AN ORDINANCE AMENDING SECTION 38-8 OF THE
CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, BY INCREASING EXISTING RATES FOR THE
USE OF DESIGNATED AREAS AT THE MANUEL ARTIME
COMMUNITY CENTER; ESTABLISHING RATES FOR THE
USE OF THE MINI -PLAZA AND MINI -PARK AND
AUTHORIZING APPROVAL OF SPECIAL RATES AND FEE
WAIVERS BY THE CITY COMMISSION AT SAID CENTER
FACILITIES; REVISING THE INSURANCE
REQUIREMENTS; RENAMING THE LARGE AUDITORIUM
OF BUILDING "A" AS THE MANUEL ARTIME
PERFORMING ARTS CENTER; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the Manuel Artime Community Center large auditorium
has been renovated under two State of Florida grants totalling
$500,000; and
WHEREAS, the Center offers a world class 699 seat facility
for the performing arts, thereby providing a venue for multi-
ethnic cultural and artistic groups; and
WHEREAS, existing rates must be revised and increased to
meet the rising cost of maintainance of said facility:
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Sections 38-8 of the Code of the City of
Miami, Florida, as amended, is hereby amended in the following
particulars:'/
"Sec. 38-8. Use of Manuel Artime Community Center.
(A) Rates for the use of the following areas at
the city facility known as the Manuel Artime Community
Center are hereby established, which rates include
normal janitorial service, air conditioning► normal
houselights, and such other items that are available at
the facility for use, but do not include event
personnel or support services such as policemen,
fireman, ushering staff, ticket sellers and ticket
takers, stagehands, spotlight operators, sound and
lighting technicians, musicians, projectionist, booth

Underscored words and/or figures shall be added. The
remaining provisions are now in effect and remain unchanged.

in the provisions of this section shall limit or
restrict the right of the city commission to establish
and fix special charges or special terms and conditions
for the use of the Manuel Artime Community Center of

areas of this city facility is gratuitous for tenants
of the Manuel Artime Community enter who have executed
current lease agreements, subject to securing insurance
as required in subsection (b) of this section, if
nontenants are invited upon the premises of the
facility or if the presence of nontenants is reasonably
anticipated.
Special Rates:
In addition to those rates set forth herein,
special rates or fee waivers may be approved
by the city _commission at the Manuel Artime
Community Center facilities upon user request
and recommendation by the administration."
(B) Insurance. The insurance requirement
referred to in subsection (a) of this section is more
specifically set forth as follows: User shall provide
to the city public liability insurance in the amount of
not less than three hundred thousand dollars
($300,000.00) per occurrence for bodily injury and
fifty thousand dollars ($50,000.00) per occurrence for
property damage; and this will be at the cost and
expense of the user. Said policy shall be written by
companies authorized to do business in the State of
Florida and must carry a rating of not less than A B+
as to management and grade X V as to financial
strength, all in accordance with Best's Key Rating
Guide. All policies written must name the city as an
additional insured.
The city may be able to obtain special -events insurance
for those events that meet certain prerequisites. The
city, at its sole option, may determine that the event
qualifies for said special -events insurance. If so
qualified, the user may comply with the insurance
requirement by obtaining said insurance through the
city at the user's expense.
(C) Reservation Deposit; Payment of Fee.
(1) Persons or organizations wishing to use the above -
designated areas at the Manuel Artime Community
Center shall be required to make a payment in the
amount of twenty-fi . - one -hundred dollars ($25 GO
100.00) per day, as a nonrefundable cash deposit,
five -(15-) (5) days from the date of
notification by the city that the requested date(s)
have been reserved. The cash deposit will be
forfeited if the user cancels the event any time
after the payment of the said cash deposit. User
must pay the city ae-t less than €iffy (50) L ___~_

subsection (b) of this section and copyright

Section 2. All ordinances, or parts of ordinances
insofar as they are inconsistent or in conflict with provisions
of this Ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective 30 days
after final reading and adoption hereof.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the
attached ordinance amending Section 38-8 of Chapter 38 of the City
Code for the purpose of increasing the rates at the Manuel Artime
Community Center; revising insurance requirements; and renaming
0.3Building "A" Large Auditorium as the Manuel Artime Performing Arts
Center.
BACKGROUND:
The Department of Community Development has prepared the attached
ordinance revising the rate schedule as well as insurance
requirements in Section 38-8 of Chapter 38 of the City of Miami Code,
pertaining to the use of the facilities at the. Manuel Artime
Community Center.
The Manuel Artime Community Center Large Auditorium, to be renamed
the Manuel Artime Performing Arts Center, has been renovated into a
world class 699-seat facility for the performing arts.. This project
was underwritten by two allocations from the State of Florida
totalling $500,000. The renovated facility offers a state of the art
performing center to local multi -ethnic cultural and artistic groups.
Due to the increasing cost of utilities and the added expense of
maintaining a state of the art facility, it is necessary that rates
be increased as follows:
Building "A" (900 S.W. First Street)
Larne Auditorium
Manuel Artime Performing Arts Center: Increase rate from $100 to
$350 for four (4) hours or less; each additional hour over -four (4)
from $50 to $100 per hour. For those events where admission is
charged, the fee shall be $350 plus 10 percent of ticket sales.

Non-Refundable Cash Deposit will be increased from $25.00 to $100 per
day to be paid no later than five (5) days from. notification by the
City that the date(s) have been reserved.
Choir Room -Third Floor: From $12.50 to $15.00 per hour or From $50 -
to $75 per day.
New Building (970 S.W. First Street)
Small Auditorium (Second Level): From $50,to $100 for four (4) hours
or less; from $25 to $50 for each additional hour after four; from
$75 to $150 per day.
It is recommended that the following new rates be implemented for the
use of the Mirk. --Plaza and Mini -Park:
Mini-Plaza/Mini-Park: $50 for four (4) hours or less; $10 for each
additional hour over four (4).
The frequent utilization of the Center for cultural events, in the
conjunction with the implementation of the Latin Quarter project,
will attract visitors and residents to the Little Havana.area.
