AN ORDINANCE AMENDING SECTIONS 113,4 AND 5 OF
ORDINANCE NO. 10648, THE ANNUAL
APPROPRIATIONS ORDINANCE FOR FISCAL YEAR
ENDING SEPTEMBER 30, 1990, ADOPTED
SEPTEMBER 28, 1989, BY CREATING A NEW
SECTION 2.11 DEBT SERVICE FUND, FOR THE
PURPOSE OF FORMALIZING CITY COMMISSION
ACTIONS AND IMPLEMENTING OTHER AMENDATORY
CHANGES; CONTAINING A REPEALER PROVISION AND
A SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 10648,
the Annual Appropriations Ordinance, on September 28, 1989,
establishing revenues and appropriations for the City of Miami,
Florida, for the Fiscal Year ending September 30, 1990; and
WHEREAS, amendatory adjustments to the FY190 appropriations
ordinance are outlined herein together with the explanation for
said adjustments; and
WHEREAS, State Revenue Sharing funding of $2,000,000 was
designated as a secondary pledge in June, 1989 for the
$16,000,000 Florida League of Cities Loan for Orange Bowl
Renovations; and
WHEREAS, this pledge coupled with an additional $466,000 of
operating revenue from the Orange Bowl must be recorded
separately in the Orange Bowl Fund, and at year end the unused
balance will be transferred to the General Fund; and
WHEREAS, the Orange Bowl Warehouse Bond Fund will expire
during Fiscal Year 1990 because the bonds will be amortized by
December 1989 and the estimated excess cash of $135,000 can be
transferred to the General Fund; and
WHEREAS, Melreese Golf Course FY189 retained earnings, in
the amount of $20,000, will be appropriated into its FY190 Budget
to pay for the removal of 18 Ficus Trees approved by Resolution
No. 89-608; and
WHEREAS, the City Commission approved the City Manager's
recommendation to establish an Unsafe Structures Board and
increase Code Enforcement efforts throughout the City; and

WHEREAS, these additional functions will increase the
Building and Zoning Department's revenue and appropriation
budget for FY190 by an estimated $385,862; and
WHEREAS, State Revenue Snaring funding of $3,721,258 was
also pledged in June, 1989 for the $6,500,000 Special Obligation
Bond Series Guaranteed Entitlement Program to fund various park
related projects; and
WHEREAS, this pledge must be recorded in a new fund,
entitled, "Guaranteed Entitlement Revenue Bonds Debt Service
Fund", and at year end the unused balance will be transferred to
the General Fund; and
WHEREAS, a Special Obligation Bond Fund in the amount of
$4,200,000 was established in FY'87 to fund the construction of
Scattered Site Affordable Housing; and
WHEREAS, revenue to repay these bonds in the amount of
$415,000 is allocated from telephone franchise fees; and
WHEREAS, the City Commission approved the sale of Tax

Anticipation Notes, Series 1989, in the amount of $14,960,000
pursuant to Resolution No. 89-899; and
.,,..,WHEREAS, the proceeds from said notes will cover anticipated
temporary cash deficiencies during fiscal year ending
September 30, 1990; and
WHEREAS, Resolution No. 89-899 requires the establishment of
a debt service fund entitled "Note Fund Tax Anticipation Notes
FY'90", funded from a pledge of Ad Valorem Tax Revenue; and
WHEREAS, principal and interest for said fund for FY190
amounts to $15,927,725; and
WHEREAS, the General Fund will make a contribution to the
Note Fund in the amount of $15,735,846; and
WHEREAS, the Department of General Services Administration
has prepared a budget estimate 'of expenditures in the amount of
$1,000,000 for Emergency 911 System Service Fees; and
WHEREAS, the City of Miami in order to comply with
Chapter 365 of the Florida Statutes must place said fees in a
separate account; and

WHEREAS, there is approximately $250,000 of interest
earnings in the Certificate of Participation Notes Acquisition
Fund; and
WHEREAS, said interest earnings must be used to purchase
additional City vehicles; and
WHEREAS, $585,694 is added to the Southeast Overtown Park
West Redevelopment Trust Fund to include all available revenue
from the City of Miami and Dade County governments; and
WHEREAS, Resolution No. 85-923 requires the City to
establish a Trust Fund to be funded from 7.4% of the rental
income received from the Bayside Retail Parcel agreement; and
WHEREAS, $90,392 is available to be deposited in said trust
fund for FY'90;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Sections 1, 31 4 and 5 of Ordinance No. 10648,
adopted September 28, 1989, the Annual Appropriations Ordinance,
for Fiscal Year ending September 301 1990, is hereby amended in
the following particulars: I/

made for the municipal operation of the City of Miami,
Florida, for the Fiscal Year 1989-90, including the

