RESIDENTIAL; BY MAKING FINDINGS; AND BY
MAKING ALL THE NECESSARY CHANGES ON PAGE
NO. 35 OF SAID ZONING ATLAS MADE A PART OF
ORDINANCE NO. 9500 BY REFERENCE AND
DESCRIPTION IN ARTICLE 3, SECTION 300,
THEREOF; CONTAINING A REPEALER PROVISION AND
A SEVERABILITY CLAUSE.
WHEREAS, the Miami Zoning Board, at its meeting of March 6,
1989, Item No. 2, following an advertised hearing, adopted
Resolution No. ZB 29-89, by a 9 to 0 vote, RECOMMENDING APPROVAL
of a change of zoning classification, as hereinafter set forth;
and
WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to
grant this change of zoning classification as hereinafter set
forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The Zoning Atlas of Ordinance No. 9500, the
Zoning Ordinance of the City of Miami, Florida, is hereby amended
by changing the zoning classification of 401-449 Northwest 9th
Avenue, 833-899 Northwest 4th Street and approximately 430 and
490 Northwest South River Drive, Miami, Florida, also described
as Lots 1-10, Block B, RIVERVIEW, as recorded in Plat Book 5, at
Page 43, of the Public Records of Dade County, Florida, from
RG-2/5 General Residential to RG-3/5 General Residential.
Section 2. It is hereby found that this zoning
classification changes
(a) Is in conformity with the adopted Miami Comprehensive
Neighborhood Plan;
(b) Is not contrary to the established land use pattern;
(c) Will not create an isolated district unrelated to
adjacent and nearby districts;
(d) Is not out of scale with the needs of the neighborhood
or the City;
(e) Will not materially alter the population -density
pattern or increase or overtax the load on public
facilities such as schools, utilities, streets, etc.;
(f) Is necessary due to changed or changing conditions;
(g) Will not adversely influence living conditions in the
neighborhood;
(h) Will not create or excessively increase traffic
congestion or otherwise affect public safety;
(i) Will not create a drainage problem;
(j) Will not seriously reduce light and air to adjacent
area;
(k) Will not adversely affect property values in the
adjacent area;
(1) Will not be a deterrent to the improvement or
development of adjacent property in accord with
existing regulations;
(m) Will not constitute a grant of special privilege to an
individual owner as contrasted with protection of the
public welfare.
Section 3. Pursuant to the applicant/owner's proffer at the
public hearing, a building permit will be obtained within twelve
(12) months from the date of this approval or be scheduled before
the City Commission for further review.
Section 4. Page No. 35 of the Zoning Atlas, made a part of
Ordinance No. 9500 by reference and description in Article 3,
Section 300 of said Ordinance, is hereby amended to reflect the
changes made necessary by these amendments.

Section 5. All ordinances or parts of ordinances insofar as
they are inconsistent or in conflict with the provisions of this
ordinance are hereby repealed.
Section 6. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall not be affected.

APPROVAL.- The proposed change is in conflict
with the adopted Miami Comprehensive
Neighborhood Plan, and requires a plan
amendment, there is a companion item being
presented before the Planning Advisory Board,
with Planning Department recommendation for
approval. The proposed change is in harmony
with the established land use pattern. The
proposed change creates a district related to
adjacent and nearby districts. The change
suggested is in scale with the needs of the
neighborhood.
Right of way dedication required. Possible
replatting may be required.

At its meeting of March 6, 1989, the Zoning
Board adopted Resolution ZB 29-89, by a 9 to 0
vote, recommending approval of the above to the
City Commission.
Five proponents were present at the meeting.
Four replies in favor were received by mail.
At its meeting of April 27, 1989, the /

9. STATEMENT WHY PRESENT DESIGNATION IS INAPPROPRIATE
"ne existing zoning does not permit nursing homes. However,
the existing nursing home located at 899 N.W. 4th street become a
legal non -confirming use at the time of the Zoning change. The
Facility has been in operation for over twenty-four years and has
been providing care for the elderly members of the surrounding
community throughout that time.
Lot 8 has been acquired by the owners of the nursing home
and the South 100 feet of Lot 9 is under contract. These two
adjacent parcels have the same Zoning designation which does not
permit nursing homes. They would be utilized for purposes of
expansion of the facility to provide the additional beds
certified by the State of Florida to be needed in the community
and to provide additonal parking, recreational areas, livability
space and landscaping.
10. STATEMENT WHY THE PROPOSED ZONING
DESIGNATION IS APPROPRIATE
RG 3-5 Zoning permits nursing homes by special exception, an
application for which accompanies this petition. The proposed
Zoning will accurately reflect the present use of the nursing
home property and will permit the expansion.
The Northern half of Block B, while Zoned RG2-5 has a legal
non conforming commercial use which will continue. The proposed
designation is more appropriate in relation to the neighborhood
and surrounding properties. The property diagonally (SE) across
the street, is also RG 3-5 and is utilized by Victoria Hospital.
The owners of Lots 1 through 4, 10 and the North 50 feet of
lot 9 have all joined in the application in order to allow a
uniform zoning designation for all of Block B of Riverview upon
the recomendation of the Planning and Zoning Departments.

