Res Appeal of the Attached Planning Director's
Decision of April 4, 1989 to Rescind the Class
"C" Special Permit C-88-1130
Dear Gloria:
Please consider this letter an appeal, pursuant to Section
2551 of the Zoning Ordinance 9500, of the Planning Director's
decision to rescind the above -referenced Class "C" permit. The
grounds for this appeal are as follows:
1. The applicant was successful in seeking a rezoning
} from RG-2.1/3.3 to RG-2.1/5 increasing the FAR to .75 on May 28,
1987-(see attached legislation).
t 2. The client, in reliance upon said zoning, purchased
the property in October, 1988.
3. A Class "C" permit was issued in September, 1988 for
the new construction of a five story apartment building with
twenty living units. (See attached application and approval of a
Class "C" permit) .
4. The Zoning Department signed off on the plans sub-
witted pursuant to the Class "C" permit application on December
23,1988, indicating that the project was in conformance with .the
toning Code.
■
5. Relying on the issuance of the Class "C" permit, the
sippliaant spent over $70,000, exclusive of interest in fury
1, tterance of this development. f—
