A RESOLUTION MAKING FINDINGS, AND DIRECTING

THE PERMANENT PROHIBITION OF VEHICULAR ACCESS -
TO NORTHEAST 70 STREET, NORTHEAST 71 STREET
and NORTHEAST 72 STREET AT THE ZONING DISTRICT -

BOUNDARY LINE LOCATED AT THE EASTERLY SIDE OF —
BISCAYNE BOULEVARD IN THE CITY OF MIAMI, -
_
FLORIDA, PROVIDED THAT THE CONDITIONS
CONTAINED WITHIN THIS RESOLUTION ARE MET; AND
DIRECTING THE ADMINISTRATION TO REVIEW OTHER _
ALTERNATIVES IN THE EVENT THE REQUIRED MONIES
FOR THE BARRICADES ARE NOT OBTAINED.

WHEREAS, a group of property owners has requested that the
City restrict vehicular access to certain streets within the
Bayside neighborhood; and
WHEREAS, the City Commission adopted Resolution No. 89-360
on April 13, 1989, authorizing for a 90-day trial period,
temporary barricades across Northeast 70 Street, Northeast 71
Street and Northeast 72 Street at the zoning district boundary
line located at the easterly side of Biscayne Boulevard in the
City of Miami, Florida, subject to certain conditions which have
been met; and
WHEREAS, the Police Department, Fire, Rescue and Inspection
Services Department, Solid Waste Department and Metropolitan Dade
County Public Works Department have evaluated the effects of the
vehicular access restriction upon their respective operations
during the 90-day trial period and have expressed no substantial
objections to the permanent restriction of vehicular access to
the aforesaid street provided that access for emergency vehicles
be allowed at all times; and
WHEREAS, Section 54-17 of the Code of the City of Miami,
Florida, gives the City Commission the power, after a properly
advertised public hearing, to require that vehicular access to a
particular street be prohibited where such prohibition is found
to be in the best interest of the public; and

WHEREAS, pursuant to due public notice, a public hearing was

held before the City Commission on January 11, 1990 as to any
objections to the permanent prohibition of vehicular access to
-i the aforesaid streets and no objections were sustained by the

City Commission, and, the City Commission has approved the
_ prohibition of vehicular access at the aforesaid intersection to
_ be implemented on a permanent basis provided that specific
requirements set forth below are met; and
WHEREAS, the City Commission hereby finds that the herein
prohibition is in the best interest of the public;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings set forth in the
Preamble to this Resolution are hereby adopted by reference and
incorporated herein as if fully set forth in this Section.
Section 2. It is hereby directed that vehicular access to
Northeast 70 Street, Northeast 71 Street and Northeast 72 Street
at the zoning district boundary line located at the easterly side
of Biscayne Boulevard in the City of Miami, Florida, will be
permanently prohibited in accordance with the findings as set
forth in Section 1 hereof provided that the following conditions
occur:
(a.) the residents shall secure and post a bond
with the Public Works Department within 120
days from the date of this Resolution, for
the monies needed to install and maintain the
aforementioned barricades in the amount of
$30,000.00;
(b.) the design of the barricades shall be
approved by the Fire, Rescue and Inspection
Services Department, the Police Department
and the Public Works Department; and
(c.) all of the barricades shall be installed by
licensed contractors retained by the Public
Works Department after posting of the bond,
as set forth in Paragraph (a) above.

Section 3. In the event that the property owners do not
post the required bond within 120 days from the date of this
Resolution, the City Administration shall review other
alternatives, such as a one-way street system.
Section 4. This Resolution shall become effective
immediately upon its adoption.

