HomeMy WebLinkAboutR-89-1107J-89-1116 11/30/89 RESOLUTION NO. 89-1107 A RESOLUTION CONCERNING: THE 1990 CARNAVAL MIAMI PASEO TO TAKE PLACE MARCH 4, 1990; THE 8K RUN ON MARCH 10, 1990: THE BIKE DASH ON MARCH 10, 1990; CARNAVAL MIAMI INTERNACINAL AT BAYFRONT PARK ON MARCH 10, 1990; AND CALLE OCHO OPEN HOUSE FESTIVAL ON MARCH 11, 1990 TO BE CONDUCTED BY THE KIWANIS CLUB OF LITTLE HAVANA, PROVIDING FOR THE CLOSURE OF DESIGNATED STREETS TO THROUGH VEHICULAR TRAFFIC; ESTABLISHING A PEDESTRIAN MALL SUBJECT TO THE ISSUANCE OF PERMITS BY THE DEPARTMENTS OF POLICE AND FIRE, RESCUE AND INSPECTION SERVICES; ESTABLISHING AN AREA PROHIBITED TO RETAIL PEDDLERS DURING THE PERIOD OF THE EVENTS; AUTHORIZING THE SALE OF BEER AND WINE IN CONNECTION WITH SAID EVENTS SUBJECT TO THE ISSUANCE OF ALL PERMITS REQUIRED BY LAW; FURTHER RELAXING THE TIME LIMITATIONS ON THE DISPLAY OF FIREWORKS TO ALLOW THE STAGING OF PYROTECHNIC DISPLAYS UNTIL 12:00 MIDNIGHT ON MARCH 3, 1990, AT THE ORANGE BOWL FOR CARNAVAL NIGHT, ON MARCH 10, 1990 IN THE VIZCAYA AREA IN CONNECTION WITH A SPONSORS PARTY AND ON MARCH 10, 1990 AT BAYFRONT PARK IN CONNECTION WITH CARNAVAL MIAMI INTERNATIONAL SUBJECT TO ISSUANCE OF APPROPRIATE PERMITS; CONDITIONED UPON THE REQUIREMENT THAT THE CITY WILL BE INSURED AGAINST ANY POTENTIAL LIABILITY AND UPON ORGANIZERS PAYING FOR ALL NECESSARY COSTS OF CITY SERVICES ASSOCIATED WITH SAID EVENTS. WHEREAS, the Kiwanis Club of Little Havana plans to conduct certain events during the period of March 3-11, 1990, in connection with the celebration of Carnaval Miami 190; and WHEREAS, on June 7, 1989, by Motion No. 89-564, the City Commission expressed its intent to grant the request received from the Kiwanis Club of Little Havana for street closures, authorization for the sale of beer and wine, the designation of areas prohibited to retail peddlers and extension of the fireworks deadline in connection with said events; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. In the interest of safety and in order to establish a temporary pedestrian mall during Carnaval Miami Paseo Amended By CUT COM SSION MEETING OF DEC 7 t9s9 f=' on March 4, 1990: during Calle Ocho 8K Run on March 10, 1990, Carnaval Miami Bike Dash on March 10, 1990 and Calle Ocho Open House Festival on March 11, 1990, the following streets are hereby closed to through vehicular traffic during the dates and hours specified below: CARNAVAL PASEO Sunday, March 4, 1990 from 10:00 A.M. to 10:00 P.M.: West Flagler Street from Twelfth Avenue to Twenty-second Avenue. Southwest First Street from Southwest Twelfth Avenue to Southwest Twenty-second Avenue. BIKE RACE Saturday, March 10, 1990 from 8:00 A.M. to 6:00 P.M.: Closure of Biscayne Boulevard (eastern most lane) Northbound from Northeast First Street to Northeast Third Street. 8K-RUN Saturday, March 10, 1990 from 8:00 A.M. to 6:00 P.M.: Biscayne Boulevard (western most lane) from Northwest Third Street to Southeast Second Street. Southeast Second Street from Biscayne Boulevard to Southeast Second Avenue. Southeast Second Avenue from Southeast Second Street to Brickell Avenue Bridge. Brickell Avenue from Southeast Fifth Street to Southeast Eighth Street. Southeast Eight Street to Southwest Thirteenth Avenue. Southwest Thirteenth Avenue from Southwest Eighth Street to West Flagler Street. (close two lanes of Flagler Street) Flagler Street from Southwest Thirteenth Avenue to Southwest Sixth Avenue. Flagler Street from Southwest Sixth Avenue to Biscayne Boulevard. CALLE OCHO OPEN HOUSE FESTIVAL Friday, March 9, 1990 from 10:00 A.M. to Monday, March 120 1990 Noon: Southwest Tenth Street Road from Southwest Eighth Street to Southwest Ninth Street. Southwest Twenty-third Avenue from Southwest Seventh Street to Southwest Eighth Street. - 2- Sunday, March 11, 1990, 2:00 A.M. to 12 