HomeMy WebLinkAboutR-89-08279/14/89 RESOLUTION NO. � 4_. o•.8 97 A RESOLUTION AMENDING SECTIONS 2 AND 3 OF RESOLUTION NO. 89-2881 ADOPTED MARCH 23, 1989 TO INCLUDE THE INSTALLATION OF A GUARD GATE IN THE CITY COMMISSION'S GRANT OF APPROVAL EXPRESSED IN SAID RESOLUTION FOR THE CREATION OF A SPECIAL TAXING DISTRICT FOR BELLE MEADE ISLAND LOCATED IN THE CITY OF MIAMI. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Sections 2 and 3 of Resolution No. 89-288, adopted March 23, 1989, are hereby amended in the following particulars:i/ "Section 2. The creation of a special taxing district on Belle Meade Island, located in the City of Miami, Florida, in accordance with Chapter 18 of the Metropolitan Dade County Code, to provide security service is hereby approved, said service to include the construction and maintenance of a guard gate and a concrete block structure guardhouse, at no cost to the City, within the public right-of-way at the northeast end of the Belle Meade Island Bridge, to be located in the swale area and not in the roadway portion of the right-of-way. Section 3. Construction of said guard gate and guardhouse shall comply with the requirements of the South Florida Building Code, and the City of Miami Public Works Department and, of Himni: to permit the constraction of guardhoti-es within the ptbl . c right of way, in full compliance with the requirements of said Ordinance City Code Section 54-10054-100." Section 2. This Resolution shall become effective immediately upon its adoption. Words stricken through shall be deleted. Underscored words shall be added. The remaining provisions are now in effect and remain unchanged. Od i c City Manager BACKGROUND DATE : Q C n - i IM FILE SUBJECT : Belle Meade Island Security Guard Special Taxing District REFERENCES: ENCLOSURES: On March 23, 1989 the City Commission passed Resolutions No. 89- 288 and 89-289. approving and supporting the special taxing district for guard protection on Belle Meade Island. Since the security guard protection also included construction of a guard house on the island, the Commission also approved Ordinance No. 10582 amending Chapter 54 of the City Code to allow the location of the guard house within the public right of way. Metropolitan Dade County has reviewed the aforementioned resolutions and ordinance and has determined that it cannot move forward with the petitioned service due to certain restrictions imposed by the City's legislation. Ordinance No. 10582 is conditioned upon the issuance of a revocable permit which would allow the City to remove the guard 4ouse at any time. The County believes that a discontinuance of the security services should only be implemented through the legal mechanism established by the District as provided in the County Code. If a third party is allowed to shut down the special taxing district, then the County will not proceed with the service. The second restriction concerns the prohibition of the installation and operation of security gates within the public right of way. The County has stated that this restriction would seriously impede the safe and effective operation of the security service. The attendant security guard must be allowed to stop vehicular traffic and record the license tag number of the vehicle. Additionally, the security gates were a condition of the petition by the homeowners and the County believes that it should not grant something that is less restrictive than the original request. As a counter argument, the Miami Police Department believes that stopping vehicles is a police activity that should only be reserved for sworn police officers. i wg ,iSM 'r
