A RESOLUTION MAKING PROVISIONS FOR HOLDING A NONPARTISAN PRIMARY ELECTION ON NOVEMBER 7, 1989, FOR THE NOMINATION OF CANDIDATES FOR THE OFFICES OF MAYOR AND TWO COMMISSIONERS AND FOR HOLDING A LATER GENERAL MUNICIPAL ELECTION ON NOVEMBER 14, 1989, UNLESS ALL OF SAID OFFICES HAVE BEEN FILLED IN THE NONPARTISAN PRIMARY ELECTION; PROVIDING FOR THE REGISTRATION OF PERSONS QUALIFIED TO VOTE IN SAID NONPARTISAN GENERAL ELECTION; DESCRIBING PERSONS QUALIFIED TO VOTE IN SAID NONPARTISAN PRIMARY ELECTION AND SAID GENERAL MUNICIPAL ELECTION; DESCRIBING THE REGISTRATION BOOKS AND RECORDS MAINTAINED UNDER THE PROVISIONS OF THE GENERAL LAWS OF FLORIDA AND CHAPTER 16 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, WHICH THE CITY HAS ADOPTED AND DESIRES TO USE FOR HOLDING SUCH NONPARTISAN PRIMARY ELECTION AND SUCH GENERAL MUNICIPAL ELECTION; DESIGNATING AND APPOINTING THE CITY CLERK AS THE OFFICIAL REPRESENTATIVE OF THE CITY COMMISSION WITH RESPECT TO THE USE OF SUCH REGISTRATION BOOKS AND RECORDS; AND DIRECTING THE CITY CLERK TO GIVE NOTICE BY PUBLICATION OF THE ADOPTION OF THIS RESOLUTION AND THE PROVISIONS HEREOF. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. In accordance with the provisions of Section 7 of the City Charter (Chapter 10847, Laws of Florida, 1925, as amended), a nonpartisan primary election is hereby directed to be held in the City of Miami, Florida, at the polling places designated on the list attached hereto and made a part hereof and referred to as Exhibit too. 1 on Tuesday, November 7, 1989 from 7:00 A.M. until 7:00 P.M. for the purpose of nominating candidates for the offices of the Mayor and two Commissioners of the City of Miami to be each voted upon at the general municipal election which is to be held, as provided in said Section 7 of the City Charter unless in the primary election a candidate from a group receives a majority vote in his or her group in which case he or she shall be elected to the office of the group for which he or she is a candidate. 3 CITY COMMISSION MEETING OF SEP 14( 1989 RESOLUTION No. Q; REMARKS. y f I i 1 I Section 2. A general municipal election is hereby directed to be held in the City of Miami, Florida, at the polling places designated in said Exhibit No. 1 from 7:00 A.M. until 7:00 P.M. on Tuesday, November 14, 1989, for the purpose of electing a Mayor and two Commissioners of the City of Miami unless a candidate from each group shall have received a majority in his or her group at the nonpartisan primary election held on November 7, 1989. Section 3. The candidate who shall receive the highest number of votes in Group I shall serve as Mayor for a term of four (4) years from 12:00 o'clock noon of the date after the canvass of the vote and the declaration of the result of said ' general election; the candidates who shall receive the highest 1 number of votes in Groups IV and V shall serve as Commissioners of the City of Miami for a period of four ( 4 ) years from 12 : 00 o'clock noon of the day after the canvass of the vote and the _! declaration of the result of said general election. Section 4. The Election Clerks and Inspectors to serve at said polling places on said date shall be designated by the Supervisor of Elections of Metropolitan Dade County, Florida for such purposes. Section 5. For the purpose of enabling persons to register who are qualified to vote in said elections and who have not registered under the provisions of the general laws of Florida and Chapter 16 of the Code of the City of Miami, Florida, as amended, or who have transferred their legal residence from one voting precinct to another voting precinct in the City, they may register at such permanent branch offices as may be approved by the Supervisor of Elections of Metropolitan Dade County and at said Supervisor's office which will be open during the following dates and time: ELECTIONS DEPARTMENT 111 Northwest 1st Street, Miami, Florida Monday to Friday, inclusive: 8:00 A.M. - 5:00 P.M. In addition to the above, said qualified persons may register at branch offices and may also use any mobile registration van for the purpose of registration in order to vote in the herein described elections during such times and on such dates as may be designated by the Supervisor of Elections of — Metropolitan Dade County. Section 6. Said elections shall be held at the voting places in the precincts designated on said Exhibit No. 1, or as may be designated by the Supervisor of Elections of Metropolitan Dade County, in conformity with the provisions of the general laws of the State. A description of the registration books and records which pertain to election precincts wholly or partly within the City and which the City is adopting and desires to use for holding such elections is as follows: All registration cards, books, records and certificates pertaining to electors of the City and established and maintained as official by the Supervisor of Elections of Metropolitan Dade County, in conformity with the provisions of the general laws of the State, are hereby adopted and declared to be, and shall hereafter be recognized and accepted as, official registration cards, books, records and certificates of the City. Section 7. The ballot to be used in said elections shall be so prepared that the names of the qualified candidates will appear on said ballot in alphabetical order according to surname in each group; provided, however, that the ballot and its preparation shall comply with the laws of the State of Florida with respect to absentee ballots, and to the use of mechanical voting machines or the Computer Election System (CES). -3- 199".-757; ffiffitt 1 Section S. (a) In compliance with Florida Statutesi the City Clerk is hereby authorized and directed to publish notice of the adoption of the herein resolution and of the provisions hereof, at least twice, once in the fifth week and once in the third week prior to the week in which the aforesaid election is to be held, in the following newspaper(s) which are published within the City of Miami, Florida: "The Miami Herald", as well as the newspapers presently stipulated to by City Resolution which notice shall be substantially as set forth in the following form: NOTICE OF NONPARTISAN PRIMARY ELECTION FOR NOMINATING CANDIDATES FOR THE OFFICES OF MAYOR AND TWO COMMISSIONERS TO BE HELD ON TUESDAY, NOVEMBER 7, 1989, PURSUANT TO RESOLUTION NO. 89- 757 A nonpartisan primary election will be held on Tuesday, November 7, 1989 from 7:00 A.M. until 7:00 P.M., in the City of Miami, Florida, at the polling places set forth herein, at which election the qualified electors participating therein will vote for the nomination of candidates for the office of Mayor and two Commissioners of the City of Miami, to be each voted on at the general municipal election which is to be held on Tuesday, November 14, 1989, unless in the primary election a candidate from a group receives a majority vote in his or her group, in which case he or she shall be elected to the office of the group for which he or she is a candidate. (b) The Election Clerks and Inspectors to serve at said polling places on said dates shall be those designated by the Supervisor of Elections of Metropolitan Dade County for such purpose. The registration books and records for the registration of persons qualified to vote in said elections shall be those maintained by the Supervisor of Elections of Metropolitan Dade County. (e) A general municipal election will be held on Tuesday, November 14, 1989 from 7:00 A.M. until 7:00 P.M., in the City of Miami, Florida, at the polling places set forth herein, at which election the qualified electors of the City of Miami participating therein will vote for the election of a Mayor and two Commissioners of the City of Miami, Florida, unless a candidate from group shall have received a majority vote in his or her group at the nonpartisan primary election held November 7, 1989, and the Election Clerks and Inspectors shall be those designated by the Supervisor of Elections of Metropolitan Dade County for such purpose. The registration books and records for the registration of persons qualified to vote in said general municipal election shall be those maintained by the Supervisor of Elections of Metropolitan Dade County. Section 9. MATTY HIRAI, the City Clerk of the City of Miami, Florida, or her duly appointed successor, is hereby designated and appointed as the official representative of the Commission of the City of Miami, Florida, in all transactions with the Supervisor of Elections of Dade County in relation to matters pertaining to the use of the registration books for the holding the herein nonpartisan primary election and the herein general election.
