A RESOLUTION MAKING FINDINGS, AND DIRECTING THE PERMANENT PROHIBITION OF VEHICULAR ACCESS TO JEFFERSON STREET AT THE SOUTHERLY SIDE OF ITS INTERSECTION WITH SOUTHWEST 28TH STREET IN THE CITY OF MIAMI, FLORIDA, PROVIDED THAT THE CONDITIONS CONTAINED WITHIN THIS RESOLUTION ARE MET; AND DIRECTING THE ADMINISTRATION TO REVIEW OTHER ALTERNATIVES IN THE EVENT THE REQUIRED MONIES FOR THE BARRICADES ARE NOT OBTAINED. WHEREAS, on May 28, 1987, the City Commission passed Resolution No. 87-518 which authorized Leonard A. Ralby and Ralby-Allen Real Estate Partnership to restrict vehicular access to Jefferson Street at S.W. 28 Street on a 6-month trial basis; and WHEREAS, said Resolution required Leonard A. Ralby and Ralby-Allen Real Estate Partnership to send letters to all 256 ® affected property owners soliciting their approval or disapproval for the construction of permanent barriers; and WHEREAS, Leonard A. Ralby and Ralby-Allen Real Estate Partnership have satisfied all of the requirements of said Resolution and are under no obligation to continue the restriction of vehicular access of Jefferson Street at S.W. 28 Street; and WHEREAS, a group of property owners has requested that the City restrict vehicular access, on a permanent basis, to Jefferson Street at S.W. 28 Street based on the results of the property owner survey required by Resolution No. 87-518, said results indicating that a majority of the property owners responding approve of the request to make the vehicular restrictions permanent; and CITY COMMISSION MEETING OF WHEREAS, the Police Department, Fire, Rescue and Inspection Services Department, Solid Waste Department and Metropolitan Dade County Public Works Department have evaluated the effects of the vehicular access restriction upon their respective operations during the 6-month trial period and have expressed no objections of substance to the permanent restriction of vehicular access to the aforesaid street provided that access for emergency vehicles be allowed at all times; and WHEREAS, Section 54-17 of the Code of the City of Miami, Florida, gives the City Commission the power, after a properly advertised public hearing to require that vehicular access to a particular street be prohibited where such prohibition is found to be in the best interest of the public; and WHEREAS, pursuant to due public notice, a public hearing was held before the City Commission on July 27, 1989 as to any objections to the permanent prohibition of vehicular access to the aforesaid street and no objections of substance were sustained by the City Commission, accordingly, the City Commission has approved the prohibition of vehicular access at the aforesaid intersection to be implemented on a permanent basis provided that specific requirements set forth below are met; and WHEREAS, the City Commission hereby finds that the herein prohibition is in the best interest of the public; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings set forth in the Preamble to this Resolution are hereby adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. It is hereby directed that vehicular access to Jefferson Street at the southerly side at its intersection with Southwest 28th Street in the City of Miami, Florida, will be permanently prohibited in accordance with the findings as set forth in Section 1 hereof provided that the following conditions occur: - 2 - a. the aforementioned property owners raise, within 120 days from the date of this Resolution, the monies needed to install and maintain the aforementioned barricade; b. the design of the barricade shall be approved by the Public Works Department; and C. the barricade must be installed by licensed contractors retained by the aforementioned group of property owners. Section 3. In the event that the property owners do not raise the required monies within 120 days from the date of this Resolution, the City Administration shall review other alternatives, such as the use of diverters, a system of one-way streets, or the installation of four-way stops at selected intersections. Section 4. This Resolution shall become effective immediately upon its adoption pursuant to law. PASSED AND ADOPTED this 12th day of October , 1989. Department Responses, City Manager Resolution RECOMMENDATION: It is respectfully recommended that the City Commission NOT adopt the attached Resolution authorizing the permanent restriction of vehicular access to Jefferson Street at S.W. 28 Street. If approved by the City Commission, financing the construction of a permanent barricade at this location must be borne by the property owners requesting this barricade. BACKGROUND: On May 28, 1987, the City Commission passed Resolution No. 87-518 which authorized Leonard A. Ralby and Ralby-Alien Real Estate Partnership to restrict vehicular access to Jefferson Street at S.W. 28 Street on a 6-month trial basis. The temporary restrictions were accomplished by the installation of barricades and signs. All work was accomplished and paid for by Leonard A. Ralby and Ralby-Allen Real Estate Partnership. After the fifth month of the six month trait period had elapsed, Leonard A. Ralby and Ralby-Allen Real Estate partnership sent letters to all 256 affected property owners soliciting their approval or disapproval for construction of permanent barriers. The results received by the Public Works Department are 98 approvals and 38 disapprovals of the request to make the vehicular restrictions permanent. Leonard A. Ralby and Ralby-Allen Real Estate Partnership have satisfied all of the requirements of Resolution No. 87-518 and are under no obligation to continue the restriction of vehicular access of Jefferson Street. The same group of property owners that have previously requested the vehicular access restrictions along Aviation Avenue and S.W. 27 Avenue between Lincoln Avenue and Andros Avenue are now requesting that Jefferson Street at S.W. 28 Street be barricaded permanently based on the results of the survey conducted by Leonard A. Ralby. Page 1 of 2 89pp 9; ....--.Honorab I e Mayor and Members of the City Commission The Police Department, Fire, Rescue and Inspection Services Department, Solid Waste Department and Public Works Department have evaluated the effects of vehicular access restrictions upon their respective operations during the 6-month trial period and recommend against the permanent restriction of vehicular access to Jefferson Street. The Solid Waste Department has Indicated that the temporary barricades have had no effect on Its operations. If a permanent barricade is approved, then the Public Works Department recommends that the property owners requesting the permanent barricade assume all costs for the installation of the barrier with the same conditions as those of the previously approved permanent barricades along Aviation Avenue and S.W. 27` Avenue.
