AN EMERGENCY ORDINANCE ESTABLISHING A NEW
SPECIAL REVENUE FUND ENTITLED: MANUEL ARTIME
DEVELOPMENT FUND; APPROPRIATING $20,580 FROM
THE METROPOLITAN DADE COUNTY CULTURAL AFFAIRS
COUNCIL FY'89-90 DEVELOPMENT GRANT;
AUTHORIZING THE CITY MANAGER TO ACCEPT THE
AFOREMENTIONED GRANT AWARD AND ENTER INTO THE
CONTRACT AND/OR AGREEMENTS, NECESSARY FOR
SUCH ACCEPTANCE CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Metropolitan Dade County Cultural Affairs
Council has made a grant to the City of Miami for an amount not
to exceed $20,580 to support the improvements at the Manuel
Artime Performing Arts Center; and
WHEREAS,
these
monies are
necessary
to
complete the
refurbishing
of said
facilities,
namely the
air
conditioning
units and panic hardware for exit doors; and
WHEREAS, by companion resolution of the same date the City
Manager is empowered to accept the grant and enter into the
necessary contract and agreements;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The following Special Revenue Fund is hereby
established and resources are hereby appropriated as described
herein:
FUND TITLE: Manuel Artime Development Fund
RESOURCES: Metropolitan Dade County Cultural Affairs
Council Grant for $20,580
APPROPRIATION: Manuel Artime Development Fund $20,580

Section 2. This appropriation is contingent upon funding
allocation from the Metropolitan Dade County Cultural Affairs
Council and the City Manager's acceptance thereof.
Section 3. The City Manager is hereby authorized to accept
the grant as set forth in the Preamble to this Ordinance and to
enter into the necessary contract and/or agreement to accept this
grant.
Section 4. All ordinances or parts of Ordinances insofar
as they are in conflict with the provisions of this Ordinance are
hereby repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases
of goods and supplies, and to generally carry on the functions
and duties of municipal affairs.
Section 7. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by a vote of not less
than four -fifths of the members of the Commission.
Section 8. This Ordinance shall become effective
immediately upon its adoption.

It is respectfully recommended that the City Commission adopt the
attached emergency ordinance and companion resolution accepting a
grant from the Metropolitan Dade County Cultural Affairs Council in
the amount of $20,580 for the improvement project of the Manuel
Artime Performing Arts Center, establishing a new special revenue
fund entitled the Manuel Artime Improvement Fund and authorizing the
City Manager to accept the aforementioned grant award and enter the
necessary contract and/or agreements.
BACKGROUND:
The Department of Community Development has prepared the attached
emergency ordinance and companion resolution to establish a new
special revenue fund, accepting a $20,580 grant from the Metropolitan
Dade County Cultural Affairs Council and empowering the City Manager
to accept said grant and enter into the necessary contract and
agreements. The monies from the grant are needed in order to
refurbish the air conditioning unit and install the panic hardware
exit doors. Both these improvements are essential to start renting
the facility. No cash match is require-d, as all matching has been
effected with in -kind services.

The Capital Development Grants Program Panel of the Cultural Affairs
Council recently convened to deliberate and recommend funding awards
for FY 1989-90. The recommendations were approved by the Cultural
Affairs Council and will be presented to the Board of County Commis-
sioners for final approval.
Your organization has been recommended for a grant,of $_20,580.00__

CONTRACTS
Enclosed is the Grant Agreement Packet for your organization. The
Agreement requires three signatures* of Board Members or authorized
representatives of — Hie— organization, including the President or
Chairman of the Board, the Chief Fiscal Officer and the Project
Director. Each of the seven (7) signature pages enclosed must bear
ol-ia! nal signatures with the Organization's Corporate Seal affixed in
Re aesignatea—space. If the —corporate seal —is unavar�a-bie, please
include seven (7) copies of the Articles of Incorporation.
EXHIBITS_1 AND_2
Please remember to fill out Exhibit 1: Revised Project Description
and Exhibit 2: Revised Project Budget. After these have been filled
out, make seven copies of each and attach to each_completed contract
(seven in total). Please follow Instructiolis on the Ex 5 1 b I ts.
Failure to attach the correct completed revised project description
and budget will result in delayed agreements and checks. Grantees
not awarded the full amount of funding requested must allocate grant
monies toward expenses designated for Capital Development Grants
Program support in the original grant budget.
* Please note: Metro -Dade employees may not sign as repr-jsentatives
of any non -County operated organization awarded County funds.

METRO-DADE DISCLOSURE AFFIDAVIT
A newly adopted Dade County Ord inance"requires that all persons or
agencies entering into contracts with the County complete a DISCLO-
SURE AFFIDAVIT. This Affidavit must be completed, signed, notarized
and returned with the complete Grant Agreement package. On TFe TTrs`tt
line till in your name, item 1 is your organization's name and
address. Item 2 may be answered by simply attaching a copy of your
Board of Directors with their addresses.
ALL CONTRACTS AND ACCOMPANYING MATERIALS MUST BE IN THIS OFFICE NO
LATER THAN OCTOBER 16, 1989. FAILURE TO SUBMIT BY THIS DATE WILL
