AN ORDINANCE AMENDING SECTION 5 OF ORDINANCE
NO. 6145, ADOPTED MARCH 19, 1958, AS AMENDED,
WHICH ESTABLISHED FEES FOR BUILDING, PLUMBING,
ELECTRICAL, MECHANICAL (INCLUDING BOILER AND
ELEVATOR) INSPECTION, PERMIT AND CERTIFICATE FEES,
BY INCREASING PERMIT FEES AND MAKING VARIOUS
CORRECTIONS OF SCRIVENERS' ERRORS IN SAID
SECTION 5, TO IMPROVE THE OPERATION AND COVER THE
COST FOR THE ENFORCEMENT OF THE SOUTH FLORIDA
BUILDING CODE; CONTAINING A REPEALER PROVISION,
AND A SEVERABILITY CLAUSE.
WHEREAS, the City Manager recommends that in order to
provide much needed services for the operation of the City of
Miami by adding new collection procedures, increase permit fees
and correct certain scrivener errors to improve and cover the
cost of the operation of the enforcement of the South Florida
Building Code;
WHEREAS, it is essential that provisions for the services as
provided herein be incorporated;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Section 5 of Ordinance No. 6145, adopted
March 19, 1958, as amended, which provides fees for building,
plumbing, electrical and mechanical (including boiler and
elevator) inspection, permit and certificate fees, is hereby
amended in the following particulars:l/

Underscored words and/or figures shall be added. The
remaining provisions are now in effect and remain unchanged.

Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective 30 days
after final reading and adoption thereof.

ENCLOSURES:
In July of 1993, as a result of Hurricane Andrew, the Building
and Zoning Department increased some of the fees in order to
better enforce the South Florida Building Code . Since that
time, the aftermath of the hurricane has brought on additional
changes to the code which affected the number of required
inspections to complete certain jobs.
The Building and Zoning Department has reviewed its fee schedule
and determined to bring the cost up to the level of service that
is being provided and in accordance 'to the fees of other
municipalities.
Ordinance 6145, amended by Ordinances 11078 and 10608, gives the
City Manager the authority to increase the fees, as necessary, to
enforce the code. Attached please find the list of fees that
should be increased and become effective within thirty (30) days.

It is respectfully recommended that the City Commission adopt
the attached Ordinance which amends the Permit Fee Schedule.
BACKGROUND:
1) The Building and Zoning Department has been faced with
continually reinspecting construction work because -it either
does not meet code or is not ready for inspection. The
present Permit Fee Schedule provides for reinspection fees,
however, the collection of the fees has been a problem and
.therefore a procedure is proposed whereby the applicant
places money in escrow to be used for reinspections. Any
remaining funds will be refunded at the completion and final
approval of all the work.
2) Also included in this Ordinance is the increase of various
building permit fees which have not been raised since 1981
in order to meet the' operational cost of the Building and
Zoning Department.
3) The remaining changes are mainly correc.tions of certain
scrivener errors and changes in minimum fees necessary to be
consistent in all areas of construction.
