ORDINANCE NO. tO GGI.
AN EMERGENCY ORDINANCE AUTHORIZING AN
:INCREASE IN THE NUMBER OF ASSISTANT CITY
ATTORNEYS EMPLOYED IN THE LAW DEPARTMENT FROM
NINETEEN TO TWENTY-ONE SUCH ATTORNEYS, WITH
THE NEED FOR THE ADDITIONAL POSITIONS HAVING
BEEN CREATED AS A RESULT OF INCREASED
ACTIVITY AND LITIGATION IN THE AREAS OF
WORKERS' COMPENSATION, CONSTRUCTION CLAIMS,
LABOR RELATIONS AND CODE ENFORCEMENT; SAID
POSITIONS TO BE FUNDED THROUGH THE MONIES
APPROPRIATED IN THE BUDGETS OF THE DEPARTMENT
OF BUILDING AND ZONING AND THE DEPARTMENT OF
LAW, RESPECTIVELY; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. An increase in the number of Assistant City
Attorneys employed in the Law Department from nineteen to
twenty-one such attorneys is hereby authorized with the need for
the additional positions having been created as a result of
increased activity and litigation in the areas of workers'
compensation, construction claims, labor relations and code
enforcement, said positions to be funded through the monies
appropriated in the budgets of the Department of Building and
Zoning and the Department of Law, respectively.
Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami.
Section 5. The requirement of reading this Ordinance on
two separate days is hereby dispensed with by an affirmative vote
of no less than four -fifths of the members of the Commission.

Section 6. This Ordinance shall become effective
immediately upon adoption.

Pursuant to Section 21 of the City Charter wherein the
number of Assistant City Attorneys must be approved by you, I Am
hereby requesting your approval for two additional Assistant City
Attorney positions increasing thereby the number of Assistant
City Attorneys from 19 to 21. 'these positions are needed to
adequately serve the legal needs of the City in the areas of
workers' compensation, construction claims, labor relations, and
code enforcement.
workers' compensation claims have increased'as a result of
the recent Florida Supreme Court decision which invalidated the
pension offset provision of the City of Miami's Pension Ordinance
which allowed the City to offset an employee's workers'
compensation payments against an employee's pension benefits.
Two major construction litigation claims are- presently being
litigated with the assistance of outs3ide'counsel in the law firms
of Steel, Hector, Davis and Daniels, Mason & Kashtar, P.A..
Because of the highly specialized area of law involved, these
firms have been engaged principally to provide an educational
mode with a view toward developing in-house expertise in
construction law so as to alleviate the need for hiring outside
counsel. In addition, there has been a marked increase in claims
as a result of police officers receiving the benefit of the Heart
Rill which provides that any condition or impairment caused by
tuberculosis, heart disease, or hypertension resulting in total
or ppartial disability or death shall be presumed to have been
accidental and to have been suffered in the line of duty,
Moreover, this office is now handling all labor arbitrations and
participates directly in labor contract negotiatio'n"s- which was
previously handled by outside counsel. Lastly, the City
Commission has expressed its will to double the number of
prosecutions before the Code Enforcement Board and presentation
of cases for prosecution before the Dade County Unsafe Structureq
Board.
