RESOLUTION NO. 89 -902.
A RESOLUTION, WITH ATTACHMENTS, ACCEPTING THE
BID OF CAZO CONSTRUCTION CORPORATION (A
HISPANIC CONTRACTOR) IN THE AMOUNT OF
$169,444, BASE BID OF THE PROPOSAL, FOR
SCATTERED SITE HOUSING DEVELOPMENT PROJECT-
ALLAPATTAH PHASE I; FURTHER ACCEPTING THE
BIDS OF ROBINSON CONSTRUCTION, INC. (A BLACK
CONTRACTOR) IN THE AMOUNT OF $171,200 AND
$85,500, BASE BIDS OF THE PROPOSALS, FOR
SCATTERED SITE HOUSING DEVELOPMENT PROJECTS -
MODEL CITY PHASE II AND MODEL CITY PHASE III,
RESPECTIVELY; WITH FUNDS THEREFOR ALLOCATED
FROM "SCATTERED SITE AFFORDABLE HOUSING
DEVELOPMENT PROGRAM" ACCOUNT, CAPITAL
IMPROVEMENT ORDINANCE NO. 10642, PROJECT
NO. 321034, TO COVER THE SAID CONTRACT
AMOUNTS; FURTHER AUTHORIZING THE CITY MANAGER
TO EXECUTE SAID CONTRACT(S) WITH THE
AFOREMENTIONED CONSTRUCTION FIRMS.
WHEREAS, sealed bids were received on August 15, 1989 for
Scattered Site Affordable Housing Development Project-Allapattah
Phase I, in connection with the construction of four (4) new
single family homes on City -owned parcels scattered in the
Allapattah Community Development Target Area; and
WHEREAS, the City Manager and the Directors of the
Department of Development and Housing Conservation and the
Department of Public Works recommended that the bid received from
Cazo Construction Corporation be accepted as the lowest
responsible and responsive bid; and
WHEREAS, sealed bids were received on August 15, 1989 and
August 17, 1989 for Scattered Site Affordable Housing Development
Projects -Model City Phase II and Model City Phase III,
respectively, in connection with the construction of four (4) and
two (2) new single family homes on City -owned parcels scattered
in the Model City Community Development Target Area; and
WHEREAS, the City Manager and the Directors of the
Department of Development and Housing Conservation and the
Department of Public Works recommended that the bids received
from Robinson Construction, Inc. be accepted as the lowest
responsible and responsive bids; and

REMARKS.

WHEREAS, Capital Improvement Ordinance No. 10642 was adopted
on September 28, 1989, and funds are available for the proposed
amounts of the contracts, project expenses, and incidentals under
Project No. 321034 of said Ordinance;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The August 15, 1989 bid of Cazo Construction
Corporation in the proposed amount of $169,444, in connection
with Scattered Site Affordable Housing Development Project-
Allapattah Phase I, for the construction of four (4) new single
family homes in the Allapattah neighborhood, for the base bid of
the proposal based on lump sum prices, is hereby accepted at the
price stated therein, with funds therefor hereby allocated from
the "Scattered Site Affordable Housing Development Program"
Account, Capital Improvement Ordinance 10624, Project No. 321034,
to cover the cost of said contract pursuant to Motion No. 89-537,
as adopted on June 7, 1989.
Section 2. The August 15, 1989 and August 17, 1989 bids of
Robinson Construction, Inc. in the proposed amount of $171,200
and $85,500, in connection with Scattered Site Affordable Housing
Development Projects -Model City Phase II and Model City Phase III
for the construction of four (4) and two (2) new single family
homes in the Model City neighborhood, respectively, for the base
bid of the proposals based on lump sum prices, are hereby
accepted at the prices stated therein, with funds therefor hereby
allocated from the account entitled "Scattered Site Affordable
Housing Development Program" to cover the cost of said contracts
pursuant to Motion No. 89-537, as adopted on June 7, 1989.
Section 3. The City Manager is hereby authorized to enter
into contracts with the construction firms of Cazo Construction
Corporation and Robinson Construction, Inc., in substantially the
attached form, on behalf of the City of Miami, in connection with
the development of four (4) new single family homes in the
Allapattah neighborhood and six (6) new single family homes in

the Model City neighborhood under the City's Scattered Site
Affordable Homeownership Development Program.
Section 4. This Resolution shall become effective
immediately upon its adoption.