Midnight: Southwest Eighth Street from Southwest Fourth Avenue to Southwest Seventh Avenue. Southwest Seventh Street from Southwest Fifth Avenue to Beacom Boulevard. Beacom Boulevard from Southwest Eighth Street to Southwest Seventh Street. Included in the herein closure are all streets, avenues, alleys, ways and thoroughfares which intersect the enumerated areas delineated in this Section. Section 2. Such closing of streets is subject to State approval and issuance of permits by the Departments of Police and Fire, Rescue and Inspection Services. Said permit from the Department of Police is to be issued upon the full approval of the Chief of Police after giving all due consideration to the safety and traffic needs of residents, businesses, and religious institutions in the area for entering and crossing through said arterials and upon the favorable exercise of the City Manager's judgement predicated upon all factors set forth herein. Section 3. Pursuant to the provision of City Code Section 39-13, all retail peddlers' occupational licenses issued under the provisions of Chapter 31 of the City Code, as amended, will not be applicable or valid in the area of public right of way included on the above designated streets and on all intersecting streets for two blocks in all directions, during the dates and hours of said events and including Carnaval Miami Internacional at Bayfront Park on March 10, 1990 as specified in Section 1. Section 4. Upon the issuance of a temporary permit by the Florida Department of Business Regulation, Division of Alcoholic Beverages and Tobacco, to sell beer and wine pursuant to City Code 54-12.1, the request of the Kiwanis Club of Little Havana to sell beer and wine in soft containers for four (4) one -day periods in connection with Carnaval Miami Paseo scheduled for March 4, 1990, Miami Carnaval Internacional at Bayfront Park on March 10, 1990 and Calle Ocho Open House Festival scheduled for March 10-11, 1990, is hereby granted, subject to the issuance of Section 5. The time limitations on the display of fireworks is hereby relaxed to allow the staging of pyrotechnic displays until 12 Midnight: on Saturday, March 3, 1990, at the Orange Bowl for Carnaval Night, and on Saturday, March 10, 1990 in the Vizcaya area in connection with a sponsors party and on Saturday, March 10, 1990 at Bayfront Park in Connection with Carnaval Miami Internacional, subject to the issuance of appropriate permits from the Department of Eire, Rescue and Inspection Services. Section 6. Such authorizations are hereby conditioned upon the organizers obtaining insurance requirements as mandated by the City of Miami and paying for all necessary costs of City services. Odio City Manager RECOMMENDATION: DATE : N Ov Z 7 1989 FILE SUBJECT :Formalizing Resolution Concerning Carnaval Miami '90 REFERENCES: Commission Agenda.1tem ENCLOSURilecember 7, 1989 It is respectfully recommended that the City Commission adopt the attached resolution formalizing Motion 89-564 of June 7, 1989 authorizing street closures, establishing a pedestrian mall, authorizing thi sale of beer and wine, prohibiting non -festival retail peddlers in the area and extending the fireworks deadline in connection with 1990 Carnaval Miami festivities. The street closures for these events are subject to the issuance of permits by the Departments of Police and Fire, Rescue and Inspection Services and conditioned upon the organizers paying for the cost of City services. BACKGROUND: The Department of Community Development has prepared the appropriate legislation for the above mentioned authorizations in connection with the 1990 Carnaval Miami festivities to be conducted by the Kiwanis Club of Little Havana. Carnaval Miami will be held March 3-11, 1990. Attachment: (1) Proposed Resolution H pI e�- e#37-4 ..
