A RESOLUTION CONCERNING THE IV ALLAPATTAH FAIR
TO BE CONDUCTED BY THE ALLAPATTAH BUSINESS
DEVELOPMENT AUTHORITY, INC., ON DECEMBER 7-
10, 1989 PROVIDING FOR THE CLOSURE OF
DESIGNATED STREETS TO THROUGH VEHICULAR
TRAFFIC AND ESTABLISHING A PEDESTRIAN MALL
SUBJECT TO THE ISSUANCE OF PERMITS BY THE
DEPARTMENTS OF POLICE AND FIRE, RESCUE AND
INSPECTION SERVICES; FURTHER ESTABLISHING AN
AREA PROHIBITED TO RETAIL PEDDLERS DURING THE
PERIOD OF THE EVENT; CONDITIONED UPON THE
ORGANIZERS PAYING FOR ANY COSTS OF CITY
SERVICES BEYOND THE FUNDING PROVIDED BY THE
CITY AND THE REQUIREMENT THAT THE CITY WILL BE
INSURED AGAINST ANY POTENTIAL LIABILITY.
WHEREAS, the Allapattah Business Development Authority, Inc.
will conduct the IV Allapattah Fair on December 7-10, 1989, at
Curtis Parr and vicinity; and
WHEREAS, the City's FY-89-90 budget provides $50,000 to the
aforementioned organization to cover the cost of City services
for this event; and
WHEREAS, certain streets shall be closed to vehicular
traffic during specified dates and hours to insure the safety of
the participants and pedestrians attending this event; and
WHEREAS, said organization has requested that retail
peddlers be prohibited in the area;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY

OF MIAMI, FLORIDA:

Section I. in order to effectuate safe passage and

establish a temporary pedestrian mall during the IV Allapattah
Fair, the following streets are hereby closed to through

vehicular traffic from 11:00 A.M. to 12 Midnight on Saturday,
tcember 9, 1989 and Sunday, December 10, 1989, as specified
belowi
Northwest Twenty-third Avenue (Park Road) from Northwest
North River Drive to Northwest Twentieth Street.
Northwest North River Drive from Twenty, -third Court to
Northwest Twenty-fourth Avenue.
included in the herein closure are all streets, avenues,
alleys, ways and thoroughfares which intersect the
enumerated areas delineated in this Section.
Section 2. Such closing of streets is subject to State
approval and issuance of permits by the Departments of Police and
Fire,` Rescue and Inspection Services. Said permit from the

Department of Police is to be issued upon the full approval of

the Chief of Police after giving all due consideration to the
safety and traffic needs of residents, businesses, and religious
institutions in the area for entering and crossing through said

arterials and upon the favorable exercise of the City Manager's
judgement predicated upon all factors set forth herein.
Section 3. Pursuant to the provision of City Code Section
39-13, all retail peddlers' occupational licenses issued under
the provisions of Chapter 31 of the City Code, as amended, will
not be valid on Saturday, December 9 and Sunday, December 10,
1989, during the hours of 11:00 A.M. to 12 Midnight on the above
designated streets and on all intersecting streets for two blocks
in all directions.
Section 4. Such authorizations are hereby conditioned
upon the organizers paying for any costs of City services beyond
the funding provided by the City and obtaining insurance
requirements as mandated by the City of Miami.
