THE RHODE BUILDING), LOCATED AT APPROXIMATELY NORTHWEST 1ST COURT AND NORTHWEST 5TH STREET, BLOCK 76-N, BLOCK 76-E AND THE RIGHT-OF-WAY OF NORTHWEST 1ST COURT AND NORTHWEST 4TH STREET ABUTTING THE AFOREMENTIONED PROPERTIES, MIAMI, FLORIDA, A DEVELOPMENT OF REGIONAL IMPACT, PURSUANT TO - CHAPTER 380, FLORIDA STATUTES, BY AMENDING FINDINGS OF FACT; BY INCORPORATING ADDITIONAL DEVELOPMENT OF APPROXIMATELY 232,680 GROSS SQUARE FEET OF PARKING STRUCTURE (724 PARKING SPACES), BY MODIFYING THE SITE PLAN; APPROVING CONSTRUCTION, AND FINDING AND CONFIRMING THAT THESE CHANGES DO NOT CONSTITUTE SUBSTANTIAL DEVIATIONS PURSUANT TO CHAPTER 380, FLORIDA STATUTES; THAT THE PROPOSED PARKING SPACES ARE INCLUDED IN THE BASE DATA FOR DOWNTOWN MIAMI DEVELOPMENT OF REGIONAL IMPACT DEVELOPMENT ORDER (RESOLUTIONS 87-1148 AND 87-1149, DECEMBER 10, 1987), AND INCORPORATING THESE FINDINGS IN CONCLUSIONS OF LAW; DIRECTING THE CITY CLERK TO TRANSMIT COPIES OF THIS RESOLUTION TO AFFECTED AGENCIES AND THE DEVELOPER; AND CONTAINING AN EFFECTIVE DATE. WHEREAS, by Resolution 76-184, February 10, 1976, the City Commission issued a Development Order for the State of Florida's Dade County Regional Service Center Project (a.k.a. the Rhode Building), located at Northwest First Court and Northwest Fifth Street, Block 76-N, Block 76-E and right-of-way of Northwest First Court and Northwest Fourth Street abutting the aforementioned properties, a Development of Regional Impact, pursuant to Chapter 380, Florida Statutes,and then Zoning Ordinance No. 6871; and WHEREAS, by Resolution 83-37, January 13, 1983, the City Commission granted approval of construction of Phase II; and WHEREAS, the applicant, the State of Florida Department of General Services, now desires to provide additional on -site i U, i ' 9 it le ei % ir�9 CITY COMMISSION MEETING OF OCT 26 1989 RESOLUTION No. parking in lieu of the off -site parking required by the original Development Order to serve the Projeot and consequently desires to amend the previously issued Development Order; and WHEREAS, on August 4, 1989, the applicant filed "Notification of a Proposed Change to a Previously Approved Development of Regional Impaot (DRI) Subseotion 380.06(19), Florida Statutes" with the Florida Department of Community Affairs, the South Florida Regional Planning Counoil and the City of Miami; and WHEREAS, on August 4, 1989, the applicant applied for an amendment to the previously -issued Development Order; and WHEREAS, the proposed amendments to the projeot adding approximately 724 parking spaces in one building is not presumed to constitute a substantial deviation under Section 380.06(19); and WHEREAS, the Miami Planning Advisory Board, as its meeting i of September 20, 1989, Item No. 2(a), following an advertised hearing, adopted Resolution No. PAB 46-89 by a vote of 7 to 1 RECOMMENDING APPROVAL of amending the previously approved Development Order; and 1 WHEREAS, the City Commission held an advertised public i hearing to consider the applioation for amendment of the original Development Order and whether it oonstituted a substantial deviation under Chapter 380, Florida Statutes; and WHEREAS, the City Commission deems it advisable and in the best interests of the citizens of the City of Miami to issue the above mentioned amended Development Order as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Seotion 1. The reoitals and findings contained in the preamble to this Resolution pertaining to substantial deviation as Conclusions of Law are hereby approved, confirmed, and adopted by reference hereto and incorporated herein as if fully set forth in this section. - 2 - Section 2. Resolution No. 76-184, attached hereto; adopted February 10, 1976, with the attached Development Order marked as Exhibit A, for the State of Florida's Dade County Regional Service Center Project a Development of Regional Impact per Chapter 380, Florida Statutes, located at approximately Northwest 1st Court and Northwest Sth Street more particularly described as blocks 76N and 76E, and the right-of-way of Northwest 1st Court and Northwest 4th Street abutting the aforementioned properties, A.L. KNOWLTON, Plat Book B, Page 41, Public Records of Dade County, Florida, is hereby amended in the following respects:I/ "EXHIBIT "A" The development shall consist of an office structure constructed in four stages comprising a total floor area of approximately 526,675 gross square feet, a total floor area ratio of approximately 3.99, a building coverage of approximately 