Section 2. The herein increase and appropriations in the
amount of $415,000 for the Special Obligation Bond Fund supports
the Debt Service requirements associated with the $4,200,000,
Scattered Site Affordable Housing Construction.
Section 3. The herein increase in revenue and
appropriations in the amount of $4,021,258 is to establish a new
fund entitled Guaranteed Entitlement Revenue Bonds Debt Service
Fund. A pledge in the amount of $3,721,258 of State Revenue
Sharing Funding plus $300,000 of interest income will support
said fund. Funds not used for debt service will be transferred
to the General Fund.
Section 4. The herein increase in revenue and
appropriations for the Orange Bowl Stadium in the amount of
$2,466,000 is to cover a secondary pledge requirement on
$16,000,000 Florida League of Cities loan for Orange Bowl
Renovations. A pledge in the amount of $2,000,000 from State
Revenue Sharing Funding and $466r000 of additional operating
revenue from the Orange Bowl will support said increase. Unused
balances will be transferred to the General Fund.
Section 5. The herein increase in appropriations for the
Orange Bowl Warehouse Bonds in the amount of $135,000
appropriates excess cash in a like amount which will be
transferred to the General Fund.
Section 6. The herein increase in revenue and
appropriations for Melreese Golf Course in the amount of $20,000
from FY189 retained earnings is to pay for the removal of 18
Ficus Trees approved by Resolution No. 89-608.
Section 7. The herein increase in revenue and
appropriations for Building and Zoning in the amount of $385,862
is to pay for additional functions (i.e. Unsafe Structures Board)
assigned to the Building and Zoning Department.
Section 8. The herein increase in revenue and
appropriations for the General Services Administration
Department, Communications Services Division, $1,000,000 and
Fleet Management $250,000 is to pay for recurring and
nonrecurring E-911 system service fees, and the purchase of
additional City vehicles. Funding is available from E-911
charges and interest earnings from the Certificate of
Participation Notes acquisition fund.
Section 9. The herein increase in appropriations for the
Southeast Overtown/Park West Redevelopment Trust Fund in the
amount of $585,694 is to appropriate all available revenue from
the City of Miami and Dade County Governments.
Section 10. The herein increase in revenue and
appropriations in the amount of $90,392 is to establish a new
fund entitled the Parks Development Trust Fund. Said fund will
receive revenue from 7.4% of the rental income received from the
Bayside Retail Parcel agreement. The establishment of this Trust
Fund is pursuant to Resolution No. 85-923.
Section 11. The herein increase in revenue and
appropriations in the amount of $15,927,725 is to establish a new
fund entitled "Note Fund Tax Anticipation Notes FY'90". A
contribution in the amount of $15,735,846, combined with interest
earnings, will support said fund.
Section 12. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.

Section 13. If any section, part of this section,
paragraph, clause, phrase, or word of this Ordinance is declared
invalid, the remaining provision of this Ordinance shall not be
affected.
Section 14. This Ordinance shall become effective
immediately upon its adoption.

Recommendation:
It is respectfully recommended that the City Commission adopt the
attached ordinance creating a new Section in the annual
appropriations ordinance •to appropriate funds for Debt Service
and for other amendatory changes.
Background:
The Departments of Budget and
changes that should be made to
Appropriations Ordinance for the
1990, as amended. The reasons
stated below.
Finance have identified certain
Ordinance No. 10648, the Annual
fiscal year ending September 30,
for the recommended changes are
A $15,927,725 appropriatibn for a new Tax Anticipation Note Debt
Service Fund to be used to account for principal, interest, and
issuance coats for Tax anticipation notes needed to cover
temporary cash deficiencies anticipated for fiscal year ending
09/30/89. Revenue to cover this appropriation will consist of a
$15,735,846 contribution from -the 'General Fund and interest
earnings.
A• $15,735,846 increase in appropriations to the General
Fund/Special Programs and Accounts to make a contribution to the
note fund in a like amount.
A $2,466,000 increase in appropriations for the Orange Bowl
Stadium Enterprise Fund to account for the $2,000,000 pledge and
$466,000 in anticipated debt service requirements for the $16
million Florida League of Cities Loan for Orange Bowl
Renovations. The $2 million pledge will come from the State
Revenue Sharing and the $466,000 from operating revenues. Any
unused balance at year end will be transferred to the General
Fund.
A $1359000 increase in appropriations to the Orange Bowl
Warehouse Bonds Enterprise Fund which can be transferred to the
General Fund. This $135,000 is the estimated cash surplus which
will result by amortizing the Bonds by December 1989.

A $20,000 increase in appropriations to the Melreese Golf Course.
to pay for the removal of 18 Ficas Trees approved by Resolution _
No. 89-608. Funds are available from FY189 retained earnings to '
cover this expense.
A $385,862 increase' in appropriations to the Building and Zoning
Enterprise Fund to cover the costs of increased Code Enforcement
activities and the establishment of an Unsafe Structures Board.
This increased activity should generate additional revenue to
cover this expense.
A $415,000 appropriation for a new Special Obligation Bond Fund
is needed _to cover the debt service requirements of the $4.2
million Special Obligation Bond Issue for the Scattered Site
Affordable Housing Program.
A �4,021,258 appropriation for a new Guaranteed Entitlement
Revenue Bond Debt Service Fund to account for a pledge of
$3,721,258 in State Revenue Sharing Funds and $300,000 in
interest income to secure this Revenue Bond. Funds not used for
debt service will be transferred.to the General Funds.
A $1,000,000 increase in appropriation to Communication Services
to corer the costs of E-911 system service. Funds to cover this
anticipated expense are available from E-911 charges to telephone
customers.
A $250.000 increase in appropriations to Fleet Management to
purchase additional City vehicles. Funds to cover this
anticipated expense are available from interest earnings
generated from the sale of Certificate of Participation Notes.
A $585,694 increase in appropriations to the Southeast
Overtown/Park West Redevelopment Trust Fund to cover anticipated
expenses relative to the development of said area.. Funds to
cover this increase consists of $300,000 in Gas Franchise fees
and $285,694 tax increment financing from Metro Dade County.
A $90,392 appropriations to the Parks Development Trust fund
pursuant to Resolution number 89-923.
