RESOLUTION NO. -
A RESOLUTION PROHIBITING THE SALE OF
ALCOHOLIC BEVERAGES IN THE ORANGE BOWL
STADIUM DURING THE 1990 ORANGE BOWL CLASSIC
FOOTBALL GAME ON JANUARY 1, 1990 PURSUANT TO
THE REQUEST OF THE ORANGE BOWL COMMITTEE,
INC.; APPROVING AND ACCEPTING CONSIDERATION
OFFERED BY THE ORANGE BOWL COMMITTEE TO THE
CITY IN THE AMOUNT OF $31,450 AND TO VOLUME
SERVICES, INC. IN THE SAME AMOUNT AS
COMPENSATION FOR REVENUES THE CITY AND VOLUME
SERVICES, INC. WOULD NORMALLY HAVE RECEIVED
FROM SAID SALE OF ALCOHOLIC BEVERAGES;
AUTHORIZING THE CITY MANAGER TO EXECUTE THE
NECESSARY DOCUMENT(S), IN A FORM ACCEPTABLE
TO THE CITY ATTORNEY, BETWEEN THE CITY OF
MIAMI, THE ORANGE BOWL COMMITTEE, INC.,
AND/OR VOLUME SERVICES, INC., AS REQUIRED,
FOR THIS PURPOSE.
WHEREAS, the City controls all rights to concessions at the
Orange Bowl Stadium and allows the sale of alcoholic beverages
during football events; and
WHEREAS, the City currently has an agreement with Volume
Services, Inc., dated April 23, 1987, for the operation of food
and beverage concessions at said stadium; and
WHEREAS, said agreement provides that Volume Services has
the right to sell alcoholic beverages during all college football
events at said stadium; and
WHEREAS, the Orange Bowl Committee, sponsors of the annual
Orange Bowl Classic Football Game, have again requested that the
City prohibit the sale of alcoholic beverages during said event;
impact upon the
revenues the City and its concessionaire, Volume Services, Inc.,
and
WHEREAS, said prohibition has significant
would otherwise receive from said event; and
WHEREAS, the Orange Bowl Committee has offered compensation
in the amount of $31,450 to both Volume Services, Inc. and the
City, for a
total compensation of
$62,800, to
cover
all or a
portion of
anticipated revenue
losses from
said
proposed
prohibitiont and s

execute agreements, in a form acceptable to the City Attorney,
with the Orange Bowl Committee and/or. Volume Services, Inca to
govern the obligations of each party relative to the prohibition
of said alcoholic beverage sales;
NOWl THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDAt
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference
thereto and incorporated herein as if fully set forth in this
Section.
Section 2. The sale of alcoholic beverages in the Orange
Bowl Stadium during the 1990 Orange Bowl Classic Football Game on
January 1, 1990 is hereby prohibited, pursuant to the request of
the Orange Bowl Committee.
Section 3. Consideration offered by the Orange Bowl
Committee, Inc. in the amount of $31, 450 to the City and in the
same amount to Volume Services, Inc. is hereby approved as
compensation to the City and Volume Services, Inc. for revenues
each would normally have received from said sale of alcoholic
beverages, and the City Manager is hereby authorized to accept
said consideration on behalf of the City.
Section 4. The City Manager is hereby authorized to execute
the necessary document(s) 1/, in a form acceptable to the City
Attorney, between the City, the Orange Bowl Committee and/or
Volume Services, Inc. as required, for this purpose.
Section 5. This Resolution shall become effective
immediately upon its adoption.
