RESOLUTION NO.
A RESOLUTION ESTABLISHING A CITY COMMISSION
POLICY GOVERNING THE DONATION OF WEAPONS
PREVIOUSLY ISSUED FOR INDIVIDUAL USE BY SWORN
PERSONNEL OF THE MIAMI POLICE DEPARTMENT IN
ACCORDANCE WITH THE HEREIN ENUMERATED
STANDARDS AND CRITERIA TO BE FOLLOWED IN
REGARD TO SUCH DONATION.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section I. A policy concerning the donation by the City
of weapons previously issued for individual use by sworn
personnel of the Miami Police Department is hereby established,
which policy supercedes any administrative policy in conflict
with the herein policy.
Section 2. The purpose of the herein policy is to
recognize meritorious service to the citizenry of the City of
Miami by police officers of the City who have dedicated a
substantial portion of their life to helping maintain the good
order of society within the City.
Section 3. In order to improve the morale of sworn
police personnel and thereby contribute to community civic
progress, the City Manager shall implement the following policy:
"Henceforth, subject to applicable law and with the
concurrence of the Chief Procurement Officer, weapons
which have been issued to sworn personnel of the Police
Department for their individual use are to be made
available as a donation at no cost to such personnel on
the date of their retirement under honorable
conditions; provided, that such personnel shall have
qualified for service, early service, rule of 70,
ordinary disability or service incurred disability
retirement."

ENCLOSURES:
The Police Department recently contacted this office
inquiring as to the status of the proposed resolution pertaining
to donation of police weapons to police officers upon their
retirement.
Copies of the proposed resolutions previously forwarded to
your office are attached hereto. Please note that Section 3 of
the later resolution (6/20/89) differs from the one initially
prepared in that the donation applies to personnel who "shall
have qualified for service, early service, Rule of 70, ordinary
disability or service incurred disability retirement" as opposed
to the previous version which required the personnel to serve
"for a period of ten consecutive years prior to retirement."
The Police Department has suggested that additional language
be included to require that the weapon must be in service for a —
minimum of five years before it can be donated pursuant to this,
resolution. This additional language addresses the existing
concern of the Police Department in regard to its disposition of
Smith & Wesson weapons that were replaced by the recent issue of
Glock weapons. Our office has not incorporated the suggested
language of the Police Department.
A copy of this memo is being forwarded to the agenda clerk
so that it may be placed as an item on the next available agenda.
Please advise if you desire to make further changes or if: you
wish us to add the requirements that any donated weapon must have:
been in service for a minimum of five years.