RECOMMENDATION:
It is respectfully recommentted that the City Commission NOT adopt
the attached Resolution authorizing the permanent restriction of
vehicular access to street:;, within the Bayside neighborhood. If
approved by thi City Commission, financing the construction of a
permanent barricades at t1iis location must be determined.
BACKGROUND:
The City Commission passed Resolution No. 89--360 on April 13,
1989 authorizing, for a 90-day trial period, temporary barricades
across N.E. 70 Street, N.E. 71 Street and N.E. 72 Street at the
zoning district boundary line located at the easterly side of
Biscayne Boulevard. The temporary restrictions were accomplished
by reusing the existing temporary barricades and signs previously
approved for the temporary street closures in the Coconut Grove
neighborhood.
After the 60th day of the 90 day trial period had elapsed,
letters were sent to all property owners in the Bayside
neighborhood affected by the temporary barricades soliciting
their approval or disapproval for construction of permanent
barriers. The results received by the Public Works Department
will be presented to the City Commission at the January 11, 1990
public hearing.

The Department of Public Works estimates that the cost of a
ppermanent barricade is $10,000 per intersection or a total of
$30,000. A project of this magnitude should be considered as a
capital improvement and there are currently no funds available
from the Highway General Obligation BonT- fund for the
construction of these barricades. If permanent barricades are
approved, then the City Commission must identify a method of
financing their construction, including the possibility of
obtaining funds from voluntary assessments, neighborhood
organizations, or similar means.

Dear Mr. Cather:
This is in response to your March 22, 1989, request for comments
concerning proposed barricade placements on the above roadways.
The Department will not take a legal or political position in this
matter, however, we have reviewed the present traffic circulation
patterns in the area and have analyzed the probable impact to adjacent
roadways that would provide access to the arterial system to motorists
that would be detoured by the proposed closures. We wish to respond
with our concerns about each street:
° N.E. 69 Street - Although closure is not requested on this
street, it would receive all of the detoured traffic if all three
proposed closures are implemented. Signal Liming would need
adjustment at this roadway's intersection with Biscayne Boulevard
to handle the additional traffic. Delays during peak periods would
be excessive and may become unacceptable. The existing southbound
left turn bay length of 50 feet may require lengthening, resulting
in a northbound left turn prohibition at N.E. 70 Street.
N.E. 70 Street - This roadway has a very narrow, winding section
near its eastern and. This section is unsuitable for all
residential traffic to be forced to use as a detour to access their
property on this street. We strongly oppose any outright closure
of this roadway in its present form for safety reasons.

N.E. 71 Street - This roadway is signalized at its intersection

with Biscayne Boulevard and acts as a collector for residents in
this area to access Biscayne Boulevard safely during periods of =

heavy traffic volumes. We therefore oppose closure of this roadway =
since it is part of the arterial roadway network and since a
=
closure would prohibit residents from utilizing the traffic signal

to access their neighborhood.
° N.E. 72 Street - This roadway is of sufficient width, and has —

N.E. S Avenue as a connector to N.E. 71 Street, that closure of —
only this roadway may not present a major negative traffic impact
="
to the surrounding area. However, the impact of traffic detoured
--
from this roadway to N.E. 8 Avenue and to N.E. 71 Street may be
considered unacceptable by the affected residents on, both streets,
and should be addressed during any temporary closure period.

The Honorable Mayor and Commissioners
of the City of Miami:
The Board of Directors of the Little River Lions Club have
unanimously adopted the following recommendation:
Whereas: A duly appointed committee of the
Little River Lions Club was requested to
investigate the effectiveness of the
temporary barricades on the following Bayside
Streets: N.E. 70th Street, N.E. 71st Street,
and N.E'. 72nd Street.
Whereas: Said Committee recently reported its
findings, revealing a gross misinterpretation
concerning the purpose for which said
barricades were erected, and
Whereas: In contrast to its designated purpose
the barricades tend to be most harmful to
the residents of Bayside especially by the
diversion of.traffic to 69th Street , thereby
setting the stage for disastrous
possibilities of unavoidable accidents and
hindrance for emergency vehicles and
Whereas: The Committee further reported that
prevention of criminal acts, the primary
reason for which the barricades were
erected, has not been accomplished,
according to police reports. This has also
been verified for the Belle Meade area
where permanent barricades were installed a
few years ago.

recommends the immediate removal of the temporary
barricades.
