' i V , A RESOLUTION MODIFYING THE DECISION OF THE HERITAGE CONSERVATION BOARD AND GRANTING A CERTIFICATE OF APPROVAL FOR THE CONSTRUCTION OF AN EIGHT FOOT CBS WALL WITH NO TREE REMOVAL FOR THE PROPERTY LOCATED AT 3918 MAIN HIGHWAY (3665 ST. GAUDENS ROAD), COCONUT GROVE, FLORIDA. WHEREAS, the Heritage Conservation Board at its meeting of June 20, 1089, Item No. 3, following an advertised public hearing adopted Resolution No. KC-89-16 by a seven to two (7-2) vote granting a Certificate of Approval for the construction of an six foot wail rather than the requested eight foot wall with no tree removal for the property located at 3918 Main Highway (3668 St. Gaudens Road), Coconut Grove, Florida; and WHEREAS, the applicant has taken an appeal to the City Commission from the decision of the Heritage Conservation Board; and. WHEREAS, the City Commission after careful consideration of this matter and notwithstanding the decision of the Heritage Conservation Board, finds that peculiar circumstances exist which do impair the owner's right to some reasonable use of the property; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The decision of the Heritage Conservation Board In this matter is hereby modified and the requested application for a Certificate of Approval for the construction of an eight foot CBS wall with no tree removal for the property located at 3918 Main Highway, (3668 St. Gaudens Road), Coconut Grove, Florida, is hereby granted. Section 2. In accordance with Section 17- 15(b) of Chapter 17 of the Miami City Code, the City Commission must render a decision within 45 days of the filing of the appeal to affirm, modify, or -_ reverse the Board's decision, which permitted a six foot wall, after which the Board's decision stands. BACKGROUND: Main Highway has been designated as both a local Scenic Transportation Corridor and a State Historic Highway. Consequently, all development activity within 20 feet of the right-of-way requires review and approval by the Heritage Conservation Board. The Board and the Planning Department have consistently denied permits for all walls along Main Highway, unless either of two conditions has been met (as set forth in the attached Evaluation Sheet). No eight foot walls have ever been approved. The Board's denial of the wall was based on the following considerations: I. An eight foot wall is out of character with Main Highway; the character of Main Highway is comprised of low coral rock walls, vistas of historic buildings, and irregularly spaced vegetation, not a solid wall of vegetation. 2. The approval of such a wall would set a precedent for future eight foot wal 1 s. 3. There is no guarantee that vegetation in the right-of-way would be maintained. If it died or were cut back, an eight foot wall would be revealed. 4. An eight foot wall would provide virtually no more of a sound barrier than would a six foot wall; other houses are being built along Main Highway with lower walls. k K. The HCB took the action at its meeting on June 20, 1989, pur- suant to an application by Walter Lavigne as President of Lavigne Properties, Inc. It denied the request for permission to construct an eight foot CBS wall, with no tree removal and 100%vegetation coverage, along a lot adjacent to Main Highway. Instead it apnroved construction of a six foot wall with lime stone facing and 60% vegetation coverage. (See cony of decision attached). Mr. Lavigne requests that the HCB decision -be reversed for the following reasons: 1. Because of the additional 10 ft. right-of-way now required along Main Highway, 100% vegetation cover- age will be the only practical alternative to a weed and litter -strewn roadside. The developer wants to invest in a beautifully landscaped strip, including ground lighting at night, along Main Highway rather than in expensive limestone facing on a wall that, for practical reasons, will and ought to be invisible. 2. An eight foot wall built along the new 10 ft. wider " right-of-way has a visual horizon to the driver on Main Highway that is virtually identical to that of a six foot wall built along the old right-of-way. 4. Construction of an eight foot wall, which is an es-`. sential part of an effective sound buffer (especially, for a two story house), enables the. Coconut Grove residential district to continue to attract families` seeking high -end single family homes and hence to.cot tinue to augment the City's tax base. For these and other reasons, Mr. Lavigne urges the City Com- mission to allow construction of a CBS wall eight feet in height adjacent to the Main Highway right-of-way, with pro fessional-landscaping and lighting of the veeetation between.: the wall and Main Highway assuring 100% coverage of the wall,:, no tree removal, and an eye-catching appearance to all users of Main Highway. Section 17-11 (5) of Chapter 17 of the Miami City Code states that development activity should "maintain the continuity of landscape material and spacing characteristic of the surrounding area or scenic corridor. If the development occurs along a designated corridor, the principal natural landscape or man- made elements which form the visual boundaries or enclosing space of the corridor shall be preserved insofar as possible." In the case of Main Highway, the principal man- made elements are low coral rock walls. Because most typical new walls and fences would detract from the scenic character of Main Highway, the Planning Department has established guidelines whereby no new walls or fences will be authorized by the Heritage Conservation Officer unless one of the following conditions is met: 1. Only coral rock walls no more than 4 feet in height (30 inches in height within vision clearances) may be approved for placement along.the property line; 2. Coral rock, wrought iron or decorative CBS walls no more than 6 feet in height (30 inches in height within vision triangles) may be approved for placement along the property line only if Public Works allows trees and other low vegeta-Mon to be planted in the right-of-way to provide at least a 60 percent visual screening of the wall, or, unless such trees and vegetation already exist; if trees and vegetation do not exist and if Public Works does not grant approval for planting, the wall must be set back at least 5 feet from the property line, and trees and other low vegetation must be planted to provide at least 60 percent visual screening of the wall. The trees and shrubbery seen, is on the 10 foot strip which we dedicated to the city as well as on the lot itself. The zig- zag wall design permits the retention (in place) of every tree, bush and shrub. During a site visit, Mr. Byron Harms agreed that this design permits retention of existing landscaping and allows for additional plantings to insure that the wall will not be seen from Main Highway. During the same visit, he approved of our selection of areca palms, silver buttonwood and southern crepe myrtle as appropriate trees to be planted after completion of the wall, to fill any foliage gaps. Any small "see through" gaps will be covered by fiscus repans vines to be planted against the wall. At Mr. Harms request, we will remove the cherry hedge on the city's right of way and plant low ground cover such as oyster plants and/or lariope with a touch of color foliage here and there. With the addition of low landscape lights, in my opinion, this will be the outstanding frontage on Main Highway. My concern for the environment and for the ambiance of the above is evidenced by my building only 2 houses on 22,000 square feet of land and carefully designing both houses around existing trees. As these houses will sell in the $600,000 plus range, I have particular concern about the perceived noise level for the house adjacent to Main Highway, hence my request for an 8 ft. wail.
