HomeMy WebLinkAboutO-10642J-89-875 9/28/89 ORDINANCE NO. t0 42 AN EMERGENCY ORDINANCE ESTABLISHING APPROPRIATIONS FOR CITY OF MIAMI CAPITAL IMPROVEMENTS; CONTINUING AND REVISING PREVIOUSLY APPROVED SCHEDULED CAPITAL IMPROVEMENT PROJECTS, ESTABLISHING NEW CAPITAL IMPROVEMENT PROJECTS TO BEGIN DURING FISCAL YEAR 1989- 90; CONDITIONALLY REPEALING PROVISIONS OF ORDINANCE NO. 10521, AS AMENDED, THE 1988-1989 CAPITAL IMPROVEMENTS APPROPRIATIONS ORDINANCE; AND PROVIDING CONDITIONS, AUTHORIZATIONS AND DIRECTIONS TO THE CITY MANAGER AND CITY CLERK. WHEREAS, the administration has designated certain projects proposed to be undertaken in fiscal year 1989-1990 with General Obligation Bond Funds, Revenue Bond Funds, Enterprise Funds, General Fund Revenues, and with some federal and state funds and private contributions, pursuant to Sections 30 and 34 of the City Charter, and has included them in this proposed appropriations ordinance; and WHEREAS, the City of Miami Capital Improvement Program has been reviewed and, in some cases, ongoing capital projects have been revised and respective appropriations increased or decreased in their totals; and WHEREAS, the appropriations ordinance includes those projects selected to be continued during fiscal year 1989-1990 and reappropriates the previously authorized project funding totals; and WHEREAS, this ordinance includes new capital projects scheduled to begin during fiscal year 1989-1990 and appropriates the project funding totals; and WHEREAS, provisions have been duly made by the City Commission for a Public Hearing on the proposed City of Miami Capital Improvement Program 1989- 1995 before the Commission and said Hearing has been held; and WHEREAS, the City Commission has reviewed the City of Miami Capital Improvement Program 1989-1995 and Capital Budget 1989-1990 and has approved appropriations in seven (I-VII) program areas based upon use or functional categories within said areas in accordance with the following format; AMENDED BY AMENDED BY AMENDED BY ORDINANCE ORDINANCE ORDINANCE # �rob p� # Lo # L02SC #1s�'. a_ r o 6 R 9 # yJ fir; D 7 D Z # r D� # #_LQ2a3_ 1073 #!09%(0 # 1D7Z REPEALED .I� BY 10 7 !R "), 10642 ki PROGRAM AREA/FUNCTIONAL CATEGORY I. This ordinance is an ordinance of precedent and all other ordinances in conflict with it are hereby held null and void insofar as they pertain to these appropriations. To the extent funds have been appropriated in Ordinance No. 10521, adopted November 17, 1988, as amended, and are not reflected herein, the provisions of said Ordinance No. 10521 are hereby expressly repealed and all remaining funds, if any, are reflected herein. The appropriations herein are the anticipated expenditure requirements for the City, but are not mandatory should unexpected difficulties arise in the planning, design, construction, and administration of projects, or if altered economic conditions indicate that a curtailment in certain expenditures is necessary or desirable for the general welfare of the City. The City Manager or the Capital Improvements Manager is specifically authorized to transfer funds between line -item budget accounts within the same Project and to withhold any of these appropriated funds from encumbrance or expenditure should such action appear advantageous to the City. Except as herein provided, transfer of funds between projects shall be authorized only by ordinance amendatory hereto. The City Manager shall be specifically authorized by resolution to transfer funds between projects where the resolution provides that the funds which have been transferred are to be restored within the current fiscal year to the Project from which the funds have been transferred. Section 3a. The City Manager is directed to file with the City Clerk and the County Clerk a statement of the proposed expenditures and estimated revenues for the fiscal year 1989-90, which shall be entitled "Capital Budget I.0642 - 26 - of the City of Miami, fiscal year October 1, 1989, through September 30, 1990." b. The City Clerk is hereby instructed to make the printed "Capital Improvement Program 1989-95" a part of the permanent records of her Office. Section 4. The City Manager is hereby authorized to invite or advertise bids for the purchase of any material, equipment, or physical improvement embraced in the aforementioned appropriations or which may be provided for in accordance with the provisions of Section 2 hereof, for which formal bidding is required; such bids to be returnable to the City Commission or City Manager in accordance with Charter or Code provisions. Section 5. If any section, part of section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of the ordinance shall not be affected. Section 6. All ordinances or parts of ordinances, insofar as they are inconsistent or in conflict with the provisions of this ordinance, are hereby repealed. Section 7. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the reservation of peace, health, safety, and property of the City of Miami and upon the further grounds of the necessity to make the required and necessary purchases and payments, and to generally carry out the functions and duties of municipal affairs.
