ORDINANCE NO. 106152.
AN EMERGENCY ORDINANCE AMENDING SECTIONS
1,2,4, AND 5, OF ORDINANCE NO. 10484, THE
ANNUAL APPROPRIATIONS ORDINANCE FOR THE
FISCAL YEAR ENDING SEPTEMBER 30, 1989 AS
AMENDED, FOR THE PURPOSE OF FORMALIZING CITY
COMMISSION ACTIONS AND IMPLEMENTING
ADDITIONAL BUDGETARY ADJUSTMENTS TO COMPLY
WITH GENERALLY ACCEPTED ACCOUNTING
PRINCIPLES, AS OUTLINED BY THE CITY'S
EXTERNAL AUDITORS; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 10484 the
annual appropriations ordinance on September 27, 1988,
establishing revenues and appropriations for the City of Miami,
Florida for the Fiscal Year ending September 30, 1989; and
WHEREAS, additional adjustments to said FY189
appropriations ordinance are set forth below together with the
explanation for said adjustments; and
WHEREAS, the most recent revenue projection prepared by the
Department of Budget for the FY189 General Fund identifies
certain revenue increases and decreases in the major revenue
categories; and
WHEREAS, the net effect of these adjustments is zero; and
WHEREAS, the Internal Audits and Reviews Department
requires an additional appropriation of $65,000 to cover the
underfunding of salary related expenditures; and
WHEREAS, revenue to fund this increase is available in
Special Programs and Accounts; and
WHEREAS, the land sale of the Municipal Shop Properties to
Miami -Dade Community College of which a partial collection in
the amount of $3,000,000 will first be appropriated in the
Property and Lease Management Budget, and transferred to the
General Fund, $2,500,000 and Capital Improvement Fund, $500,000;
and
WHEREAS, a Special Obligation Bond Fund in the amount of
$4,200,000 was established in FY187 to fund the construction of
Scattered Site Affordable Housing; and

WHEREAS, revenue to repay these bonds is allocated from -�
telephone franchise fees; and
WHEREAS, it is anticipated that $415,000 of Telephone
Franchise fees will be needed in FY189 to support the Debt
Service requirements of said bond issue; and
WHEREAS, the amount of $214,000 in proceeds from
Certificate of Participation Notes, Series 1986 is available to
reimburse the Miami Stadium for previously incurred restoration
costs funded by Miami Stadium Revenues and $3,467,794 will be
transferred to the General Fund, and $720,000 will be reimbursed
to the General Fund from a loan to S.E.O.P.W.; and
WHEREAS, the Utility Service Tax Special Revenue Fund will
receive $336,490 in additional revenue due to increased
collection efforts by the City and higher electricity consumption
by customers; and
WHEREAS, the Internal Service Funds, Custodial Maintenance
will increase by $41,000 and Fleet Management by $200,000 due to
increased custodial requirements relative to the Police Sub
Stations coming on line and additional costs for motor fuel; and
WHEREAS, the City of Miami has received an additional
$611,536 in pension receipts from the State of Florida, for
Police and Fire Personnel pursuant to Chapters 175 and 185 of the
Florida Statutes; and
WHEREAS, the General Fund or the Utility Service Tax
special Revenue Fund is authorized to borrow up to $3,000,000
from the New Port Bridge Land Sale Fund if required; and
WHEREAS; the previous increase of $2,751,000 in Self
Insurance Trust Fund Revenues (Group Benefit Section) is
allocated as follows; ($1,751,000 Departmental Billings and
$1,000,000 Fund Balance appropriation);
NOW, THEREFORE , BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Sections 1, 2, 4 and 5 of Ordinance No. 10484
adopted, September 27, 1988, the Annual Appropriations Ordinance
for Fiscal Year ending September 30, 1989, is hereby amended in

Section 2. The herein adjustments to the General Fund
revenue categories results from certain revenue increases and
decreases for same. These adjustments were based on a recent
revenue projection prepared by the Department of Budget.
Section 3. The herein increase in revenue and expenditures
in the amount of $415,000 for the Special Obligation Bond Fund
supports the Debt Service requirements associated with the
$4,200,000, Scattered Site Affordable Housing Construction. All
remaining balances of the Southern Bell Telephone Franchise to be
transferred to the General Fund.
Section 4. The herein increase in revenue and
appropriations for Miami Stadium is a result of a reimbursement
from Certificate of Participation Dotes, Series 1986 for
previously incurred restoration costs funded by Miami Stadium
revenues.
Section 5. The herein increase in appropriations for
Internal Audits and Reviews in the amount of $65,000 results from
the underfunding of salary related expenditures. Revenue to fund
this increase is available from Special Programs and Accounts.
Section 6. The herein increase in revenue and expenditures
in the amount of $3,000,000 from a partial collection of land

sales to the Property and Lease Management Budget is from the
sale of the Municipal Shop Properties to Miami -Dade Community
College. Said revenue will be transferred to the General Fund,
$2,500,000 the Capital Improvement Fund, $500,000.
Section 7. The herein increase in appropriations for the
Utility Tax Special Revenue Fund in the amount of $336,490 is due
to increased collection efforts and electricity consumption.
Section 8. The increase in appropriations for the Internal
Service funds, Custodial Maintenance, $41,000 and Fleet
Management $200,000 is due to increased requirements for
Custodial Services relative to the Police Sub Stations coming on
line and additional costs for motor fuel.
Section 9. The herein increase in appropriations for
Pension in the amount of $611,536 results from receipts from the
State of Florida, pursuant to Chapters 175 and 185 of the Florida
Statutes.
Section 10. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provision of
this ordinance are hereby repealed.
Section 11. If any Section, part of Section, paragraph,
clause, phrase, or word of this ordinance is declared invalid,
the remaining provision of this ordinance shall not be affected.
Section 12. This ordinance is hereby declared to be an
emergency measure on grounds of urgent public health, safety and
property of the City of Miami and upon the further ground of the
necessity to make the required and necessary payments to its
employees and officers, payment of its debts, necessary and
required purchases of goods and supplies, and to generally carry
on the function and duties of municipal affairs.
Section 13. The requirement of reading this ordinance on
two separate days is hereby dispensed with by a vote of not less
than four -fifths of the members of the Commission.

Proposed Amendment to the
FY'89 Annual Appropriation
ordinance
It is respectfully recommended that the City Commission adopt the
attached emergency ordinance making additional budgetary
adjustments to comply with generally accepted accounting
principles as outlined by the City's external auditors.
The Departments of Budget and Finance have identified certain
budgetary changes that should be made to Ordinance No. 10484, as
amended, the FY'89 annual appropriations ordinance. The reasons
for the recommended changes are stated below.
The most recent revenue projection prepared by the Department of
Budget for the FY189 General Fund identifies certain revenue
increases and decreases in the major revenue categories. The net
effect of these adjustments is zero.
The appropriations for the Internal Audits and Reviews Department
is being increased by $65,000 to cover the underfunding of salary
related expenditures. Revenue to fund this increase is available
from Special Programs and Accounts.

The appropriations for the Miami Stadium will increase by
$214,000 as a result of a reimbursement from Certificate of
Participation Notes Series, 1986 for previously incurred
restoration costs funded by Miami Stadium revenues.
The appropriation for the Special Obligation Bond Fund requires
$415,000 from Telephone Franchise fees to support the Debt
Service requirements of the $4,200,000 Scattered Site Affordable
Housing Bond Issue.
The Utility Service Tax Special Revenue Fund will receive
$336,490 in additional revenue due to increased collection
