IN CONCLUSIONS OF LAW.
WHEREAS, by letter of June 8, 1984, the Florida Department
of Community Affairs issued a Binding Letter (File BLID-1184-040)
deolaring that the proposed LeJeune Centre Projeot was not a
Development of Regional Impaot,, pursuant to Chapter 380, Fla.
Stats.; and
WHEREAS, by Resolution No. 85-331, Maroh 28, 1985, the City
Commission issued a Major Use Speoial Permit for the LeJeune
Center Projeot (a.k.a. Ooean Bank), looated at approximately 780
Northwest 42nd Avenue, pursuant to Ordinanoe No. 9500, the Zoning
Ordinamoe of the City of Miami, Florida, as amended; and
WHEREAS. Phases 1, 11 and III of the proje0t, the extent of

the said permit have now been ooustruoted; and

Commission issued a Major Use Special -Permit for the LeJeune
Center Project (a.k.a. Ocean Bank), located at approximately 780
Northwest 42nd Avenue, pursuant to Ordinance No. 9500, the Zoning
Ordinance of the City of Miami, Florida, as amended; and
WHEREAS, Phases i, II and III of the projeot, the extent of
the said permit have now been constructed; and
WHEREAS, said Permit provides for 1,122 parking spaces in
Phase II, and the seven level parking garage, as oompleted,-only
accommodates 1,060 parking spaoes due to the oonstruotion demands
of Phase III, and said 1,060 parking spaces are insuffioient t4
service the patrons of the LeJeune Centre Projeot; and

WHEREAS, the Applicant, Ocean Bank, a State of Florida
banking corporation, now desires to provide additional off -site
parking to accommodate the needs of Phases 11 and III (exceeding
by 23 spaces the number of parking spaces specified in the
original Major Use Special Permit) and consequently desires to
amend the previously approved Major Use Special Permit; and
WHEREAS, the proposed amendments to the project,
Incorporating approximately 88 off -site parking spaces, with
required Special Exception by the Zoning Board have been
demonstrated by the Planning Director, as agreed by the Zoning
Administrator, to constitute a substantial change going beyond
the original approval pursuant to Section 3515.1 of Ordinance No.
9500, the Zoning Ordinance of the City of Miami, Florida, as
amended; and
WHEREAS, on August 15, 1989, the Applicant filed an
"Application to Amend the Major Use Special Permit" with the City
of Miami; and
WHEREAS, the Planning Advisory Board, at its. meeting of
October 18, 1989, Item No. 1, following an advertised hearing,
adopted Resolution No. PAB 53-89, by a vote of 8 to 4,
RECOMMENDING APPROVAL of amending the previously approved Major
Use Special Permit; and
WHEREAS, the City Commission held an advertised public
hearing to consider the application for amendment of the original
Major use Special Permit as a substantial change pursuant to
section 3818.1 of the Zoning Ordinance of the City of Miami,
Florida, as amended; and
WHEREAS, the City Commission:deems;.It:atvisable and in the
best interests of-. the oitizens of the City . of Miami to .issue the
above mentioned ,amended Major Use . fipeo sl , P,e mit as : hereinafter
set forth;
NUW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THS CITY

Seotion 1. An Amendment to a previously approved Major Use
Special permit, (Resolution 88-331; March 28, 1988) (attached),
is hereby approved with oonditions for the LeJeune Centre Project
(a.k.a. ocean Bank) located at 780 Northwest LeJeune Road, as
proposed by Ocean Bank, principally to incorporate off -site
parking located at 4262 Northwest 7th Street and 4251 Northwest
6th Street, Miami, Florida, described more particularly as Lots
3, 12 and 13, Block 1, GOLF COURSE PARK, according to the Plat
thereof, recorded in Plat Book 43, at Page 3, of the Public
Records of Dade County, Florida.
Section 2. Section 1 of Resolution No. 88-331 is hereby
amended in the following respects:I/

hereto as Exhibit "A" and made a part hereof by reference,
is hereby approved for proposed Phases II and III and off -
mite parking on lots 3 12 and 13. Block 1. Golf Course

_ Records of Dade County. F oida. of the subject LeJeune
Centre Project (hereinafter referred to as "PROJECT") to be

LeJeune Centre Subdivision, as recorded in Plat Book 120 at
page 81 of the Public Records of Dade County, Florida.
Section 3. The Major Use Special Permit marked as -Exhibit
"A" and attached to Resolution No. 88-331 is hereby amended in
the following respects:

Let it be known that the Commission of the City of
Miami, Florida has considered in public hearing on
January 24, 1988; the issuance of a Major Use Special
Permit and on November 16, 1989, an amendment to the
Major Use Stieoiai Permit: DetailedRequirements of
Zoning Ordinance 9800, said development to be Located
in the City of Miami, at approximately 780 North
LeJeune Road, 4282 Northwest Tth Street and 4281
Northwest 6th Street, Miami, Florida, being

Section 2. The subject Major Use Special Permit, as
