HomeMy WebLinkAboutR-89-0994J-89-1074 10/26/89 RESOLUTION NO. 99-994' A RESOLUTION ESTABLISHING SPECIAL CHARGES, TERMS AND CONDITIONS FOR THE USE OF THE MIAMI BOBBY MADURO BASEBALL STADIUM BY MIAMI AMATEUR BASEBALL ASSOCIATION, INC. FOR SAID ASSOCIATION'S 1989 SEASON OF AMATEUR BASEBALL GAMES TO BE HELD DURING THE PERIOD OCTOBER 1989 THROUGH JANUARY 1990; ALLOCATING AN AMOUNT NOT TO EXCEED $25,000 FROM SPECIAL PROGRAMS AND ACCOUNTS, CONTINGENT FUND, TO COVER CERTAIN CITY FEES AND EXPENSES IN SUPPORT OF SAID GAMES, AND CONDITIONED THAT NO FEES ARE CHARGED TO PARTICIPANT ATHLETES BY SAID ASSOCIATION; AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY AGREEMENTS), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH SAID USER FOR THIS PURPOSE. WHEREAS, the City of Miami Department of Parks, Recreation and Public Facilities seeks quality sporting events for the Miami Bobby Maduro Baseball Stadium for the enjoyment of the community; and WHEREAS, the Miami Amateur Baseball Association, Inc. has utilized said stadium since 1980 and has again requested the use of said stadium for its 1989 season of approximately 27 baseball programs and an elimination tournament to be held during the period October 1989 through January 1990; and WHEREAS, it is recommended that special fees, terms and conditions be established for this community sporting event; and WHEREAS, it is recommended that the use fee to be paid by said Association be set at a flat rate of $250 per day; and WHEREAS, departmental expenses for the program amount to approximately $295 for day programs and $745 for night programs and include, without limitation, event personnel, cleanup, trash removal, and field lighting and preparation; WHEREAS, said use fee and expenses accumulate to a total amount not to exceed $25,000 for the entire use period; and WHEREAS, said Association will be responsible for the payment of the applicable ticket surcharge and Police expenses; _ and CITY COMMISSION MEETING OF OCT Y-6 1989 -S WHEREAS, the City Manager and the Director of the Department I of Parks, Recreation and Public Facilities recommend that a grant in an amount not to exceed $25,000 be allocated from Special Programs and Accounts, Contingent Fund, to cover said use fee and departmental expenses; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are hereby adopted by reference thereto and included herein as if fully set forth in this Section. Section 2. The special charges, terms and conditions set forth in the Preamble to this Resolution are hereby established for the use of the Miami Bobby Maduro Baseball Stadium by the Miami Amateur Baseball Association, Inc. for said Association's 1989 season of amateur baseball games to be held during the period October 1989 through January 1990. Section 3. An amount not to exceed $25,000 is hereby allocated from Special Programs and Accounts, Contingent Fund, to cover the use fee and certain City expenses in support of said games, on condition that no fees are charged to participant athletes by said Association. Section 4. The City Manager is hereby authorized to execute the necessary agreement(s), in a form acceptable to the City Attorney, for this purpose. Section. 5. This Resolution shall become effective immediately upon its adoption. PASSED AND ADOPTED this 26th day of October 1989. / XAVIER L.
