A RESOLUTION BY AN AFFIRMATIVE VOTE OF 4/5THS VOTE OF THE MEMBERS OF THE CITY COMMISSION WAIVING FORMAL COMPETITIVE SEALED BID PROCEDURES FOR THE REQUIRED SERVICES, EQUIPMENT, GOODS AND/OR MATERIALS FOR THE GENERAL ANTONIO MACEO PARK DEVELOPMENT PROJECT - PHASE 1; RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S FINDING THAT A VALID PUBLIC EMERGENCY EXISTS JUSTIFYING SUCH WAIVER FOR SAID PROJECT; AUTHORIZING THE CITY MANAGER TO ACCEPT THE LOWEST RESPONSIVE AND RESPONSIBLE BID(S) FOR NECESSARY IMPROVEMENTS, SERVICES, EQUIPMENT, GOODS AND/OR MATERIALS FOR SAID PROJECT; ALLOCATING FUNDS THEREFOR IN AN AMOUNT NOT TO EXCEED $215,000 FROM THE CAPITAL IMPROVEMENT PROJECT OF THE SAME NAME, PROJECT NO. 331354; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE _ AND/OR ISSUE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH THE SUCCESSFUL BIDDER(S). WHEREAS, the City Manager has made a written finding that the preliminary development (Phase 1) of General Antonio Maceo Park constitutes a valid public emergency which requires the immediate procurement of the required services, material, goods and/or equipment to protect the health, safety and welfare of residents and for the convenience of the City; and WHEREAS, the nature of said valid public emergency is based on the community's need for waterfront recreational facilities and upon State and Federal requirements that the presently undeveloped Park be opened to the public no later than August 1, 1990; and WHEREAS, plans and specifications for Phase 1 of the Project will be prepared by professional staff of the Public Works Department with assistance from the General Antonio Maceo Foundation and input from the community; and WHEREAS, Phase 1 of the project will stabilisation, a boat ramp, finger (picnic tables, barbeque grills and security lighting; and include shoreline piers, site furnishings benches), parking, and 1#" 4% r WHEREAS, said August 1990 deadline does not allow sufficient time for the formal advertising, receipt of bids, and award of contracts which are normally required procedures; and WHEREAS, the City Code provides for the emergency procurement of required goods and services in connection with public works and improvements; and WHEREAS, the City Manager and Director of the Department of Parks, Recreation and Public Facilities recommend that informal bid procedures be utilized to procure the needed services, equipment goods and/or materials for said project; and WHEREAS, after receipt of informal bids, contracts for said services, equipment, goods and/or materials will be awarded to the lowest responsive and responsible bidder(s) by the City Manager; and WHEREAS, Ordinance No. 10f:71 adopted November 30', 1989, established the General Antonio Maceo Park Development Project (No. 331354) within the City Capital Improvement Program and appropriated $470,000 for said Project, of which $215,000 will be utilized for Phase 1; and WHEREAS, the herein resolution has been the subject of a properly advertised public hearing before the City Commission; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the = Preamble -to this Resolution are hereby incorporated by reference thereto.and adopted as if fully set forth in this Section. - Section 2. The City Manager's finding that a valid public = —. emergency exists justifying the waiver of formal competitive sealedbid'` procedures for the General Antonio Mateo -'Park Project - Phase l is hereby ratified, approved and confirmed. ;a pection 3. The City Manager is hereby authorized to accept the lowest responsive and responsible bid(s) for the necessary services, equipment, goods and/or materials for said Project, with funds therefor hereby allocated in an amount not to exceed $215,000 from the General Antonio Maceo Park Project, CIP Project #331354. Section 5. The City Manager is hereby authorized to execute and/or issue the necessary documents, in a form acceptable to the City Attorney, with the successful bidder(s) for said items for - said Project. With additonal funds from a FY'90 State Line Appropriation Grant, a $215,000 Phase' 1 'Project has been devised to include shoreline stabilization, a boat ramp and fishing piers, parking improvements,security lighting` and site furnishings (picnic tables; barbeque_ grills and benches). This memorandum serves as the written finding of a valid public emergency for the General Antonio Macao Park Development Project - Phase 1. This finding is based upon the followings * The presently undeveloped Macao Park, located on the inland- waterway';known as Blue Lagoon, is a. vital recreational — `resource that ' the City acquired with State • and Federal „K assistance for the benefit of its citizens and vistors. * Because the park has not been developed in a timely manner, ' said State and Federal agencies have begun proceedings whichf - -w3ll. require. the City to purchase an additional parcel of 1'arid of equal size, recreational value and cost in the local 4 ;j area. * Said -penalty would impose a significant hardship on the City, ; deleterious to the health, safety and welfare'of its citizs46z and to the convenience of municipal affairs.
