HomeMy WebLinkAboutR-89-0921.1w J-89-965 10/ 12/89 RESOLUTION NO. �"".��:�;• A RESOLUTION APPROVING THE CHIEF PROCUREMENT OFFICER'S DECISION TO REJECT THE PROTEST RECEIVED FROM JUSTICE SYSTEM DEVELOPMENT GROUP, INC. IN CONNECTION WITH THE REQUEST FOR QUALIFICATIONS ISSUED JUNE 22, 1988 FOR THE DEVELOPMENT OF A FEDERAL LAW ENFORCEMENT BUILDING IN DOWNTOWN MIAMI, FLORIDA. WHEREAS, in connection with the Request For Qualifications (RFQ) issued June 22, 1988 for the development of a Federal Law Enforcement Building in Downtown Miami, Florida, it was determined by the Chief Procurement Officer in his role as the arbiter of bid protests pursuant to Section 18-56.1 of the City Code that the protest filed by Justice System Development Group, Inc., be rejected as it lacks merit for the reason set forth below; and WHEREAS, the reason that this protest lacks merit is because the proposal submitted does not meet the required specification on Section III, B of the RFQ which states "in no event shall any of the individual Minority participants hold less than 5% ownership interest"; and WHEREAS, the minority participants set forth in the proposal of Justice System Development Group, Inc., clearly do not meet this requirement; and WHEREAS, the Chief Procurement Officer's rejection has been approved by the City Manager and the City Attorney; and WHEREAS, in the vote adopting the herein Resolution there were two members of the five members Miami City Commission who were disqualified from voting thereon and who did not vote; and WHEREAS, the remaining three members of the City Commission have duly considered the argument presented in regard to the protest and its rejection and a majority of those members approve of the rejection; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: CITY COMMISSION MEETING OF OCT 12 1989QQ RESOLUTION No. —' 2141 Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and incorporated herein as if fully set forth in this Section. Section 2. The Chief Procurement Officer's rejection of the herein protest filed by Justice System Development Group, Inc., is hereby approved. Section 3. Odi REFERENCES � ment Building in City Manager downtown Miami ENCLOSURES: It is respectfully recommended that the City Commission adopt a resolution approving the Chief Procurement Officer's decision to reject the protest received from Justice System Development Group, Inc. in connection with the Request for Qualifications Issued June 22, 1988 for the Development of a Federal Law Enforcement Building in Downtown Miami, Florida. BACKGROUND: A protest was received from Blackwell, Walker, Fascell & HOehl and it was determined by the Chief Procurement Officer in his role as the arbiter of bid protests pursuant to Section 18-56.1 of the City Code that this protest lacks merit. It does not meet the required specification on Section III, B of the RFQ which states "in no event shall any of the individual Minority participants hold less than 5% ownership interest.