Please supply a statement indicating why you think the existing
plan designation is inappropriate. -
The existing plan designation does not reflect the existing
use of the majority of the property for the past twenty-five
years. The density designations for residential areas do
not appropriately take into consideration the needs of
specially permitted uses such as nursing homes.
'Please supply a statement justifying your request to change the
plan to your requested plan designation.
The high density use designation is required to permit the
RG 3-5 zoning designation which permits nursing homes by
special exception. However, many of the concerns typical of
a higher density are not present where the intended use is a
nursing home. The change will not adversely impact the
surrounding neighborhood and the proposed addition to the
existing structure will meet all standard Lui Ratios; a
significant improvement to the existing structure. HRS has
issued a certificate of need for additional skilled nursing
beds in the community, thus, passage of the ammendment will
be consistent with plans intent of meeting the needs of its
elderly residents. Re -Designation of Lots 1 through 10
although not all are to be used for the nursing home will
provide a uniform designation for the block.

WASHINGTON -- Almost 45
percent of Florida's nursing homes
fail to meet sanitary standards for
storing and serving food and almost
25 percent do not adequately care
for residents who have problems
with bowel and bladder control, ac-
cording to a federal survey released
Thursday.
"In Dade County alone, seven of
the 30 nursing homes included in
the Health Care Financing Adminis-
tration's study failed to meet seven
of 32 health and safety standards.
Local facilities were faulted for vio-
lations such as failing to promptly
help those who cannot eat and drink
by themselves.
Florida homes were rated higher
than the national average in 24 of
the 32 categories surveyed. The
state was below average in seven
categories and tied the national
average in one.
More than 15,000 homes nation-
wide are profiled in the 75-volume
study. Their evaluations are based
on inspection's that state officials
carry out on behalf of the federal
agency that administers Medicare
and Medicaid.
"This information will help con-
sumers make better decisions about
such facilities," said HCFA Admin-
istrator Dr. William A. Roper.
Florida's state long-term care
ombudsman and nursing home in-
dustry representatives called the
report "misleading." They said the
profiles were based on spot inspec-
tions that often occurred more than
one year ago.
Kathy Westberry, assistant direc-
tor of the Florida Health Care Asso-
ciation, said a trifling failure such as
a cracked egg in a refrigerator could
cause a home to be cited for failing

The study looked at 32 of more
than 500 standards inspectors con-
sider when they decide whether to
allow a home to participate in Med-
icaid or Medicare programs.
Nationwide, almost 43 percent
failed to store and cook food in a san-
itary fashion. In 29 percent, drugs
were not administered according to
doctors' written orders. Almost 30
percent did not pay enough atten-
tion to personal hygiene.
In Dade, Riverside Care Center
was the only nursing home of the 30
surveyed to get a perfect'score in all
32 categories.
The seven nursing homes that
fared worst were Ashley Manor
Care Center, Coral Gables Conva-
lescent Center, Greynolds Park
Manor Rehabilitation Center, Heri-
tage Nursing and Rehabilitation
Center, Human Resources Health
Center, Jackson Heights Nursing
Home and Jackson Manor Nursing
Home.
Martin Casper, executive direc-
tor of Greynolds Park, said the
home was deficient in only 22 of the
543 elements surveyed during a
three-day inspection last December,
and that all deficiences have since
been corrected. "It's already stale

Anita Edwards, administratoi at
Coral Gables Convalescent Center,
said her staff also corrected prob-
lems immediately after the inspec-
tion, which was more than six

chased new equipment that heats
each plate individually.
Larry Pruitt, administrator at
Ashley Manor, said'he didn't expect
the report to have a negative effect
on the home. "I have one of the
most experienced staffs in Dade
County. My opinion is we do a good
job. We take care of patients."
Heritage Nursing and Rehabilita-
tion Center met all state standards
in its annual inspection, which was
more recent than the federal sur-
vey, said Mike Mervif, spokesman
for Unicare Health Facilities, Inc. of
Wisconsin, the parent company of
the center.
Mary Cottler, executive director
of Jackson Manor, said new manage-
ment took over in August and has
corrected all problems.
Armand Gonzalez, administrator
for Human Resources Health Cen-
ter, disagreed with the report.
"We've got an excellent reputation.
We haven't had any complaints or
any investigation by a government
source at all, and. I can't imagine
what that report could be based on."
Officials at Jackson .Heights
couldn't be reached for comment
