The development, oonsisting of two nearly equal size paroels totaling 7.29 net &ores, spans both sides of Briokell Avenue oreating an arohiteotural "Gateway" into Downtown Miami from the South. The east paroel, looated between S.B. 14th mane and 14th Terraoe will oontain approximately 1,503,000 gross square feet of offioe, retail and -residential uses. Phase I of the Projeot is - proposed to oonsist of approximately: Element Area tG.S.F.) The oomprehensive plan future land use designation for both the east and west paroele is offioe vhioh allows the proposed retail, residential, offioe and hotel mixed --use. The Projeot also refleots suggestions reoeived at the Miami Large Soale Development oommittee meeting of January 20, 1969. The Projeot will be oonstruoted substantially in a000rdanoe with plane and design sohematios on file prepared by Hellmuth, Obata V Kassabaum, Ino., dated August 18, 1989. (See Exhibit 6.3, Site Plan and Exhibit A.25, Building Elevation, attaohed.) The Projeot will be oonstruoted in two phases. Phase I, of the Projeot, will inolude approximately 1,467,341 gross square feet of offioe and retail spaos, as well as surfaoe and elevated parking for approximately 2,622 to 3,232 automobiles. Phase II, the west paroel, not under oonsideration at this time, is planned for offioe, retail, residential and other support funotions and is proposed by the applioant to be part of a future amendment to this Major Use Speoial Permit. A street level publio plaza is proposed, as well as a pedestrian oonneotion to the proposed Briokell Metromover Station by means of an elevated pedestrian walkway over Briokell Avenue to the north portion of this east paroel. The last proposal remains to be evaluated from the standpoint of pedestrian oonvenienoe, funotional integration_ and urban design. The Projeot, as defined immediately above, meets the requirements for the issuanoe of a Development Order pertaining to,.a Development of Regional Impaot, as required under Seotion 080.06 Florida Statutes, eaoept that it is enoompasaed by the Master and Inorement I Development Orders of the Downtown Miami Development of Regional Impaot; this Major Use Speoial Permit is appropriate instrument. Designate gratis spaoe in design plans of the roof for a oommunioations antenna and supporting struoture for the City,s emergenoy and general government oommunioations system, inoluding suffioient spaoe near/under the roof for necessary support equipment. The applioant and City must mutually agree to the looation, number and size of any suoh equipment, installation or space designation. suoh aerials, antennas and appurtenanoes will be installed and maintained at the expense of the City of Miami. The applioant will retain the right of arohiteotural review and approval, whioh shall not be unreasonably withheld. Section 2036.4 of Ordinance No. 9500, requires outdoor play area of a minimum size of 500 square feet or 45 square feet per child, whichever Is greater and the National Fire Protection Association (N.F.P.A.) 101 Life Safety Code requires a minimum of thirty-five (35) square feet per child of indoor floor area; design plans for the day care facility shall be revised to a000mmodate these minimum requirements. Within twenty-four (24) months from approval of a certificate of 000upanoy or when the building is 50% 000upied, whichever comes first, ensure that a day care center is open during normal work week hours and continuously operating with a minimum capacity for one hundred (100)°children, unless the Planning Advisory -Board relieves the Applicant of all or part of such requirements upon a shoving that there is insufficient demand to justify the operation of such day care facility. e. Within six (6) months from the issuanoe of the Major Use Speoial Permit, provtas a ievicer indicating 000rdination with members of the Fire Plan Review Seotion to disouss the soope of the Projeot, owner responsibility, building development prooess and review prooedures, as well as speoifio requirements for fire protection and life safety systems, exiting, vehicular aooess and water supply. 6. Within six (6) months from the issuanoe of the Major use Speoial Permit, provide a letter assuring k that Briokell Gateway has addressed all oonoerns of the Solid Waste Department. 9. Prior to issuanoe of a building permit. implement the design whioh has been mutually agreed upon by j the City for the ground level public plaza im substantial a000rd with the Exhibit S-a, previously attached. lS+ 1< # k i 10. Prior to issuanoe of a oertifioate Of Oooupanoy for Phase 1, Briokell Gateway, with the agreement and oonourrenoe of the City, agrees to oonstruot to City speoifioations or to fund $106,200 for various 1 street improvement projeots in the immediate geographic vioinity of Phase 1, as shown in Exhibits 11, 12, and 13 of the X&Jor USO Special Permit Applioation (attaohed hereto). The street improvement projeots inolude: (a) the signals%ation and addition of a west bound, left turning lane and inorease in the south bound, left turn storage at Briokell Avenue and S.B. 14th Terraoe (Exhibit 12); and (b) the addition of a west bound, left turning lane and oonstruotion of a south bound, left i± turning lane at Briokell Avenue and S.S. 14th bane f (Exhibit 13). Briokell Gateway shall not be { required to pay for acquisition of any additional rights -of -way. Briokell Gateway shall furnish to the Planning Department evidenoe of suoh ij oonstruotion, $108,200 payment or funding; for any defioienoy, Briokell Gateway shall pay to the City on the date of the oertifioate of ocoupanoy for i Phase I the variance of suoh construoted or fundod amount from $108,200. Suoh publio improvements do not inolude, however, improvements required by the :l platting prooess, improvements required by paragraphs 2 hereof or damage to existing publio improvements oaused by the negligenoe of Briokell s' Gateway, its agents, employees or oontraotors. Allow :.the applicant the option of developing,,'hbac+� ° II° pursuant to the development regulationg:.and � r+ coning node in effect at the time of the passage of this Development Order only if Phase It in undertaken as an amendment to this Development Order. If the City requires a new Major Use Speoial Permit for Phase 11, that Major Use Speoial Permit Development Order shall be subjeot to the development regulations and zoning oode in effeot at the time of its adoption. In any event, it is further understood that an amendment (or new application) of the order of magnitude now antloipated will require substantial supporting information and analyses. 12. Meet all City of Miami obligations pursuant to the Downtown Development of Regional Impaot Development Order (City of Miami Resolutions 87-1148, 87-1149, State of Florida Administrative Hearing Settlement Case Number 88-1608, and City of Miami Ordinanoes 10461 and 10545), all applioable building oodes, land development regulations, ordinanoes and other laws, and in addition, 13. Establish the effeotive date of the. On the northern corner, the office tower rises to a height of 48 stories; at the southern corner the residential tower rises to a height of 40 stories., There are appropriate setbacks on Brickell Avenue. Brickell Gateway is included in incremento I of Tonal` ANALYSIS the Downtown Miami Development 9 = Impact Development Order. There are two questions to consider about the market for this project. The retail portion of this development, will include a 100,000 g.s.f'. department store to be supported by a market area extending to a 4 mile radius as far west as Red Road.
