HomeMy WebLinkAboutO-10682ORDINANCE NO. 9500, THE ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, BY CHANGING THE j ZONING CLASSIFICATION OF 401-449 NORTHWEST 9TH AVENUE, 833-899 NORTHWEST 4TH STREET AND APPROXIMATELY 430 AND 490 NORTHWEST SOUTH RIVER DRIVE, MIAMI, FLORIDA (MORE PARTICULARLY DESCRIBED HEREIN), FROM RG-2/5 GENERAL RESIDENTIAL TO RG-3/5 GENERAL RESIDENTIAL; BY MAKING FINDINGS; AND BY MAKING ALL THE NECESSARY CHANGES ON PAGE NO. 35 OF SAID ZONING ATLAS MADE A PART OF ORDINANCE NO. 9500 BY REFERENCE AND DESCRIPTION IN ARTICLE 3, SECTION 300, THEREOF; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the Miami Zoning Board, at its meeting of March 6, 1989, Item No. 2, following an advertised hearing, adopted Resolution No. ZB 29-89, by a 9 to 0 vote, RECOMMENDING APPROVAL of a change of zoning classification, as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Zoning Atlas of Ordinance No. 9500, the Zoning Ordinance of the City of Miami, Florida, is hereby amended by changing the zoning classification of 401-449 Northwest 9th Avenue, 833-899 Northwest 4th Street and approximately 430 and 490 Northwest South River Drive, Miami, Florida, also described as Lots 1-10, Block B, RIVERVIEW, as recorded in Plat Book 5, at Page 43, of the Public Records of Dade County, Florida, from RG-2/5 General Residential to RG-3/5 General Residential. Section 2. It is hereby found that this zoning classification changes (a) Is in conformity with the adopted Miami Comprehensive Neighborhood Plan; (b) Is not contrary to the established land use pattern; (c) Will not create an isolated district unrelated to adjacent and nearby districts; (d) Is not out of scale with the needs of the neighborhood or the City; (e) Will not materially alter the population -density pattern or increase or overtax the load on public facilities such as schools, utilities, streets, etc.; (f) Is necessary due to changed or changing conditions; (g) Will not adversely influence living conditions in the neighborhood; (h) Will not create or excessively increase traffic congestion or otherwise affect public safety; (i) Will not create a drainage problem; (j) Will not seriously reduce light and air to adjacent area; (k) Will not adversely affect property values in the adjacent area; (1) Will not be a deterrent to the improvement or development of adjacent property in accord with existing regulations; (m) Will not constitute a grant of special privilege to an individual owner as contrasted with protection of the public welfare. Section 3. Pursuant to the applicant/owner's proffer at the public hearing, a building permit will be obtained within twelve (12) months from the date of this approval or be scheduled before the City Commission for further review. Section 4. Page No. 35 of the Zoning Atlas, made a part of Ordinance No. 9500 by reference and description in Article 3, Section 300 of said Ordinance, is hereby amended to reflect the changes made necessary by these amendments. 2 1Qf 82. Section 5. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 6. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. At its meeting of March 6, 1989, the Zoning Board adopted Resolution ZB 29-89, by a 9 to 0 vote, recommending approval of the above to the City Commission. Five proponents were present at the meeting. Four replies in favor were received by mail. At its meeting of April 27, 1989, the / City Commission passed the above on First Reading. STATEMENT WHY PRESENT DESIGNATION IS INAPPROPRIATE "ne existing zoning does not permit nursing homes. However, the existing nursing home located at 899 N.W. 4th street become a legal non -confirming use at the time of the Zoning change. The Facility has been in operation for over twenty-four years and has been providing care for the elderly members of the surrounding community throughout that time. Lot 8 has been acquired by the owners of the nursing home and the South 100 feet of Lot 9 is under contract. These two adjacent parcels have the same Zoning designation which does not permit nursing homes. They would be utilized for purposes of expansion of the facility to provide the additional beds certified by the State of Florida to be needed in the community and to provide additonal parking, recreational areas, livability space and landscaping. 10. STATEMENT WHY THE PROPOSED ZONING DESIGNATION IS APPROPRIATE RG 3-5 Zoning permits nursing homes by special exception, an application for which accompanies this petition. The proposed Zoning will accurately reflect the present use of the nursing home property and will permit the expansion. The Northern half of Block B, while Zoned RG2-5 has a legal non conforming commercial use which will continue. The proposed designation is more appropriate in relation to the neighborhood and surrounding properties. The property diagonally (SE) across the street, is also RG 3-5 and is utilized by Victoria Hospital. The owners of Lots 1 through 4, 10 and the North 50 feet of lot 9 have all joined in the application in order to allow a uniform zoning designation for all of Block B of Riverview upon the recomendation of the Planning and Zoning Departments. /3 10682 *88 JAN 27 P 3 :58 Please supply a statement indicating why you think the existing plan designation is inappropriate. - The existing plan designation does not reflect the existing use of the majority of the property for the past twenty-five years. The density designations for residential areas do not appropriately take into consideration the needs of specially permitted uses such as nursing homes. 'Please supply a statement justifying your request to change the plan to your requested plan designation. The high density use designation is required to permit the RG 3-5 zoning designation which permits nursing homes by special exception. However, many of the concerns typical of a higher density are not present where the intended use is a nursing home. The change will not adversely impact the surrounding neighborhood and the proposed addition to the existing structure will meet all standard Lui Ratios; a significant improvement to the existing structure. HRS has issued a certificate of need for additional skilled nursing beds in the community, thus, passage of the ammendment will be consistent with plans intent of meeting the needs of its elderly residents. "In Dade County alone, seven of the 30 nursing homes included in the Health Care Financing Adminis- tration's study failed to meet seven of 32 health and safety standards. Local facilities were faulted for vio- lations such as failing to promptly help those who cannot eat and drink by themselves. Florida homes were rated higher than the national average in 24 of the 32 categories surveyed. The state was below average in seven categories and tied the national average in one. More than 15,000 homes nation- wide are profiled in the 75-volume study. Their evaluations are based on inspection's that state officials carry out on behalf of the federal agency that administers Medicare and Medicaid. "This information will help con- sumers make better decisions about such facilities," said HCFA Admin- istrator Dr. William A. Roper. Florida's state long-term care ombudsman and nursing home in- dustry representatives called the report "misleading." They said the profiles were based on spot inspec- tions that often occurred more than one year ago.
