HomeMy WebLinkAboutR-89-0817RESOLUTION NO.,, A RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO ACQUIRE BY NEGOTIATED PURCHASE IN LIEU OF CONDEMNATION THE FEE SIMPLE TITLE TO A PARCEL OF REAL PROPERTY LOCATED ON NORTHWEST 34 TERRACE BETWEEN NORTHWEST FIRST & SECOND AVENUES, MORE PARTICULARLY DESCRIBED AS, LOT 18, BLOCK 5, WYNDWOOD PARK AS RECORDED IN PLAT BOOK 5 AT PAGE 23 OF THE PUBLIC RECORDS OF DADE COUNTY, A/K/A 153 NORTHWEST 34 TERRACE, FOR THE PURPOSE OF EXPANDING THE ROBERTO CLEMENTE PARK; AND AUTHORIZING THE CITY COMMISSIUN TO APPROVE A PROPOSED CONTRACT FOR TEN (10%) PER CENT ABOVE THE APPRAISED VALUE; FUNDS THEREFORE, BEING ALLOCATED FROM THE CAPITAL IMPROVEMENT PROGRAM, CLEMENTE PARK RENOVATION PROJECT NO. 331056. WHEREAS, the Commission of the City of Miami is striving on a continuous basis to provide adequate open spaces in the form of public parks for the use and enjoyment of the citizens of the City of Miami; and WHEREAS, Resolution No. 88-654 authorized the acquisition, by negotiated purchase or condemnation, of twelve (12) lots for the expansion of the Roberto Clemente Park, at the appraised value or for no more than five (5%) per cent above the appraised value; and WHEREAS, eight (8) of the twelve (12) lots have been acquired in accordance with Resolution 88-654; and WHEREAS, the owner of Lot 18, Block 5, Wyndwood Park rejected the city's second offer of $63,000 which was five (5%) per cent above the appraised value; and WHEREAS, Resolution 88-654 required Commission approval for any contracts above five (5%) per cent of the appraised value; and WHEREAS, the owner will accept an offer of $66,000, which is ten (10%) per cent above the appraised value; and WHEREAS, a negotiated purchase in lieu of condemnation would be in the city's best interest; CITY COMMISSION . The City Manager is, hereby. authorized to a %quire the fee simple title by negotiated purchase in lieu of condemnation a parcel of real property, located on Northwest 34 Terrace between Northwest First Second Avenues, more particularly described as Lot 18, Block 5, Wyndwood Park as Recorded in Plat Book 5 at Page 23 of the Public Records of Dade County, a/k/a 153 Northwest 34 Terrace, at a cost of $66,000 which is ten (10%) per cent above the appraised value; funds therefore being hereby allocated from the Capital Improvement Program, Clemente Park Renovation Project No. 331056. 1 Section 2.