29.66% A 724 space multistory parking structures with a building coverage of approximly 18 percent, paved areas including walks and drives of approximately 29.34M 18.00% and landscaped area of approximately 41.0% of the total lot area. Said development shall be in accord with the application for development approval as submitted to the South Florida Regional Council, and the Department of Administration Planning and Zoning Boards and the State of Florida Department of Community Affairs, (See site plan. as modified attached) Pursuant to Section 380.06 and after due consideration of the consistency of this development with regulations, and the regional report this body took the following action: Approval of this development subject to the following conditions: Words and/or figures stricken through shall be deleted. The following findings of fact are made with respect to the application for an Amended Development Order for the Project: a. this amendment, by specifically adding one parking structure to accommodate workers in and visitors to the existing office buildings, does not constitute a substantial deviation pursuant to Chapter 380, Florida Statutes. b. the Project, as amended, is consistent with the Downtown Development of Regional Impact Development Orders (Resolutions 87-1148 and 87-1149; Ordinances 10461, 10543 and the State of Florida Administrative Hearing Settlement Case Number 88-1638, hereafter referred to as the Downtown Development Order); and o. this Amended Development Order is further implemented by issuance of a companion Major Use Special Permit. Section 4. The application for Amended Development Order dated August 4, 1989, as submitted by the applicant, on file with the Planning Department, shall be relied upon for administrative interpretations. Section 5. The following Conclusions of Law are hereby incorporated in this resolution. The State of Florida Dade County Regional Service Center Amended Development Order proposed by the State of Florida Department of General Services, complies with the Miami Comprehensive Neighborhood Plan 1989-2000, is consistent with the orderly development and goals of the City of Miami, and complies with local land development regulations. The proposed development, as amended, does not unreasonably interfere with the achievement of the objectives of the adopted State Land Development Plan applicable to the City of Miami; and The proposed development, as amended, is consistent with and shall comply with the Downtown Development of Regional Impact Development Orders and thus with the considerations and objectives set forth in Chapter 380, Florida Statutes. h.: Changes in the project, as amended, which do not exceed development parameters set forth in the State of Florida Regional Service Center Development of Regional Impact or the Downtown Development of Regional Impact Application for Development Approval and Report and Recommendations of the Regional Planning Council shall not constitute a substantial deviation under Chapter 380, Florida Statutes, notwithstanding City zoning approvals which may be required. Additionally the administration may permit minor non -substantial increases of square footage and/or minor changes in the number of parking spaces provided, not exceeding 5% without a further public hearing. Section 6. This Development Order shall become null and void three years from the effective date of this Resolution unless construction work, beyond site preparation, has commenced by that date. Section 7. This Resolution shall be transmitted to Ronald W. Let it be known that pursuant to Section 380.06(7), Florida Statutes, the Commission of the City of Miami, Florida, has heard at a Public Hearing held on February 10, 1976, an application for a development of regional impact consisting of an office structure to be located in the downtown government center in the City of Miami beginning in 1976. The development shall consist of an office structure constructed in four stages comprising a total floor area of approximately- 626,67S gross square feet, a total floor area ratio of approximately 3.99, a building coverage of approximately 29.66%, paved areas including walks and drives of approximately 29.34% and landscaped area of approximately 41.0% of the total lot area. Said development shall be in accord with the applica- tion for development approval as submitted to the South Florida Regional Planning Council and the Department of Administration Planning and Zoning Boards. Pursuant to Section 