ORDINANCE NO.
AN ORDINANCE AMENDING SECTION 2-316 OF THE
CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, WHICH GENERALLY REQUIRES THAT A
LOBBYIST SUBMIT A STATEMENT UNDER OATH
LISTING ALL LOBBYING EXPENDITURES AND THE
SOURCES FROM WHICH FUNDS FOR SUCH
EXPENDITURES HAVE COME, BY CHANGING THE
FILING REQUIREMENT FROM A QUARTERLY TO A
YEARLY FILING; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA:
Section 1. Section 2-316 0£ the Code of the City of
Miami, Florida, as amended, is hereby amended in the following
particulars`/ :
"Sec. 2-316. Quarterly Annual statements.
A lobbyist shall quarberty annually submit
to the city clerk's office a signed statement
under oath listing all lobbying expenditures
and the sources from which funds for making
lobbying expenditures have come. The
lobbying expenditures shall include, but not
be limited to, all expenses of any nature or
kind for or on behalf of the lobbyist and for
expenses for lodging, meals, entertainment
and travel of the lobbyist and the identity
and address of any guest. Such statements
shall be rendered on the form provided by the
city clerk's office and shall be open to
public inspection. Such statements shall be
filed, even if there have been no
expenditures during a reporting period until
such time as a notice of withdrawal of
lobbying activities is filed by the lobbyist
with the city clerk."
Section 2. All Ordinances or parts of Ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 3. If any section, part of this section,
paragraph, clause, phrase or word of this Ordinance is declared

remaining provisions are now in effect and remain unchanged.

As evident from the attached memorandum, the City Clerk has
requested that Section 2-316 of the City Code be amended to
provide for Annual instead of Quarterly statements from Lobbyists
regarding funds and expenditures. Our office recommends that the
City Commission approve the attached Ordinance amending the City
Code to provide for Annual instead of Quarterly statements from
Lobbyists.

ENCLOSURES:
The administrative function of processing lobbyists' quarterly
reports has turned into a massive paper -processing operation.
We hereby respectfully- request that you consider and advise
this office as to whether the originating ordinance could
be amended to require annual filing of said reports rather
than the quarterly filing presently required under said
ordinance.
The administrative function of keeping track of these filings
has. been substantially worsened due to the fact that we have
been forced to follow up, monitor, and report to your office
a large number of lobbyists who do not comply with the quarterly
filing requirement as presently outlined under Ordinance 10087.
If a finding were made by you, upon review of our request,
that an annual filing of reports would still satisfy the spirit
of the ordinance, I hereby respectfully request that you assist,
this office by drafting the appropriate legislation which
could then be presented to the City Commission for consideration
of said request.
We sincerely thank you for your continued assistance to this
office.
