WITH ATTACHMENT A RESOLUTION,/APPROVING AN AMENDMENT TO THE COST SHARING CONTRACT THAT EXISTS BETWEEN THE CITY OF MIAMI AND THE SOUTH FLORIDA WATER MANAGEMENT DISTRICT FOR RETROFITTING STORMWATER BASINS BY INCREASING THE SCOPE OF WORK AND EXTENDING THE TERM OF THE CONTRACT; AND AUTHORIZING THE CITY MANAGER TO EXECUTE SAID AMENDMENT, IN SUBSTANTIALLY THE FORM ATTACHED) ON BEHALF OF THE CITY WITH FUNDS THEREFOR MADE AVAILABLE FOR THE CITY'S SHARE OF THE CONTRACT INCREASE FROM STORM SEWER GENERAL OBLIGATION BOND FUNDS AND/OR STORMWATER UTILITY TRUST FUNDS. WHEREAS, Resolution No. 88-507, adopted by the City Commission on June 9, 1988, approved the negotiated cost sharing contract between the City of Miami and the South Florida Water Management District for retrofitting five stormwater basins within the City of Miami; and WHEREAS, the aforementioned resolution also authorized the City Manager to execute the aforesaid contract, and said contract was subsequently executed and entered Into on July 26, 1988; and WHEREAS, It Is the mutual desire of both parties to amend the contract to Increase the scope of work by adding three stormwater basins to the proposed retrofitting work and by extending the term of the contract by approximately three years;and WHEREAS, an amendment to accomplish the aforesaid revisions has been prepared by the South Florida Water Management District to the satisfaction of the City of Miami Administration; and WHEREAS, It is now appropriate for the City Commission to consider the authorization of the City Manager to execute said amendment; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: ATTACHMENTS Ca��i�"AIPJED CITY COMMISSION MEETING OF SEP 14 11989 )N No. S9 1 i i section 1. the rftito1s and findings set forth 1n the preamble to this Resolution are hereby Incorporated by reference and adopted. Section 2. The City Commission hereby approves the amendment to the existing cost sharing contract between the City of Miami and the South Florida Water Management District for retrofitting three (3) additional stormwater basins within the City of Miami at the locations specified In Exhibit "D" of said 1` amendment. Section 3. The City Manager Is hereby authorized to execute said amendment In substantially the form attached hereto i/on behalf of the City of Miami. Section 4. Funds are to be made available for the City's share of the cost of the additional stormwater basin retrofitting, as specified In Exhibit "E" of said amendment, from Storm Sewer General Obligation Bond Funds and/or Stormwater Utility Trust Funds. PASSED AND ADOPTED this 14th day of September ^� 19a9. 88-0.38-0651-A 1 AMENDMENT NO.1 TO CONTRACT BETWEEN THE SOUTH FLORIDA WATER MANAGEMENT DISTRICT AND CITY OF MIAM1, FLORIDA This AMENDMENT is entered into on __, 1989, to that certain CONTRACT dated July 26, 1988 (CONTRACT) by and between the South Florida 'Hater Management District (DISTRICT) and the City of Miami, Florida (CITY). WITNESSETH: WHEREAS, the CITY and DISTRICT entered into a contract whereby CITY Would be responsible for retrofitting the stormwater basins in the Miami River and Biscayne Bay areas; and WHEREAS, it is the mutual desire of the parties to amend the CONTRACT to increase the scope of work and to extend the termination date; NOW, THEREFORE, in consideration of the benefits to each of the parties; the DISTRICT and the CITY agree to amend their CONTRACT as follows: 1. The CITY shall to the satisfaction of the DISTRICT, fully and timely perform all work items described in Exhibit "D", attached and made a part of this AMENDMENT. 2. As consideration for providing the services required by this AMENDMENT, the DISTRICT shall pay CITY . an amount not to exceed Eight Hundred and Thirteen Thousand Two Hundred and Seventy Six Dollars ($813,276) for construction as set forth in Exhibit "E", attached and made a part of this AMENDMENT. The total amount of the CONTRACT as amended shall not exceed "wo Million Three Thousand Two Hundred and Seventy -Six Dollars ($2,003,276.00). The locations of these projects covered by this amendment are depicted on the attached maps (Exhibits "F-1", "F-2" and "F-3"). These projects are: 1. Lawrence Pump Station Bar Screen Replacement (Basin 44) -Y This project is the replacement of a hand -raked bar screen (filter mechanism to remove debris) with a mechanical bar screen. The pump station is not manned, so during moderate to heavy rainfall events the existing bar screen becomes plugged by debris causing water to ? overflow the weir. Street debris then discharges Into the Miami River. A mechanical bar screen will eliminate the need for manual cleaning, so debris will not enter the discharge. 2. Lawrence Waterway Retrofitting (Basin 54) This project consists of retrofitting stormwater outfalis discharging to the Lawrence Canal and will be constructed in conjunction with the locally -funded Lawrence Highway Improvement Project. 3. Wagner Creek/Heavy Equipment Facility Retrofitting This project consists of retrofitting stormwater outfalis that discharge Into Wagner Creek between N.W. 20 Street and N.W. 14 Avenue, including the outfall from the City of Miami General Services Administration (GSA) fac;lity. High pollutant loads discharging from the GSA outfall were discovered during 1988, so this site does not appear on the priority list established In 1987. The project will be coordinated with the City's Wagner Creek Renovation -Phase IIi Project. The CITY will be responsible for all design, permitting, construction and quality control. Design and construction will be sufficient to meet all applicable regulatory requirements and codes of practice. Where possible, retrofitting will be performed In conjunction with other road construction projects so as to minimize costs. Construction drawings and work schedules will be provided to the DISTRICT for each basin prior to construction. As built drawings will be provided to the DISTRICT upon completion of each basin. The CITY will cooperate and coordinate with Dade County Department of Environmental Resources Management on the Installation of and access to the outfalis, for the purpose of monitoring. The CITY will provide a record of maintenance of all projects covered under this amendment for a period of not less than five (5) years from the date of construction. 1 K ' p } ry 4. p _ .,fie za•'�.. Od I o City Manager RECOMMENDATION: CA111111111-7 DATE S E P - 1 1989 FILE SUBJECT: Amendment to Cost Sharing Contract with South Florida Water Management District REFERENCES: ENCLOSURES: Proposed Contract Amendment It is respectfully recommended that the City Commission adopt the attached resolution approving an amendment to the cost sharing contract that exists between the City of Miami and the South Florida Water Management District (S.F.W.M.D.) for retrofitting stormwater basins. BACKGROUND: The Department of Public Works, in a continuing effort to serve all residents of the City of Miami, is recommending the adoption of the attached resolution amending the City's existing contract with the S.F.W.M.D. On June 9, 1988 the City Commission adopted Resolution No. 88-507 which approved a negotiated cost sharing contract with the South Florida Water Management District for retrofitting five stormwater basins within the City of Miami. The contract was subsequently executed by the City Manager and entered into by the City on July 26, 1988. At this time both the City and the S.F.W.M.D. want to amend the contract to increase the scope of work by adding three stormwater basins to the proposed retrofitting work and by extending the term of the contract by approximately three years to accomplish the additional work. An additional $813,278 in Surface Water Improvement and Management (S.W.I.M.) Funds would be granted to the City as part of the amended agreement bringing the total S.W.I.M. grant amount to $2,003,278.
