HomeMy WebLinkAboutR-89-07510 J-89-706(a) 7/31/80 RESOLUTION NO. 8 ';1' A RESOLUTION DENYING THE APPEAL AND AFFIRMING WITH MODIFICATIONS THE ZONING BOARD'S REVERSAL OF THE PLANNING DIRECTOR'S DENIAL OF THE CLASS C SPECIAL PERMIT (C-88-1130) FOR THE CONSTRUCTION OF AN EIGHTEEN (18) UNIT APARTMENT BUILDING FOR THE PROPERTY LOCATED AT 2100 BRICKELL AVENUE, MIAMI, FLORIDA (MORE PARTICULARLY DESCRIBED HEREIN); AND GRANTING, AS MODIFIED, SAID CLASS C SPECIAL PERMIT (C-88 -1130) FOR AN EIGHTEEN (18) UNIT APARTMENT BUILDING; PROVIDING FOR THE GRANTING OF THIS CLASS C SPECIAL PERMIT UPON THE CONDITION THAT TWENTY-SIX (26) PARKING SPACES BE PROVIDED BY THE APPLICANT AND UPON THE FURNISHING TO THE CITY OF A GENERAL RELEASE BY THE APPLICANT. WHEREAS, the Miami Zoning Board at its meeting of June 19, 1989, Item No. 1, following an advertised hearing, adopted Resolution No. ZB 65-890 by a seven to two (7 - 2) vote, reversing the Planning Director's decision which denied the Class C Special Permit (C-88-1130) for the construction of a twenty (20) unit apartment building for the property located at 2100 Brickell Avenue, Miami, Florida; and WHEREAS, neighboring property owners have taken an appeal to the City Commission from the Zoning Board's decision; and WHEREAS, Zoning Board Resolution No. ZB 65-89 and the findings of the Zoning Board relative to said Resolution No. ZB 65-89 have been reviewed by the City Commission; and WHEREAS, the City Commission in its herein modification of the June 19, 1989 decision of the Zoning Board has considered that there was a rezoning of this property on May 28, 1987, from RG-2.1/3.3 to RG-2.1/5, increasing the FAR to .75, and that the Applicant, in apparent reliance on the said rezoning, purchased the property in October of 1988 after being informed by the City's Planning Director in September of 1988 that the zoning under Zoning Ordinance No. 9500, as amended, the Zoning Ordinance of the City of Miami (the "Zoning Ordinance"), permitted a twenty CITY COMMISSION MEETING OF JUL pp31 19899 A No. 89� (20) unit apartment building upon this site and, in additionf the Applicant received on December 23t 1988 a written affirmation from a stoning inspector of the City of Miami, in conjunction with its application for a Class C Special Permit, that this proposed apartment building was in conformity with all requirements of Zoning ordinance No. 9500; and WHEREAS, the City Commission, after careful consideration of this matter, and based upon all of the evidence presented at the City Commission, deems it advisable and in the best interests of the general welfare of the City of Miami and its inhabitants to confirm the issuance of the conditional Class C Special Permit (C-88-1130), as herein modified; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble of this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section 1. Section 2. The appeal from the decision of the Zoning Board to reverse the Planning Director's decision not to issue a Class C Special Permit (C-88-1130), for the construction of a twenty (20) unit apartment building for the property located at 2100 Brickell Avenue, Miami, Florida, also described as Lots 79 & 80, Block 56, FLAGLER MARY BRICKELL, as recorded in Plat Book 5, at Page 44, of the Public Records of Dade County, Florida, is hereby denied. Section 3. Subject to the modifications being hereby made by the City Commission, the Class C Special Permit shall be issued for an eighteen (18) unit apartment building on the following conditions, to be complied with prior to the issuance of a building permit: a. The Applicant is to provide twenty-six (26) parking spaces for the building's tenants, owners and guests.
