AN EMERGENCY ORDINANCE APPROPRIATING THE SUM OF $300,000 IN SUPPORT OF THE PROGRAM OF CAREY TECHNICAL INSTITUTE, INC., A FLORIDA NOT FOR PROFIT CORPORATION ("CAREY TECHNICAL"), UPON CAREY TECHNICAL'S COMPLIANCE WITH THE TERMS AND CONDITIONS SET FORTH IN ENABLING LEGISLATION AND LOAN AGREEMENT(S) TO BE EXECUTED BY CAREY TECHNICAL, SAID $300,000 CONSISTING OF $100,000 RECEIVED FROM MIAMI CAPITAL DEVELOPMENT, INC. FROM ITS LOAN POOL FOR FY 1988-89 AND OTHER FUNDS CURRENTLY APPROPRIATED TO MIAMI CAPITAL DEVELOPMENT, INC., WITH MONIES TO BE MADE AVAILABLE BY AUGUST 15, 1989 TO CAREY TECHNICAL, AND FURTHER CONSISTING OF $100,000 FROM MISCELLANEOUS REVENUES OF THE CITY OF MIAMI FOR FY 1988-89, TO BE MADE AVAILABLE BY THE CITY MANAGER TO CAREY TECHNICAL ON OR ABOUT SEPTEMBER 1, 1989, WITH THE SUM OF $100,000 TO BE MADE AVAILABLE FROM MISCELLANEOUS REVENUES OF THE CITY OF MIAMI IDENTIFIED BY THE CITY MANAGER, TO CAREY TECHNICAL INSTITUTE ON OR ABOUT OCTOBER 1, 1989; ALL OF THE FOREGOING TO BE TRANSFERRED AND DEPOSITED IN CITY OF MIAMI SPECIAL PROJECTS AND ACCOUNTS FOR THE SOLE AND EXCLUSIVE PURPOSE OF FUNDING THE CONTINUED OPERATIONS OF CAREY TECHNICAL, IN ACCORDANCE WITH ENABLING LEGISLATION AND THE LOAN AGREEMENT(S) FOR SAID LOAN; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, Carey Technical Institute, Inc. ("Carey Technical"), a Florida not for profit corporation, which provides necessary educational, vocational and technical training to residents and use of the areas commonly known as the inner city within the City of Miami and its adjacent neighborhoods has petitioned the City of Miami to make a $300,000 loan to said Carey Technical for the purposes of assisting Carey Technical to remain open despite difficult fiscal and economic problems it is encountering so that it may continue to provide necessary training and technical guidance to disadvantaged residents of the community through which the entire City and its adjacent areas benefit by the resulting increased economic, technical and social advancement of disadvantaged residents; and ti WHEREAS, the City Commission shall authorize a loan of Three Hundred Thousand Dollars ($300,000) in accordance with the terms, conditions and stipulations contained in the security agreement, promissory note, UCC-1 financing statement, and similar loan instruments (herein collectively referred to as "loan documents") and in accordance with enabling legislation for the continued operation and existence of Carey Technical; and WHEREAS, City of Miami has been able to identify the sums of One Hundred Thousand Dollars ($100,000) as being available from the operating fund budget of Miami Capital Development, Inc. for FY 1988-89 to make the first disbursement of said loan proceeds on or about August 15, 1989, and further has identified the sum of $100,000 from miscellaneous revenues of the City of Miami for FY 1988-89, to be made available to Carey Technical, and paid on or about September 1, 1989; and WHEREAS, the City Manager shall identify the sum of One Hundred Thousand Dollars ($100,000) from miscellaneous revenues of the City of Miami for FY 1989-90, commencing on October 1, 1989, to be made available to Carey Technical for the third and final disbursement of this loan to be paid on or about October 1, 1989; NOW, THEREFORE , BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The following special projects and accounts fund is hereby established and resources are hereby appropriated as described herein for the sole and exclusive purposes of making this loan in the manner provided for by the enabling legislation and loan agreements: FUND TITLE: Special Projects and Accounts, Carey Technical REVENUES: Miami Capital Development, Inc. Operating Fund Balance for FY 1988-89 (payable on or about August 15, 1989) $100,000 ., -2- ._� ?Q�,, wi i H Miscellaneous Revenues of the City of Miami from FY 1988-89 (to be made available on or about September 1, 1989) $100,000 Miscellaneous Revenues of. the City of Miami from FY 1989-90 (to be made available on or about October 1, 1989, only under the terms and conditions of the loan agreement(s) and enabling $100,000 legislation) APPROPRIATIONS SPECIAL PROJECTS AND ACCOUNTS, CAREY TECHNICAL $300,000 Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provision of this Ordinance are hereby repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provision of this Ordinance shall not be affected. Section 5. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 6. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 7. This Ordinance shall become effective immediately upon its adoption. PASSED AND ADOPTED this llth day of August , 1989.
