RESOLUTION NO.
A RESOLUTION DENYING THE APPEAL OF MR. MARTIN
SUSKIND IN CONNECTION WITH A PERMIT FOR A
SIDEWALK CAPS IN THE RIGHT OF WAY ADJACENT TO
3176 COMMODORE PLAZA IN COCONUT GROVE (ALSO
KNOWN AS "LA BREAD STATION") AND THUS
AFFIRMING THE DECISION OF THE DIRECTOR OF THE
DEPARTMENT OF PUBLIC WORKS TO DENY PERMIT
RENEWAL OF THE SIDEWALK CAPS IN QUESTION.

WHEREAS, the Director of the Department of Public works

f' refused to renew the sidewalk cafe permit for "La Bread Station"
sidewalk cafe located at 3176 Commodore Plaza, Coconut Grove,
fi Florida, due to repeated violations by Mr. Martin Suskind, the
permit holder; and
_ti WHEREAS, the permit holder filed an appeal with the City
Commission to review the decision of the Public Works Department
to deny the renewal of said sidewalk cafe permit; and
WHEREAS, the City Commission, after hearing arguments from
applicant/appellant and City staff, has determined that it is in
the best interest of the City and its residents to uphold the
decision of the Director of the Public Works Department and thus
not renew the sidewalk cafe permit for 3176 Commodore Plaza;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The appeal from the Public Works Department
Director's decision to deny renewal of the sidewalk cafe permit
for 3176 Commodore Plaza ("La Bread Station") is hereby denied —
and said decision is hereby affirmed.
Section 2. This Resolution shall become effective
immediately upon its adoption.

Deer Sirs:
Appal is hereby filed from city action revoking Le Bread Station's right to do business on the
sidewalks of Coconut drove on its Commodore Place.
City action was noticed pursuant to section (b) of the code. Notice thereof was received on July
22. This appeal is timely made.
