J-89-1073 11/1/89 RESOLUTION NO. .045 A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO PAY HEVERLY PARKER, ESQUIRE, OF THE FIRM OF GREENE AND GREENE, P.A., AND PETER J. HURTGEN, ESQUIRE, OF THE FIRM OF MORGAN LEWIS AND SOCKIUS, AT AN HOURLY RATE OF $150,00 EACH, AN AMOUNT NOT TO EXCEED $25,000.00 EACH FOR SERVICES RENDERED IN THE LEGAL REPRESENTATION OF KENNETH C. MC CULLOUGH AND COLONEL H. DUKE RESPECTIVELY IN BOYKIN, ET AL. V. CITY OF MIAMI, ET AL., WITH FUNDS FOR SUCH PAYMENT BEING ALLOCATED FROM THE SELP- INSURANCE AND INSURANCE TRUST FUND. WHEREAS, because of possible conflicts of interest, Beverly Parker, Esq. of the law firm of Greene & Greene, P.A. and Peter J. Hurtgen of the law firm of Morgan, Lewis and Bockius have been engaged for the legal representation of former City of Miami Fire Chief Kenneth C. Mc Cullough and present City of Miami Fire Chief Colonel H. Duke respectively in the United States District Court case of Benjamin J. Boykin, et al. v. City of Miami, et al., Case No.: 88-2033-Civ-KEHOE in which Kenneth C. Mc Cullough and Colonel H. Duke are named as defendants; and WHEREAS,, the City Attorney has estimated that, at the agreed upon rateof $150.00 per hour, the maximum billing to be submitted by Beverly Parker, Esq. and Peter J. Hurtgen, Esq. will not exceed.$25,000.00 each; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Attorney is hereby authorized to pay Beverly Parker, Esq., of the firm of Greene and Greene, P.A. and Peter J. Hurtgen, Esq., of the firm of Morgan Lewis and Bockius_ at an hourly rate of $150.00 each, an amount not to exceed $25,000.00 each for services rendered in the legal representation of Kenneth C.