ADVERTISEMENT FOR BIDS
Sealed bids for the construction of four (4) single family homes (Model C) for the
Scattered Site Housing Homeownership Development Program,,MQ911 Cit Phase II will

Mid , an Drive, Dinner Key, Miami, Florida 33133, at
which time and place they will be publicly opened and read.
The project consists of site preparation and construction of four (4), three -
bedroom, two -bath single family residences. The project is to be constructed at
the following publicly owned sites: 1590 Northwest 58th Street; 1360 Northwest
59th Street; 5845 Northwest 12th Avenue and 1601 Northwest 52nd Street.
The estimate for this project is $190,000. City does not require permit bidders
to furnish performance and bid bonds in accordance with Resolution No. 86-983.
For clarification of technical issues as presented in the construction documents
and specifications please contact Luis Morera at the City of Miami Housing
Conservation and Development Agency, (305)579-3336.
All bids shall be submitted in accordance with the Instructions to Bidders and
Specifications. New City regulations will require each bidder to submit proposals
in duplicate originals. Plans and specifications may be obtained from the office
of the Director of Public Works, 275 N.W. 2 Street, 3rd floor, Miami, Florida,
33128, on or after July 25, 1989. If bidders wish, a set of plans and
specifications will be mailed to them by writing to the Department of Public Works
and including a separate check for $8. There will be a $20 deposit required for
the first set of pins and specificaoTons. Additional sets may be purchased for a
fee of $ZO per set and this is not refundable. Deposits will be refunded only
upon the return of one set of plans and specifications to the Department of Public
Works, unmarked and in good condition within two (2) weeks after the opening of
the bids.
A pre -bid conference will take place at 10:00 A.M. on August 3, 1989, at the
Public Works Department, to address questions regarding the project. -Prospective
bidders are urged to attend.
Prospective bidders are alerted to the provisions of Ordinance No. 10062 regarding
allocation of contracts to minority vendors. The City will expect prospective
bidders to submit an Affirmative Action Plan, as defined in said Ordinance, and as
required in the Instructions to Bidders. THIS PROJECT HAS BEEN DESIGNATED AS A
SET -ASIDE FOR BLACK OWNED BUSINESSES OR JOINT VENTURES.
The City of Miami has adopted Ordinance No. 10032, which implements the "First
Source Hiring Agreement." The object of this ordinance is to provide employment
opportunities to City of Miami residents on contracts resulting in the creation of
new permanent jobs. Contractors may be eligible for wage reimbursement under this

Proposal includes the time of performance, and specifications contain provisions
for liquidated damages for failure to complete the work on time. The City
Commission reserves the right to waive any informality in any bid, and the City
Manager may reject any or all bids, and readvertise (B-3240-B, Req. 554.6).

ARTICLE 4. TIME OF COMPLETION: The Contractor shall commence the
worK to be performed under this Contract within the number of
consecutive calendar days after date of written notice from the
Director of the Department of Public Works to begin work. as noted
in the Proposal, and shall fully complete the Contract in
accordance with the Contract Documents within the number of
working days as set forth in the Proposal.
It is mutually agreed between the parties hereto, that time is the
essence of this Contract, and, in the event that construction of
the work is not completed within the time herein specified, it is
agreed that from the compensation otherwise to be paid to the
Contractor, the City may retain for each day thereafter, Sundays
and holidays included, that the work remains uncompleted, the sum
set forth in the General Conditions of the Specifications, as
modified by Division 2 - Special Provisions, which sure represents
the actual damage which the City of 'Miami, Florida, will have
sustained ner day by failure of the Contractor to complete the
work within the time stipulated, and this sum is not a oenal ty,
but will be the liquidated damage the City wi l l have sustained in
event of such default by the Contractor.

ARTICLE S. ADDITIONAL. BOND: It is further mutually agreed
etween -t a parties hereto, that i f, at any time after*.he
execution of this Agreement and the Performance Bond hereto
attached, when required for its faithful performance, the City
shall deem the surety or sureties upon such bond to be
unsatisfactory, or if, for any reason, in the opinion of the
Engineer; such bond ceases to be adenuate to cover the performance
of the work, the Contractor shall, at his expense, within five M
days after receipt of notice from the Engineer so to do, furnish
an additional bond or bonds in such form and amount, and with such
surety or sureties as shall be satisfactory to the City. In such
event, no further payment to the Contractor shall be deemed to he
due under this Agreement until such new or additional security for
the faithful performance of the work shall be furnished in manner
and form satisfactory to the City.
ARTICLE 6. CONTRACT DOCUMENTS: All of the documents hereinafter
listed form the Contract and they are as fully a part of the
Contract as if hereto attached, or repeated in this Agreement:

It is respectfully recommended that the City Commission adopt the
attached resolution accepting the low bid of Cazo Construction
Corporation (A Hispanic Contractor) received on August 15, 1989 in
the amount of $169,444, base bid, in connec`_lon with the
development of four (4) new single family homes under Allapattah
Scattered Housing Phase I. Further accepting tale low bids of
Robinson Construction, Inc. (A Black Contractor) in the amounts of
$171,200 and $85,500, base bids in connection with Elie development
of six (6) new single family homes under Model City Scattered Site
Housing Phase II and III, respectively, received August 15, 1989
and August 17, 1989. The attached resolution further authorizes
the City Manager to enter into contracts on behalf or the City with
Cazo Construction Corporation and Robinson Construction, Inc. for
the construction of ten (10) new 3-bedroom, 2-bat,1 single family
homes in the Allapattah and Model City neighborhoo(i,.
BACKGROUND:
In October of 1986, the City Commission took a major step toward
addressing the existing housing affordability gap in the City by
approving implementation of the City sponsored Scattered Site
Affordable Homeownership Development Program.

With the City of Miami serving as developer, it is possible for the
City to construct and deliver "at cost" new single family homes at
sales prices affordable to low and moderate income purchasers in
the City's Community Development Target Areas. The City
Commission, in October of 1986 also approved t'liz-1 issuance of
$4,290,000 in Special Obligation Bonds, 1986 Series A, the proceeds
of which have been used for the establishment )f a revolving
construction fund for this unique Program.
To date, seven (7 ) new single family homes have: b.2'an sold and
occupied by low and moderate income families in the Model
neighborhood on the former City -owned Carver Branch 'Y74CA Site,

Construction has been recently completed on two (2) new 3-bedroom,
2-bath single family homes at 49 and 51 Northwest 35th Street in
the Wynwood neighborhood. On September 26, 1989, a closing was
held Dn one o'f the homes and it is anticipated that the closing on
the remaining home will take place on/or before October 5, 1989.
On June 7, 1989, through Motion No. 89-537, the City Commission
approved the solicitation of bid proposals from private contractors
for construction of ten (10) new 3-bedroom, 2-bath single family
homes on City -owned parcels located in the neighborhoods of
Allapal-tah (4) and Model City (6). Through Motion No. '89-537, the
Cite Commission further authorized and all•-)cated $460,000 in
Special Obligation Bond proceeds for the purpose of funding the
cost :-)f construction and other related expenses associated with the
development of the ten (10) dwelling units planned. The purchase
price for each of the 3-bedroom, 2-bath single family homes planned
is estimated at $59,900, inclusive of land costa
On August 15, 1989 and August 17, 1989, fifteen (15) small Hispanic
own-d and Black owned construction firms submitted bid proposals to
the City in accordance with the development of the ten (10) single
family homes planned for construction in the •Allapattah and Model
City neighborhoods. The exhibits accompanying the attached
resol-ition provide a brief analysis of the lowest responsible and
responsive bid proposals, in addition to a summary of the bid
