A RESOLUTION WAIVING THE REQUIREMENTS FOR
FORMAL SEALED BIDS, BY AN AFFIRMATIVE
VOTE OF 4/5THS OF THE MEMBERS OF THE CITY
COMMISSION; RATIFYING CONFIRMING AND
ADOPTING THE CITY MANAGER'S ACTIONS
ACCEPTING THE BID FROM MET CONSTRUCTION,
INC. IN AN AMOUNT NOT TO EXCEED $200,000
FOR THE CONSTRUCTION NECESSARY IN
CONNECTION WITH THE "ORANGE BOWL JOIST
REPLACEMENT - 1989"9 WITH MONIES
THEREFOR ALLOCATED FROM THE "ORANGE BOWL
MODERNIZATION - PHASE II" ACCOUNT,
PROJECT NO 404238, TO COVER THE CONTRACT
COST; RATIFYING, CONFIRMING AND ADOPTING
THE CITY MANAGER'S WRITTEN FINDINGS THAT
A VALID EMERGENCY EXISTS; AND AUTHORIZING
THE CITY MANAGER TO EXECUTE AND/OR ISSUE
THE NECESSARY CONTRACTS AND DOCUMENTS, IN
A FORM ACCEPTABLE TO THE CITY ATTORNEY,
WITH SAID BIDDER.
WHEREAS, there exists a hazardous condition at the Orange
Bowl Stadium, which requires the emergency repair of concrete
joists and associated slabs; and
WHEREAS, MET Construction, Inc., had effected similar
repairs to the Orange Bowl in 1986, and has agreed to undertake
the present repairs at the same prices quoted then; and
WHEREAS, the Director of the Department of Public Work has
determined that the fastest and most effective way to remedy the
situation is to let out a contract immediately for the repair
and reconstruction of the facilities as designed by the
Department; and
WHEREAS, the City Manager has entered into an agreement
with MET Construction, Inc. for the reconstruction and repair of
said joists and slabs; and
WHEREAS, the Capital Improvements Appropriation Ordinance
No. 10648 , was adopted on September 28, 1989, and moni es are
available for the proposed amount of the contracts, project
expense, and incidentals from the account entitled "Orange Bowl
Modernization - Phase II", Project No. 404238 in said ordinance;

WHEREAS, the City Manager has made a written finding that
the use of the competitive sealed bidding method for the award
of the herein procurement contracts is not practicable or
advantageous, due to the existing hazard at the Orange Bowl; and
WHEREAS, the City Commission, after a properly advertised
public hearing, accepts and ratifies the City Manager's above
finding.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The findings set forth in the preamble to this
Resolution are hereby adopted as if fully set forth in this
Section.
Section 2. The requirement for formal competitive sealed
bids for the "Orange Bowl Joists Repairs - 1989" is hereby
waived by a four -fifths vote of the members of the City
Commission.
Section 3. An amount not to exceed $200,000 is hereby
allocated from the account entitled "Orange Bowl Modernization -
Phase II", Project No. 404238 to cover the cost of said
contract.
Section 4. The actions of the City Manager accepting the
bid of MET Construction, Inc., in an amount not to exceed
$200,000 for the emergency repair of concrete joists and slabs
at the Orange Bowl Stadium is hereby confirmed, ratified and
adopted.
Section 5. The City Manager is hereby authorized to enter
into a contract on behalf of the City of Miami with MET
Construction, Inc. for the construction necessary to complete
the "Orange Bowl Joist Repairs - 1989" project.
Section 5. This resolution shall become effective
immediately upon its adoption pursuant to law.

It is respectfully recommended that the City Commission adopt
the attached resolution which waives the requirement for
formal sealed bids in connection with the emergency repairs
to the Orange Bowl joists and seating slabs, and ratifies the
actions of the City Manager in awarding a contract to and
entering into a contract with MET Construction, Inc. to
effect said emergency repairs.
BACKGROUND:
The Department of Public Works has determined that there
existed an emergency need to carry out repairs at the Orange
Bowl. These repairs consisted of the reconstruction and
replacement of approximately thirty five (35) concrete joists
and their associated seating slabs.
In 1986, MET Construction, Inc. undertook similar repairs at
the Orange Bowl, and said firm has agreed to carry out the
work for the same prices quoted to the City at that time. It
is imperative that these repairs be carried out immediately
to safeguard the users of the facility.
The attached resolution waives the time requirements for
formal sealed bids, and ratifies the actions of the City
Manager which awarded a contract and entered into a contract
on behalf of the City with MET Construction, Inc. Funds for
these repairs are available from the "Orange Bowl
Modernization - Phase II" account, CIP Project No. 404238.

The reasons for the emergency are as follows:

Informal bids were taken from the firm of MET
Curl-.truc.tion, Inc., who agreed to effect the

In order- to avoid interruption of the City's
c.urrtr•dctual obligations with the orange Bowl
tenants, these repairs are being made on an
emergency basis.
