general character of the residential district.

Grant of Special Exception

Per direction of the City Commission on July 13, 1989 and per Section 3201, -
Zoning Ordinance 9500, and Section 62-62(b) of the City Code, the Planning
Department requests a review by the City Commission of the Zoning Board's
grant of special exception on July 10, 1989, to use two transitional lots for
off-street parking by Victor's Cafe, formerly the site of the Studio
Restaurant, at 2340 S.W. 32nd Avenue.
BACKGRQUND:
By memorandum of March 17, 1989 (attached) the Zoning Administrator issued an
opinion allowing the continuation of a non -conforming use and structure at
this location, finding that demolition of the roof; 109 lineal feet of wall on
the north, west and south sides and relocation of the east wall did not
further the non -conformity of the structure or use.
Due to the approval of continued non -conformity, the restaurant does not have
to meet the off-street parking requirements in the Zoning Ordinance (60 spaces
otherwise required) but only has to supply the number of spaces which were
formerly on -site (33 spaces on -site). Thereafter, on July 10, 1989, the
- Zoning Board granted a special exception to allow use of two transitional lots
to the west of the restaurants for excess parking for the restaurant (31
additional spaces).
The Planning Departments' main contention is .that all the parking to be
provided, including the parking on the transitional lots, should be defined as
rg4u parking (64 spaces, including on -site and transitional). Otherwise,
the restaurantawill have on open invitation to expand' the structure e.gg., by
adding a banquet hail, while providing no additional parking, which will have
a consequent negative impact on the neighborhood.

Attached for your information is a copy of a memorandum of
opinion from Joseph A. Genuardi, Zoning Administrator, in
reference to proposed alterations and partial demolition of the
old Studio Restaurant building and site for a new Victor's
Restaurant.
Mr. Genuardi discussed this with Miriam Maer, Assistant City
Attorney, last week and she indicated that she halt no problems
with the opinion.

Following is my opinion on the continuation of nonconformities of a structure
and on -site parking at 2340 S.W. 32 Avenue.
1. The existing building which has been used as a restaurant
and which after alteration by new owners will be used as a
restaurant is a permitted use under the CR-V7 zoning
classification. The existing floor area together _rrith
Proposed additions will be below -the maximum floor area
permitted.
2. Only a portion of the existing structure is nonconforming
because it does not meet the required setbacks. This
includes the wall along S.W. 32 Avenue, the wall along,S.W._
23 Terrace and rti of the wall along the west side of
a po on
the property.

It has been proposed to compl-itely remodel the interior of
the building and replace the roof because of its :condition
due to age and to change its appearance consistent with.the
—
new ownership.' This work does not affect the nonconformity
of the structure.:

During the removal of the roof and interior partition under
a demolition permit, approximately 42 L.F. of wall at the
west side of the building had to be removed because 'of the
poor condition. This portion is conforming and will be
replaced at the same location and therefore does not affect
the nonconformity of the structure.

L.F. at the H.W. corner and 32 L.F. at, the i.W. corner of

taking. The location of the new wall would in fact reduce
the nonconformity of these walls.

permits the enlargement, extension or alteration of a
nonconforming structure if the degree of its nonconformity
remains the same or is decreased.

In all cases described above the new wall will be in
conformity or will decrease the degree of nonconformity.
The only nonconforming portion being replaced is due. to
public taking. Therefore, it is my opinion, that -the
building may be reconstructed as proposed.
The existing on -site parking does not meet the present City
of Miami Zoning Ordinance requirements. Therefore, it is a
nonconforming characteristic of use. Section 2107.
Nonconforming characteristic of use. does not contain a
discontinuance section. Further, Section 2107.1 permits
changes which result in the same or lesser degree of noncon-
formity. 'It is proposed that the existing parking area be
codified to provide addition parking spaces for the
additions and also resulting in more spaces for the existing
use.
The existing parking area alpo does not meet the
requirements of the City of Miami Guides and Standards;
however, Section 2017.4 permits modifications which lessen
the degree of nonconformity as much as is reasonably
feasible in the circumstances of the case.
The proposed modification will privide all spaces meeting
minl,mum size and required Aisles and Will include more
landscaping than is existing. It is therefore my opinion
that the nonconforming parking area as modified is
permitted,

Within the City generally, or within certain zoning districts, certain structures, uses,
and/or occupancies specified in this ordinance are of a nature requiring special and
intensive review to determine whether or not they should be permitted in specific
locations, and if so, the special Umitatiom% conditions, and safeguards which should
be applied as reasonably necessary to promote the general purposes of this Zoning
Ordinance, and, in particular, to protect adfoining properties and the neighborhood
from avoidable potentially adverse effects. it is further intended that the expertise

