AN EMERGENCY ORDINANCE AMENDING SECTION 1 OF ORDINANCE
NO. 10521, AS AMENDED, THE CAPITAL IMPROVEMENTS
APPROPRIATIONS ORDINANCE, BY REDUCING THE
APPROPRIATION FOR BAYFRONT PARK REDEVELOPMENT NORTH
END AMPHITHEATHER-PHASE II, ACCOUNT NO. 331302, BY
$50,000; AMENDING SECTIONS 1 AND 5 OF ORDINANCE
NO. 10484, AS AMENDED, THE ANNUAL APPROPRIATIONS
ORDINANCE, BY INCREASING THE APPROPRIATION TO GENERAL
FUND, PARKS, RECREATION AND PUBLIC FACILITIES
DEPARTMENT, IN THE AMOUNT OF $50,000, AND BY
INCREASING THE AMOUNT OF NON -REVENUES BY A LIKE SUM;
FURTHER AUTHORIZING THE CITY MANAGER TO MAKE A LINE
ITEM TRANSFER OF SAID $50,000 FROM THE GENERAL FUND OF
THE PARKS, RECREATION AND PUBLIC FACILITIES
DEPARTMENT, FISCAL YEAR 1989 BUDGET, TO THE BAYFRONT
PARK MANAGEMENT TRUST ("BPMT") LIGHT TOWER, ACCOUNT
NO. 067009646; CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the renown and celebrated Laser Light Tower is now
substantially operational and will soon bathe downtown in an attractive series
of lighting effects; and
WHEREAS, the City pursuant to a certain Grant Agreement with the Knight
Foundation relative to the Laser Light Tower is required to make an annual
contribution of $50,000 towards the Light Tower's operation and maintenance;
and
WHEREAS, the City is desirous of immediately and completely effectuating
its annual contribution for the 1989 Fiscal Year; and
WHEREAS, the passage of this amendatory Ordinance is necessary on an
emergency basis to protect the public health, safety and general welfare and
to implement the timetables for completion of various Bayfront Park
improvements which had been intended;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Section 1 of Ordinance No. 10521, as amended, the
Capital Improvements Appropriations Ordinance, adopted November 17, 1988, is

hereby amended in the following particulars:
"Section 1. The herein appropriations are hereby made for
implementation of all municipal capital improvements of the City of
Miami, including new capital improvement projects scheduled to begin
during fiscal year 1988-1989. The herein appropriations which are
hereby designated by reference to descriptive project title and number
also include appropriations for previously approved scheduled projects
as well as reappropriations of prior fund appropriations. The source of
revenues to support the herein appropriations is hereby identified by
fund and project with the project appropriations and revenues therefor
being set forth for seven program (I-VII) areas based upon use or
functional category within said areas, as follows:

Section 2. Sections 1 and 5 of the Ordinance No. 10484, as
amended, adopted September 27, 1988, the Annual Appropriations Ordinance, is
hereby amended in the following particulars:l/
"Section 1. The following appropriations are made for the
municipal operations of the City of Miami, Florida, for the Fiscal
Year 1988-89, including the payment of principal and interest on
all General Obligation Bonds:

Section 3. The Finance Director is further authorized and
directed to transfer as a line item $50,000 from the Parks, Recreation and
Public Facilities Department Aid to Government Agencies, Account
No. 580301-925, increasing the Parks, Recreation and Public Facilities
Department's Aid to the Bayfront Park Management Trust's ("BPMT") Fiscal Year
1989 into BPMT Account No. 067009646. This serves as the City's $50,000
contribution to the Laser Light Tower for Fiscal Year 1989. The BPMT
Executive Director is instructed to segregate these funds and use them solely
for operation and maintenance of the Laser Light Tower.
Section 4. All ordinances or parts of ordinances insofar as they
are inconsistent or in conflict with the provisions of this Ordinance are
hereby repealed.
Section 5. If any section, part of section, paragraph, clause, or
ward of this Ordinance is declared invalid, the remaining provisions of this
Ordinance shall not be affected.
Section 6. This Ordinance is hereby declared to be an emergency
measure on grounds of urgent public health, safety and property of the City of
Miami and upon the further ground of the necessity to make the required and
necessary payments to its employees and officers, payment of its debts,
necessary and required purchases of goods and supplies, and to generally carry
on the function and duties of municipal affairs.

Section 7. The requirements of reading this Ordinance on two
separate days is hereby dispensed with by an affirmative vote of not less than
four -fifths of the members of the Commission.
Section S. This Ordinance shall became effective immediately upon
its adoption.

It is respectfully recommended that the City Commission adopt the
attached emergency ordinance amending the Capital Appropriations
Ordinance No. 10521, reducing appropriations for "Bayfront Park
Redevelopment North End Amphitheater Phase II", Project No. 331302,
in the amount of $50,000; amending the Annual Appropriations
Ordinance No. 10484, increasing the appropriations for "Parks,
Recreation, and Public Facilities Department", in the amount of
$50,000;-and authorizing the City Manager to transfer these same
$50,000 to the Bayfront Park Management Trust Light Tower.
BACKGROUND
The Department of Public Works has determined that there exists an
emergency need to decrease appropriations for the project entitled
"Bayfront Park Redevelopment North End Amphitheater Phase II" in
the amount of $50,000, to increase the appropriations in the
general fund for the Department of Parks, Recreation and Public
Facilities in the same $50,000, and to make a line item transfer of
these $50,000 from the Parks Department Budget to the Bayfront Park
Management Trust - Light Tower.
The City of Miami has committed to a contribution of $50,000
towards the maintenance of the light tower at Bayfront Park,
pursuant to an agreement with the Knight Foundation. The light
tower is substantially operational and will soon begin projection
of its computerized laser programming.
At this time, the City is anxious to finalize its contribution for
the maintenance portion of its obligation, and to continue to
implement the timetables and schedules agreed upon and committed to
in conjunction with the construction and redevelopment of Bayfront
Park. This amendment is being presented so that the project can
proceed without interruption.
