deems it advisable and in the best interest of the general welfare of the City
of Miami and its inhabitants to amend the Code of the City of Miami., Florida,
as amended, as hereinafter set forth;

Section 1. Sections 35-1 and 35-11 of the Code of the City of Miami,
Florida, as amended, are hereby amended in the following particulars:.1/
"Sec. 35-1 Definitions.
The following words and phrases, when used in this chapter,
shall for the purpose of this chapter, have the meanings
respectively ascribed to them in this section, except where the
context clearly indicates a different meaning:

Bus: Every public motor vehicle designed for carrying more
than seven t m (T IQ) passengers and used for the transportation
of persons, and every motor vehicle, other than a taxicab,
designed and used for the transportation of persons for
compensation.
Words and/or figures stricken through shall be deleted.
Underscored words and/or figures shall be added. The
remaining provisions are now in effect and remain
unchanged. Asterisks indicate omitted and unchanged
material.

"Sec. 35-11. Parking for oertain purposes prohibited.
-Cal No person shall park a vehicle upon any street or within the
public r gU-of-wav for the principal purpose of:

(1) Displaying such vehicle for sale.
(2) Washing, greasing or repairing such vehicle, except
repairs necessitated by an emergency.
(3) Displaying advertising.
(4) Selling merchandise from such vehicle, except in a
duly established marketplace, or when so authorized or
licensed under this Code or other ord:xanoes of the
city.
(5) Storage, or as junkage or dead storage for more than
twenty -hours.

(f) The enforcement of this section may be initiated by city
personnel .listed in City Code section 2-393 in accordance
with the procedure set Eorth in the City Code section 2-

Section 2. All ordinances or parts of ordinances insofar as they are
inconsistent or in conflict with the provisions of this Ordinance are hereby
repealed.
Section 3. if any part of section, paragraph, clause, phrase or work of.
this Ordinance is declared invalid, the remaining provisions of this Ordinance
shall not be affected.
Section 4. This Ordinance shall become effective February 1, 1990.

first reading concerning the enforcement of this Ordinance by
police officers, we have now included paragraph (f) on page 3 for
consideration at second reading. By the inclusion of paragraph
(f), the Ordinance can be enforced by police officers and code
enforcement inspectors. The cases enforced by the code
enforcement officers can be brought before the City of Miami Code

It is respectfully requested that the Commission adopt the attached ordinance
amending Chapter 35 of the City Code to prohibit persons from parking
commercial vehicles, trucks, buses., trailers and semitrailers, construction
equipment, major recreational vehicles and similar vehicles, within the public
rights -of -way of residentially -zoned districts.
The Miami Roads Neighborhood Civic Association has complained to the Manager's
Office that there is no legislation to prohibit buses from parking on
residential streets.
By Dade County Code, trucks are prohibited from parking on streets in
residential districts as follows:
"Sec. 30-388.31. Trucks; parking prohibited in residential zones.
In areas zoned residential districts, it shall be unlawful for a
truck of one -ton capacity or over to be parked for more than one
(1) hour, unless engaged in the loading or unloading of
materials.
The City's Zoning Ordinance 9500 prohibits certain vehicles from parking on
private property in residential districts as follows:
"2020.2. Major recreation equipment parking, storage and
occupancy, limitations and exceptions.
2020.2.1. Major recreation equipment defined. For purposes
of these regulations, major recreational equipment is

converted trucks or buses, motorized homes, tent
campers, tents, or other short term housing or shelter
arrangements and devices, boats and boat trailers,
combinations thereof, and other similar equipment,
whether occupied by such equipment or not.
2020.2.2. Parking or storage of major recreational equipment
as accessory use in residential districts. Parking or
storage of major recreational equipment shall be
permitted as an accessory use in residential districts
only in accordance with the following limitations:
(a) Such equipment shall be parked or stored behind
the nearest portion of any building to the
street, provided that parking shall be permitted
anywhere on the premises or on adjacent streets
or alleys (if otherwise lawful) for not to exceed
twelve (12) hours during loading and
unloading; ..."

112020.3. Parking or storage of specified trucks, buses, trailers
or semitrailers prohibited as accessory use in
residential districts, or in parking facilities in
transitional areas of residential districts.
Parking or storage of commercial trucks, buses, or vans;
trailers or semitrailers for freight, luggage or the like; or sign
trailers shall not be permitted as an accessory use in any
residential district, or in any parking facilities authorized in
transitional areas of any residential district."
2020.4. Parking or storage of construction equipment prohibited
in residential districts.
Except in conjunction with authorized active continuing
construction on the premises, construction equipment such as earth
moving machines, excavators, cranes and the like shall not be
parked or stored in any residential district."

This proposed legislation repeats in Chapter 35 certain parking provisions
that are now contained in the County Code and Zoning Ordinance 9500 in order
to address two kinds of concerns expressed: territorial and jurisdictional.
The territorial concern is that the zoning ordinance prohibitions
conventionally cover public and private property; and seldom and only
incidentally cover public rights -of -way, which the City of Miami holds in
trust for the public through dedication with reversionary provisions if
unused, in contrast to fee simple ownership. Regulation of public rights -of -
way have been usually addressed by Code provisions for traffic control -
Chapter 35 - and construction standards - Chapter 54.
The jurisdictional concern follows from the territorial concern. The
Department of Building and Zoning enforces the Zoning Ordinance (and other
codes) within public and private property and hardly ever enforces provisions
in public rights -of -way. On the other hand the Police Department enforces
traffic control measures in the public right-of-way and the Department of
Public Works enforces construction standards in the public right-of-way.
Therefore, prohibitions against parking commercial vehicles should be
addressed in Chapter 35 - Motor Vehicles and Traffic of the City Code.
This proposed legislation would prohibit parking:
- commercial vehicles, trucks of one ton capacity or more, buses, etc.;
- construction equipment (except for authorized construction); and
- major recreation equipment e.g., travel trailers, pickup campers, etc.,
in the public rights -of -way of residentially -zoned districts. (see
attachments).

FUND-1990" IN THE AMOUNT OF $6,000 FOR THE PURPOSE
OF EXPENDING M0141ES TO DEFRAY EXPENSES INCURRED IN
CONNECTION WITH THE PARADE TO BE CONDUCTED IN THE
CITY OF MIAMI DURING THE MONTH OF JANUARY, 1990 IN
OBSERVANCE OF THE BIRTHDAY OF THE LATE DR. MARTIN
LUTHER KING, JR., REVENUE IN A LIKE AMOUNT BEING AVAILA-
BLE FROM PRIVATE SECTOR DONATIONS; -FURTHER PROVID-
ING THAT ANY SURPLUS OF FUNDS REMAINING AFTER THE
PAYMENT OF EXPENSES INCURRED AS A RESULT OF STAG-
ING THE 1990 PARADE SHALL BE MADE AVAILABLE FOR USE
IN CONNECTION WITH THE CITY'S ONGOING FUNDING PRO-
GRAM FOR COMMUNITY CULTURAL EVENTS AS ESTABLISHED
BY ORDINANCE NO. 10206; CONTAINING A REPEALER PROVI-
SION AND SEVERABILITY CLAUSE.
Said ordinances may be Inspected by the public at the Office of the
City Clerk, 3500 Pan American Drive, Miami, Florida, Monday through
Friday, excluding holidays, between the hours of 8:00 a.m, and 5:00 p.m.
