HomeMy WebLinkAboutO-10641J-89-871 9/28/89 ORDINANCE NO._ 1064 1 AN EMERGENCY ORDINANCE AMENDING SECTIONS 35-91, 35-92, 35-93, AND 53-161(3) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY ESTABLISHING RATES AT CERTAIN ON -STREET PARKING METERS AND CERTAIN OFF-STREET LOTS; ESTABLISHING RATES AT MUNICIPAL, PARKING GARAGES; FURTHER PROVIDING AN EFFECTIVE DATE OF NOVEMBER 1, 1989 FOR THE HEREIN RATE CHANGES; RATIFYING AND CONFIRMING ALL ACTS OF THE OFF-STREET PARKING BOARD AND ITS DIRECTOR AS TO RATES HERETOFORE CHARGED; FURTHER AUTHORIZING THE OFF-STREET PARKING BOARD TO DEVELOP EXPERIMENTAL RATE STRUCTURES AND TO INITIATE RATES FOR NEW FACILITIES DURING THE FISCAL YEAR; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Off -Street Parking Board of the City of Miami, on July 19, 1989, instructed the Executive Director to submit an ordinance to the City Commission that parking rates be changed in certain on -street parking areas, in certain off-street parking lots and that rates be changed at the Municipal Parking Garages; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1.. Sections 35-91, 35-92, 35-93, and 53-161(3) of the Code of the City of Miami., Florida, as amended, are hereby further amended in the following particul.ars:l "Sec. 35-91. On -street parking meters. The rate of charge for parking in metered spaces in on -street parking meter zones, except as otherwise provided herein, is as follows: l/ Words and/or figures stricken through shall be deleted. At no time will the rates be adjusted higher than. the rates set by the City Commission. Section 3. All acts of the Off -Street Parking Board and its Executive Director as to rates heretofore charged are hereby ratified and confirmed. Section 4. The provisions of this Ordinance shall take effect on November 1, 1989. Section 5. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. =:= 1.06 41 Section 6. If any section, part of section, paragraph, clause, phrase, or work of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. This Ordinance shall be operative and the provisions thereof, unless otherwise indicated herein, shall become effective in accordance with City Charter provisions. Section 7. This ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami. Section 8. The requirement of reading this Ordinance on two separate days is hereby dispensed with by an affirmative vote of not less than four -fifths of the members of the Commission. Section 9. These rate changes are expected to generate approximately $29,500 of additional revenue in Fiscal Year 89/90. Garages The only change proposed in garage rates is to increase the monthly rate in Municipal Garage No. 5 from $55.00 to $60.00. This is expected to generate $72,000 in additional revenue. It is also proposed that modifications be made in the current rate ordinance language regarding "experimental rate structures." The proposed changes would permit greater flexibility to market facilities and their rates,. as well as to match rates of competing facilities on a case -by -case, as -needed basis.
