F A RESOLUTION REVERSING THE DECISION OF THE ► ZONING BOARD AND GRANTING A SPECIAL EXCEPTION FROM ORDINANCE 9500, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, ARTICLE 20, SECTION 2018, SUBSECTION 2018.2.1, TO ALLOW THE CONSTRUCTION OF A SURFACE PARKING LOT FOR THE PARKING OF PRIVATE PASSENGER VEHICLES ONLY, SUBJECT TO CERTAIN CONDITIONS, FOR THE PROPERTY LOCATED AT 4251 AND 4253 NORTHWEST 6 STREET (MORE PARTICULARLY DESCRIBED HEREIN), AS PER PLANS ON FILE, IN CONJUNCTION WITH THE OCEAN BANK COMPLEX LOCATED AT 780 NORTHWEST 42 AVENUE, MIAMI, FLORIDA: ZONED RG-1/3 GENERAL # RESIDENTIAL (ONE AND TWO FAMILY) SUBJECT TO CONDITIONS. WHEREAS, the Miami Zoning Board at its meeting of October 16, 1989, Item No. 3, following an advertised hearing, adopted Resolution ZB 112-89 by a five to four vote (5 -4), denying the Special Exception from Ordinance No. 9500, as amended, the Zoning Ordinance of the City of Miami, Florida, Article 20, Section 2018, Subsection 2018.2.1, to allow the construction of a surface parking lot for the parking of private passenger vehicles only, for the property located at 4251 and 4253 Northwest 6 Street, more particularly described as Lots 12 and 13, Block 1, GOLF COURSE PARK, as recorded in Plat Book. 43, at Page 3, of the Public Records of Dade County, Florida, as per plans on file, in conjunction with the Ocean Bank Complex located. at 780 Northwest 42 Avenue, Miami, Florida; zoned RG-1/3 General Residential (one and two family); and WHEREAS, the applicant has taken an appeal to -the City Commission from the denial of the Special Exception and it WHERBASO the City Commission, after careful consideration of d«' this matter, finds that the application for a Special: ftception meets the applicable requirements of Zoning Ordinance No 9500;;';. r x` c E� NOW, THEREFORE, BE IT RESOLVED B? THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The decision of the Zoning Board in denying the Special Exception from ordinance No. 9500, as amended, the zoning Ordinance of the City of Miami, Florida, Article 20, Section 2018, Subsection 2018.2.1, to allow the construction of a surface parking lot for the parking of private passenger vehicles only, more particularly described as Lots 12 and 13, Block 1, GOLF COURSE PARK, as recorded in Plat Book 43, at Page 3, of the Public Records of Dade County, Florida, as per plans on file, in conjunction with the Ocean Bank complex located at 780 Northwest 42 Avenue, Miami, Florida; zoned RG-1/3 General Residential (one and two family), is reversed and the special exception is hereby granted subject to the following conditions: 1. A building permit must be obtained within twelve months of this date; 2. Parking is restricted to employees of the principal site by key card; not to be used by customers; 3. Ingress and egress is only to/from Northwest 7 Street. 4. A landscape plan shall be prepared for the approval of the Planning Department; fencing or wall materials such as concrete louvers, chain link or wrought iron or their combinations shall be acceptable but solid walls are not permitted; 5. A review by the Zoning Board and City Commission two years from the date of issuance of a certificate of occupancy. 6. A fifteen foot setback from the zoned street line of Northwest 6 Street; east, west and north setbacks are governed by - the zoning district regulations; s Y� = `� - 7. Parking spaces shall be arranged so that vehicles head in to the east and west property lines so that vehicles exhaust fumes do not flow into the adjacent residential areas; and-° - 8.
