopting the finding and conclusions set forth in the preamble of this resolution. 1 1BACKGROUND: The Department of Public Works has determined that it is now in order for the Commission to authorize an increase in contract amount for the S.E. Overtown/Park West Paving Project - Phase I CIP Project No. 341105. Dade County required relocations and modifications to the Overtown Metrorail Station in conjunction with the paving project. Also unforeseen concrete road base and asphaltic concrete surface, exceeding 3" in thickness, was encountered during the street rebuilding and had to be removed. —.+ As required by City ordinances, an increase of $10,000 or more in a City contract must be accompanied by a finding by the City Manager that the increase resulted from emergency circumstances, and such a finding has been prepared and signed. It is further required -that a Public Hearing be held, and the Public Hearing has been scheduled. The contractor on the project has satisfactorily completed all of the work included in the original contract, and the work covered by the proposed $48,496.74 increase in contract, for a total cost of $1,455,121.14. OVERTOWN/PARK WEST PAVING PROJECT - PHASE 1 CIP Project No. 341105 Emergency Need for Increase REFERENCES : in Contract ENCLOSURES: Based on information supplied to me by the Director of the Public Works Department, I have found that there exists an emergency need for an increase in contract amount of $48,496.74 in the contract between the City of Miami, Florida and M. Vila & Associates, Inc. for the construction of S.E. Overtown/Park West Paving Project - Phase 1. The reason for the emergency need is as follows: Relocations and modifications to the Overtown —1 Metrorail Station, required by Dade County.. Removal and disposal of additional unforeseen - concrete road base. Removal and disposal of asphaltic concrete surface exceeding 3" in thickness. LAP:mh
