Who will who would like to say a few words about our being here tonight. netts All the members of PACT are glad to be here tonight, and are happy to have met with most Comissioners on our PACT Plan . We are here because of the crisis of abandonded and open buildings we are forced to live with. In short- crack houses in our neighborhoods. Alot of people here tonight, in the comission chambers and outside and eagerly look forward to your support of Our Plan to Cjean up Miami' . We first presented the PACT PLAN on August 23rd, to Mayor Suarez and Commisioner Dawkins. And thank tyab for their attendance, and concern. That night th y/you agreed to direct the City Manager to develop a plan that addressed our concerns a plan which included our steps. On Sept. b, Mr. Odeo presented his plan to our committee, and members. So this plan (you have before you tonight) aa. Only one item, under Agreements, needs to be corrected to reflect bi-monthly sweeps (not semi-monthly). They will be conducted through your designated area by the Building and Zoning Department for a period of one year. I have indicated this in my memorandum of September 6, 1989 to the Honorable Mayor and Members of the City Commission (see attached copy). The following are my responses to your Questions: 1. Budget allocated and source of funding The budget allocated to this function includes: Building & Zoning Department $888,726 Community Development Department $329,390 Solid Waste Department $205,842 Police Department $142,574 Approximate funding required for second monthly meeting before the County's Unsafe Structures Board - $100,000 In addition, there needs to be funding for City and County attorneys to handle the cases. 2. Personnel flow chart (number of employees, job descriptions and accountability) ' Attached is the organizational chart that was proposed by the City of Miami Office of Industrial Engineering when they did the consolidation study. P.A.C.T. proposals REFERENCES Meeting of Aug. 23, 1909 ENCLOSURES This is in response to memorandums from Mayor Suarez of August 24 & 28, 1989 concerning the requests submitted to the Mayor and Commissioner Dawkins by this newly formed neighborhood association. —_' The City of Miami's Office of Industrial Engineering has been 1 conducting since June, 1989,a study on consolidation of some of our code enforcement sections. The ultimate goal is to have a coordinated and centralized code enforcement throughout the City. This consolidation will address stepping up of enforcement and will . definitely be a positive response to "People Acting for Community Together." (P.A.C.T.) proposals. At the present time, complaints on code enforcement cases are handled separately by five (5) different departments (Building & Zoning, Fire, Police, Public Works and Solid Waste). This consolidation will centralize the receiving of complaints and enforcement by the Building & Zoning Department with direct referral to the Police and Fire Departments. Coordination will be done by one Division Chief within the Building & Zoning Department with timely follow-ups and monitoring by two (2) Section Supervisors. As a consequence, considerable time will be saved in looking up and finding the status of cases. Inspectors will be cross -trained in order to eliminate referrals of cases to other environmental code enforcement inspectors, thus substantially increasing the number of cases handled without adding new personnel. In response to the specific enforcement steps identified in the P.A.C.T proposal, after the consolidation and reorganization takes place, we will be able to: 1. Have the Building & Zoning Department conduct bi-monthly sweeps for a one year period, in their designated area, in order to detect more violations and process more cases. 2. Have the Building & Zoning Director appoint a Chief of Code Enforcement Division to oversee and coordinate the abandoned structures program. =t h Honorable Mayor and Members x of the City commission Page two 3. Maximise on follow-ups and assistance by the City to the Dade County's Minimum Housing Code in a coordinated use of Chapter ` 170, by: a. Building i Zoning Department referring cases to Police Department directly. b. Police Department following up expeditiously and submitting to Dade County cases for disposition. 4. Step up our present Miami's Code Enforcement Board processing of cases, under Ordinance No. 10563, and help secure and gain compliance of the open/unsecured structures. At present: a. Owners are complying. b. We do not have City crew to do boarding up, but we do contract with private contractors as soon as due dates are up. c. We are scheduling open structures as priority cases. d. Code Enforcement Board cases are heard within 45 days from date of issuance of notice. 5. Increase the number of cases to be heard by the County's Unsafe Structures Board. We are not recommending, at this time, to create our own Unsafe Structures Board. Building & Zoning Department has been working with the County to have a second monthly meeting of the Unsafe Structures Board specifically to hear City of Miami cases only. This has received concept approval from the County Manager. If this goes into place by next month, the 400 pending cases that previously have been limited to 5 cases per month would be substantially expedited. Furthermore, a centralized computer system will be installed in the Building i Zoning Department to ascertain timely follow ups, updating of cases, and centralization of filing system, and expediting of paper work. In response to the Mayor's proposal for a whole new housing code, I have instructed the Building and Zoning Department, in conjunction with the Housing Conservation Agency, to prepare a new ordinance containing the features suggested by the Mayor. We will present it as soon as possible at a City Commission meeting after review by the Legal Department. Each owner of a residential unit other than declared homestead property would have to file quarterly reports containing the following: a) Number of residents in the property. b) Name and address of a resident agent or other person empowered by the owner'to receive complaints of code violations or of il.legal. activity in or about the premises and to remedy same. c) if cited with a City code violation, whether it's been cured. If not, the City should have the power to summarily enter the premises, secure, demolish and dispose of same as indicated. 2. If such reports are not received by the City, penalties would be assessable and liens imposed for same. Coordinated use of Chapter 17B by Mian►i Building and Zoning and Miami Police Department.iocluding the following steps: A. Building and Zoning designate staff to refer suspected cases to the Police Department for computer check of drug incidents: 8. Miami Police Department (MPD) check Miami addresses (referred by Miami or Metro) for drug incidents and refer to Minimum Housing staff within two weeks of receipt: MPD be available to accompany Minimum Housing staff to document suspected Ch. 17B buildings: and, MPD provide necessary documentation and•record keeping for successful Ch 170 cases. 4. Miami Code Enforcement Board help secure open buildings through: A. Owner compliance (CEB warnings, fines, repeat offender plans, etc.) 8. City sponsored blocking up crew/contracts C. Scheduling open buildings as priority cases, 0. Ensuring that cases are heard by CEB within 45 days of receiving case S. Creation of a City of Miami Unsafe Structures Board To arrange for City Manager Cesar Odio to develop a plan incorporating these steps, including timeframe, cost and source of funding, and meet with
