Odio Agenda Item - City Commission City Manager ENCLOSURES: Meeting of September 14, 1989 RECOMMENDATION: It is respectfully recommended that the City Commission appoint seven (7) members to the City of Miami Latin Quarter Review Board, per the attached resolution. The terms of two of the new appointments will expire February 27, 1990 and five will expire February 27, 1991. BACKGROUND INFORMATION The Planning Department services the Latin Quarter Review Board. The Latin Quarter Review Board assists the Planning Department by reviewing all proposed projects in the Latin Quarter district in excess of $10,000. Section 62-78 of the City Code provides for the appointment or reappointment of Board Members. According to this section, no member of this board can be reappointed to more than two (2) consecutive terms. The following Board members cannot be reappointed because they have served the maximum two consecutive term limit: Willy A. Bermello Robert Chisholm Carlos Mencio Luis Sabines ' Rodolfo Sanchez Armando Cazo, Pelayo Gonzalo Fraga and Teresita (Tessi) J. Garcia were appointed to the Board on April 14, 1988 by Resolution 88-334. On April 14, 1988 certain applicants were appointed or re -appointed to the Latin Quarter Review Board by Resolution 88-334; however,.the appointments of Raul Hernandez by Commissioner Kennedy, and Rodolfo Sanchez by Commissioner Dawkins were ^inappropriate at. that time because Hernandez's name and qualifications were not filed in a timely manner, available for public review, as required by the Latin Quarter legislation, and Rodolfo Sanchez was not able to be reappointed because he had already served the two consecutive term limit. At the June 9, 1988 City Commission meeting, two applicants were appointed: Raul Hernandez by Commissioner Kennedy and Hector Gasca by Commissioner Dawkins; however, the nominees either had not filed in a timely matter or did not have the required qualifications. Page 2 of 3 '"� 71' At the April 13, 1989 City Commission meeting, there were seven vacancies, properly advertised, for the Latin Quarter Review Board. Mayor Suarez appointed Mr. Silvio Diaz and Commissioner Dawkins appointed Mr. Hector Gasca. These two appointments were not valid because Mr. Gasca has not filed his application in a timely manner; Mr. Diaz has never submitted an application. No appointments were made to the other five vacancies. At the June 7, 1989 City Commission meeting, the Commission adopted emergency Ordinance 10597 amending membership requirements and appointment procedures for the Latin Quarter Review Board by increasing the board membership to 10 and eliminating the alternate membership, newspaper advertising, and the mandatory appointment of architects, engineers, and landscape architects. The regular terms of office of the following two Latin Quarter Review Board Members expired on February 27, 1988; however, they are still serving. The work of the Board consists of reviewing technical drawings (building plans, elevation, construction sections, architectural and engineering details, colors, materials etc.) to ensure that projects meet the criteria specified in the Latin Quarter Design Guidelines and standards which was approved by the City Commission. Therefore the work of the Board requires the expertise of architects, engineers and members of the design profession. The other Board members without the expertise to read and review architectural plans (drawings), and knowledge of codes and regulations, rely on the design professionals for interpretation of these plans. If the participation of these design professionals is not mandatory, there will be occassions when this expertise might not be available at a Board meeting and the Board will be unable to perform this fuction as intended. Additionally, we find that at times the plans submitted do not have the benefit of qualified architects, engineers or landscape architects. The resent economic conditions of this area seem to make It difficult for some residents and businessmen to afford these architect's professional services.