A RESOLUTION AFFIRMING THE DECISION OF THE
ZONING BOARD AND GRANTING A SPECIAL EXCEPTION
FROM ORDINANCE NO. 9500, AS AMENDED, THE
ZONING ORDINANCE OF THE CITY OF MIAMI,
FLORIDA, ARTICLE 20, SECTION 2018, SUBSECTION
2018.2.1, FOR THE CONSTRUCTION OF A SURFACE
PARKING LOT FOR THE PARKING OF PRIVATE
PASSENGER VEHICLES ONLY, AS EXCESS (NOT
REQUIRED) PARKING, AS PER PLANS ON FILE, FOR
THE PROPOSED RESTAURANT LOCATED AT
2340 SOUTHWEST 32 AVENUE, MIAMI, FLORIDA, FOR
THE PROPERTY LOCATED AT 3224 SOUTHWEST
23 STREET, MIAMI, FLORIDA AND APPROXIMATELY
3221 SOUTHWEST 23 TERRACE, MIAMI, FLORIDA,
(MORE PARTICULARLY DESCRIBED HEREIN); ZONED
RG-1/3 GENERAL RESIDENTIAL (ONE AND TWO
FAMILY), AND SUBJECT TO REVIEW BY THE CITY
COMMISSION OF ANY FUTURE MODIFICATION OF
PLANS THAT WOULD INCREASE THE SIZE OF THE
BUILDING LOCATED AT 2340 SOUTHWEST 32 AVENUE,
MIAMI, FLORIDA, TO MORE THAN 11,000 SQUARE
FEET, OR OF ANY FUTURE CHANGE THAT WOULD
IMPACT THE NUMBER OF PARKING SPACES OR THE
PARKING LOTS LOCATED AT 3224 SOUTHWEST
23 STREET AND APPROXIMATELY 3221 SOUTHWEST
23 TERRACE, MIAMI, FLORIDA. THIS SPECIAL
EXCEPTION HAS A TIME LIMITATION OF TWELVE
MONTHS IN WHICH A BUILDING PERMIT MUST BE
OBTAINED.
WHEREAS, the Miami Zoning Board at its meeting of
July 10, 1989, Item 3, following an advertised hearing, adopted
Resolution ZB 77-89 by a seven to two vote (7 - 2), granting the
Special Exception from Ordinance No. 9500, as amended, the Zoning
Ordinance of the City of Miami, Florida, (hereinafter the "Zoning
Ordinance") Article 20, Section 2018, Subsection 2018.2.1, to
allow the construction of a surface parkinq lot for the parking
of private passenger vehicles only as excess (not required)
parking on the site, as per plans on file, for the proposed
-restaurant at 2340 Southwest 32 Avenue, Miami, Florida, for the
property located at 3224 Southwest 23 Street, Miami, Florida, and
approximately 3221 Southwest 23 Terrace, Miami, Florida, also
described as Lots 4 and 38, Block 9, MIAMI SUBURBAN ACRES AMD.
(4-73) of the Public Records of Dade County, Florida;
zoned RG 1/3 General Residential (One and Two Family); and
WHEREAS, the Planning Department, pursuant to Section 3201
of the Zoning Ordinance, has taken an appeal to the City
Commission from the granting of the Special Exception; and
WHEREAS, the City Commission, after careful consideration of
this matter, finds that the application for a Special Exception,
with certain conditions attached, meets the applicable
requirements of the Zoning Ordinance;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The decision of the Zoning Board in granting the
Special Exception from the Zoning Ordinance, Article 20,
Section 2018, Subsection 2018.2.1, to allow the construction of a
surface parking lot for the parking of private passenger vehicles
only on the above site, as per plans on file, as excess (not
required) parking, for the proposed restaurant located at
2340 Southwest 32 Avenue, Miami, Florida, for the property
located at 3224 Southwest 23 Street, Miami, Florida, and
approximately 3221 Southwest 23 Terrace, Miami, Florida, also
described as Lots 4 and 38, Block 9, MIAMI SUBURBAN ACRES AMD.
(4-73), of the Public Records of Dade County, Florida;
zoned RG-1/3 General Residential (One and Two Family), is hereby
affirmed and the Special Exception is hereby granted, subject to
review by the City Commission of any future modification of plans
that would increase the size of the proposed building to be
located at 2340 Southwest 32 Avenue, to more than 11,000 square
feet, or of any future change that would impact the number of
-parking spaces or the parking 'lots located at 3224 Southwest
23 Street and approximately 3221 Southwest 23 Terrace, Miami,
Florida. This special exception has a time limitation of twelve
months in which a building permit must be obtained.
