ORDINANCE NO.
AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE
NO. 10521, ADOPTED NOVEMBER 17, 1988, AS
AMENDED, THE CAPITAL APPROPRIATIONS
ORDINANCE, BY ESTABLISHING THE PROJECT
ENTITLED "MIAMARINA - FISHERMEN'S PIER 5",
PROJECT NO. - 413013, IN THE AMOUNT OF
$1,532,200 FROM SUNSHINE STATE LOAN BOND
POOL; CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 10521 on
November 17, 1988, which established appropriations for the
implementation of Capital Improvements in the City of Miami; and
WHEREAS, in accordance with Section 2.136 of the Miami City
Code (1980), the Planning Department has prepared and submitted
to the City Commission a Capital Improvements Program (CIP) that
identifies the sources of funding of all proposed capital
projects valued at $5,000 or more for the program years 1988-
1994; and
WHEREAS, there exists an agreement between the City of Miami
and the fleet of commercial fishermen that operated out of
Miamarina before the construction of Bayside whereby the City is
committed to construct docking facilities for the fleet; and
WHEREAS, the total projected cost of this project is
$1,531,200, and monies are available from the Sunshine State Loan
Bond Pool to cover said expenses;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Section 1 of Ordinance No. 10521, as
amended, adopted November 17, 1988, is hereby amended in the
following particulars: 1/

remaining provisions are now in effect and remain unchanged.

"Section 1 The herein appropriations are
hereby made for implementation of all municipal capital
improvements of the City of Miami, including new
capital improvement projects scheduled to begin during
Fiscal Year 1988-89. The herein appropriations which
are hereby designated by reference to descriptive
project title number also include appropriations for
previously approved scheduled projects as well as
reappropriations of prior fund appropriations. The
source of revenues to support the herein appropriations
is hereby identified by fund and project with the
project appropriations and revenues therefor being set
forth for seven (I-VII) program areas based upon use or
functional category within said areas, as follows:

Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective 30 days
after reading and adoption thereof.

It is respectfully recommended that the City Commission adopt the
attached ordinance amending the Capital Appropriatiuns Ordinance
No. 10521, establishing appropriations for Miamarina - Fishermen's
Pier 5", Project No. 413013, in the amount of $1,531,200 from the
Sunshine State Loan Bond Paul.
BACKGROUND
The Department of Public Works has determined that there *exists an
emergency n.eed to establish appropriations -for the project entitled
"Miamarina - Fishermen's Pier 5". Preliminary estimates place the
cost of the project at $1,531,200.
There is a need to construct pier facilities for the commercial
fishing fleet that operated out of Miamarina prior to the
construction of Bayside. An agreement has been reached whereby the
City will provide a facility for the fishermen's use in the
Miamarina area, which pier will contain 35 full slips, and
amenities including canopies. finger piers, booths, cutting tables,
etc.
This amendment is being presented so that the project can be
established, and construction completed by October 1989. Funds are
available from the Sunshine State Loan Bond Pool.
