RESOLUTION NO. 89-,-939
A RESOLUTION CONDITIONALLY APPROVING, IN
PRINCIPLE, THE DONATION OF APPROXIMATELY 12.6
ACRES OF CITY -OWNED LAND LOCATED IN THE MIAMI
FASHION/GARMENT DISTRICT TO THE WYNWOOD
COMMUNITY ECONOMIC DEVELOPMENT CORPORATION
FOR DEVELOPMENT OF A FOREIGN TRADE ZONE;
SUBJECT TO PREPARATION OF APPROPRIATE
AGREEMENTS BY THE CITY ATTORNEY AND CITY
ADMINISTRATION ADDRESSING REVERSIONARY
INTERESTS AND OTHER CONCERNS OF THE CITY
COMMISSION; AND SUBJECT TO FINAL CITY
COMMISSION APPROVAL.
BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The City Commission hereby approves, in
principle, the donation of approximately 12.6 acres of oity-owned
real property, located in the Miami Fashion/Garment District, to
the Wynwood Community Eoonomio Development Corporation for the
purposes of developing a foreign trade zone.
Section 2. Said donation is hereby subject to subsequent
City Commission approval of agreements to be prepared by the City
Attorney and City Administration which will address, inter alia,
the issue of reversionary interests and other concerns of City
Commission raised during discussion at its meeting of October 12,
1989.
Section 3. This Resolution shall become effective
immediately upon its adoption.

The Miami Fashion/Garment Districts N.W. 24 Street
on the North, N.W. 22 Street and N.W. 21 Terrace
on the South, N.W. 2 Avenue on the East, and
N.W. 6 Avenue on the West.
Dear Mr. Odio:
The Wynwood Community Economic Development Corp. (WCEDC)
would like to request a public appearance before the
City Commission, in order to request on behalf_ of the
Wynwood Safe Neighborhood Improvement District(SNID) the
donation of approximately 12.6 acres of land located
within the SNID Fashion/Garment District of the City of
Miami.
The donation will serve to match the State of Florida's
SNID projects for those Districts developing or
implementing projects within State Enterprise Zones (as
per F.S. 163.521 enclosed). Since the WCEDC is developing
the Wynwood Foreign Trade Zone a project, found to be
consistent with the Cities plans and objectives
(Resolution No.88-10390 and recommended by a Resolution
from the Cities International Trade Board on May 10, 1989
and the Dade County Commission by resolution No.376-89.
And whereas, the City Commission has found that the
creation of the Wynwood Safe Neighborhood Improvement
District is in the public good see Ordinances 10406 and
10522. We like to request that said lands be donated for
the further development of the District and the Foreign
Trade Zone.

a major impact on this area in terms of jobs, crime,
and development for the City and the District.

CHARTER AND RELATED LAWS
(2) All persons contracting with the city under
this section shall be obligated to pay which-
ever is the greater of the following; (i) all
applicable ad valorem taxes that are lawfully
assessed against the property involved or (ii)
an amount to be paid to the city equal to
what the ad valorem taxes would he if the
property were privately owned and used for a
profit -making purpose. Such taxes shall not
be credited against any revenues accruing to
the city under any contract that may be
awarded under this section.
(3) Any proposal by a potential bidder or con-
tractor that contemplates more than the es-
timated extent of the city's proposed commit.

(4) Any substantial increase in the city's com-
mitment of funds, property, or services, or
any material alteration of any contract awarded
under subsection (c) of this section shall enti-

from the review committee that evaluated

on Sept. 17, 1982, set forth Charter Amendment No. 1 for
approval/rejection at election on Nov. 2, 1982. On Oct. 28,
1982, Ord. No. 9507 amended the language of subsections (a)
and (c) of 153 as proposed by Ord No. 9489. The election was
to approve the language of Charter Amendment No.1, as amended
by Ord No. 9507. Subsequently, in light of Charter Amend-

Sec. 29-B. City -owned property sale or lease —
Generally.
Notwithstanding any provision to the contrary
contained in this Charter or the City Code, except
for the conveyance or disposition of city -owned
property implementing city -assisted housing pro-
gram or twoiects which are intended to benefit
persona or households with low and/or moderate
income by providing housing for�such persons or
households, such as, but not limited to, those f bided
programs or projects undertaken, pursuant to the
Federal Housing Act of 1937 and the Florida Hous-
ing Act of 1972, as those statutes may be amended
or revised from time to time, implementing city -
assisted housing programs as may be authorized

city commission is authorized to waive all such
disposition requirements where the intended use
of such property or interest therein is in f u-ther-
ance of the objective of providing rental or sales
housing within the economic -affordability range
of low and/or moderate income families and/or
individuals. In determining low and/or moderate
income households as set forth above, the criteria
shall be those provided for by federal and/or state

Sec. 29-C. Same —Watson Island.
Notwithstanding any provision to the contrary
contained in the Charter or Code of the City of
Miami, no sale, conveyance lease, ,management
agreement, revocable use permit, or license agree.

type no smaller than 18-point; and, (2) the pro-
posed transaction be approved by a majority of
the votes cast by the electorate at a referendum
to be held at the next regularly scheduled general
election. The procedures for selection of proposals
shall be those provided by Charter section 29A(c)
or (d) as appropriate and/or by applicable City
Code provisions. Nothing herein shall effect the
existing rights or privileges, if any, of any lessee,
permitter, licensee or concessionaire currently sit-
uated in said area; however, any enlargement,
amendment, transfer, or increase in those rights
or privileges as may be in exiatence at the time
this amendment is adopted shall require compli-
ance with the provisions of this amendment. This
Charter Amendment shall not affect the city's

use or occupancy of the area, nor shall it apply to
contracts for the construction of any city facilities
or improvements in the area; further, nothing
contained herein shall apply to projects of any
governmental agency or instrumentality. (Char.

Sec. 30. Local improvements.
(a) Definitions, divisions into classes. In this
section the following words afid phrases shall have
the following meanings, unless some other mean-
ing is plainly intended:
The main divisions of this section are some-
times herein termed paragraphs, and the divisions
of paragraphs are sometimes herein termed
subparagraphs,
A local improvement is an improvement defined
by this section and made under the provisions
thereof.
The word commission shall be deemed to refer
to the city commission of the City of Miami.
A highway is a public .way such as a street,
boulevard, avenue, lane, alley, parkway, court,
terrace, or place.
A sidewalk is a path for pedestrians along a
highway.
A storm sewer is a conduit above or below ground
for the passage of storm water, including a pump-
ing station and outlet where deemed necessary; it
may also include the building of culverts over
streams or enclosing of streams where necessary
or advisable to carry off storm water.
A sanitary sewer is an underground conduit for
the passage of sewage and may include a pump.

INTERSTATE 195; AND BY PROVIDING
AUTHORIZATION FOR THE WYNWOOD LOCAL

Improvement District, is hereby amended in the following
particulars:1
"Section 1. A Local Government Neighborhood
Improvement District, to be known as the Wynwood Local
Government Neighborhood Improvement District, located
within the City of Miami, bounded by
U.S. Interstate 1955, N.E. 213t Terrace and N.W. 22nd
trees, North Miami Avenue, and N.W. 6th Avenue,
containing approximately 368 acres, is hereby created.
Section 2. The District 13 hereby authorized
to receive a planning grant from the Safe Neighborhoods
Trust Fund.
Section 3. A Safe Neighborhoods Plan shall be
prepared for the District for the coordinated,
balanced, and harmonious development of the District,
and for the reduction of crime through environmental

may prohibit the use of any District powers although
said powers may be authorized by Section 163.514 F.S.

the District by rescinding the herein Ordinance.
Section 4. 10. This Ordinance is hereby declared
to be an emergency measure on the grounds of urgent
public need for the preservation of peace, health,
safety, and property of the City of Miami.
Section q+ 11. The requirement of reading this
Ordinance on two separate days is hereby dispensed with
by an affirmative vote of not less than four -fifths of
the members of the Commission.
Section .1.0. 12. The District . created herein shall
serve as a pilot project for the- City in order to
evaluate the feasibility of similar undertakings
throughout the City."
Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance IS declared invalid,
the remaining provisions of this ordinance shall not be affected.
Section 4. This ordinance is hereby declared to be an

RESOLUTION SUPPORTING THE FOREIGN TRADE ZONE
PROJECT PROPOSED BY THE WYNWOOD COMMUNITY
ECONOMIC DEVELOPMENT CORPORATION TO BE
ESTABLISHED WITHIN THE WYNWOOD COMMUNITY OF
THE CITY OF MIAMI
WHEREAS, the Wynwood Community Economic Development
Corporation has proposed the establishment of a Foreign 'Trade
Zone within the Wynwood community of the City of Miamit and
WHEREAS, pursuant to Resolution No. 88-1039, the City of
Miami found that the plans of the Wynwood Community Economic
Development Corporation are consistent with the objectives and
regulations of the Cit* 6f Miamit and
WHEREAS, the board of County Commissioners recognizes the
many benefits to be derived by the citizens of Dade County
through the attraction of international business, the creation of
jobs and the supportinq economic development which would be
created by the establishment of a Foreign Trade Zone within the
Wynwood community,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF DADE COUNTY, FLORIDA. that this board hereby
supports the Foreign Trade Zone project proposed by the Wynwood
Community Economic Development Corporation to be established
within the wynwood community of the City of Miami.
The foregoing resolution was offered by Commissioner
Larry Hawkins , who moved its adoption. The motion
was seconded by Commissioner 3=W E. Valdes , and upon
being put to a vote, the vote was as follows:

Advisory Board to the Miami City Commission, established to
enhance Miami's competitive position in international trade
through the implementation of innovative approaches to trade and

1988. the Miami City Commission found that the Wynwood Community
Economic Development Corporation plans are consistent with the

State Dade County Enterprise Zones. the Wynwood Local Government
Neighborhood Improvement District. the Garment Center/Fashion