380.06 and after due consideration of the consistency of this development with regulations, and the regional report this body took the following action: approval of this development subject to the following conditions: 1. In the event the Stage I transit program does not become operational by 1985, and the Miami Off -Street Parking Authority cannot meet the Phase III parking requirements for the proposed Service Center as stated in the ADA, the City of Miami shall delay permission for development of Phase III until such a time as parking for those employees and visitors can be guaranteed. In the event Stages II and III of the transit program do not become operational by 1990, and parking requirements for Phase IV cannot be met, the City of Miami shall delay development permits until parking requirements, as stated in the ADA, can be guaranteed. 3. F.S., by amending findings of fact; by incorporating additional development of approximately 232,680 gross square feet of parking garage (724 parking spaces), by modifying the site plan; approving construction, and finding and confirming that these changes do not constitute substantial deviations pursuant to Chapter 380. F.S.; that the proposed parking spaces are included in the base data for Downtown Miami Development of Regional Impact Development Orders (Resolutions 87-1148 and 87-1149, December 10, 1987) and incorporating these findings in conclusions of law, directing the City Clerk to send copies of this Resolution to affected agencies and the developer; and containing an effective date. BACKGROUND In 1976, a development order (Resolution 76-184) February 10, 1976) was issued for four phases of the State Regional Service Center (Rhode Office Building). The project, as proposed and accepted by the development order included only office buildings and did = include parking structures. These spaces were located at: 312 spaces in municipal lots; 75 on street spaces and 444 spaces on land available for lease. An additional 700 spaces were available on an interim basis on 5 acres of County -owned land south of the project. After 1980, both the City and County constructed parking garages on N. W. 2nd Avenue. Conditions 2 and 3 of the 1976 development order approved phases III and IV, subject to the inception of Metrorail Service, transit utilization criteria for employees and visitors, and parking availability. Subsequently, the Downtown Government Center DRI Development Order was issued (since ex fired) and the Downtown -Miami and Southeast OvertownPPark West DRI Development Orders were approved, all assuming that the subject Development Order would be built out. However, there was no separate accounting of parking spaces. ANALYSIS The State Department of General Services proposes to construct two parking garages, as follows: Lgcation Spaces Floor Area (o.s.f.) Site "A" 724 232,680 Site "B" 675 216,160 1399 448,840 Site "A" is south of N.W. 5th Street; Site "B" is north of N.W. 5th Street. Several factors have moved the State to purchase the one acre Site "B" north of N. W. 5th Street and to utilize the location of proposed Phases III and IV of the Regional Service Center as the Site "A" parking garage; principally being the desire of Metro -Dade County to utilize their property in the Downtown Government Center for the green park. The amendments to the previously -approve DRI Development Order would approve construction of the Site "A" parking garage, require a further amendment in the event that the State decided to provide with the Phase III and IV office buildings; find that this garage is consistent with the Downtown Miami DRI, and find that these amendments do not constitute a substantial deviation. The reasoning for the "no substantial deviation" finding is that the office workers and visitors to the existing Phase I and II office buildings already are on this site, having arrived by Metrorail or having parked in the immediate area. Therefore, there is no further impact by having these people, already in the area, park their vehicles in garages (or continue to utilize Metrorail). The Major Use Special Permit would approve construction of both garages, stipulate various conditions pertaining to these approvals, and find that the garages are consistent with the Downtown Miami and Southeast Overtown/Park West DRI Development Orders. PLANNING ADVISORY BOARD At its meeting of September 20, 1989 the Planning Advisory Board adopted Resolution 46-89 by a vote of 7 to 1 - recommending approval of the above.
