A RESOLUTION AUTHORIZING THE USE OF A PORTION OF BICENTENNIAL PARK, LOCATED AT 1075 BISCAYNE BOULEVARD, MIAMI, FLORIDA, BY UNITED STATES HANG GLIDING ASSOCIATION. INC. d/b/a/ MIAMI HANG GLIDERS, FOR THE PURPOSES OF CONDUCTING HANG GLIDING LESSONS ON A THIRTY DAY TRIAL BASIS BEGINNING AFTER THE 1990 MIAMI GRAND PRIX FOR A FEE TO THE CITY OF = $500; SUBJECT TO SUCH CONDITIONS AND LIMITATIONS AS MAY BE PRESCIBED BY THE CITY OF MIAMI; DIRECTING THE CITY MANAGER TO MONITOR. SAID HANG GLIDING OPERATIONS AND RETURN TO THE CITY COMMISSION WITH A RECOMMENDED REVOCABLE USE PERMIT, IF =_ APPROPRIATE, FOR A LONGER TERM USE ARRANGEMENT. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The use of a portion of Bicentennial Park, located at 1075 Biscayne Boulevard, Miami, Florida, by the United States Hang Gliding Association, Inc., d/b/a Miami Hang Gliders, is hereby authorized for the purposes of conducting hang gliding lessons on a thirty day trial basis beginning after, the 1990 Grand Prix for a fee to the City of $500. Section 2. Said authorization is hereby subject to and contingent upon said organization's compliance with any and all conditions and limitations as may be prescribed by the Administration of the City of Miami. Section 3. The City Manager is hereby directed to monitor said hang gliding operations and to return to the City Commission with a recommended revocable use permit, if appropriate, for a longer term use arrangement. Section 4. This Resolution shall become effective immediately upon its adoption. I feel there is a need to explain to the City of Miami what we, "Miami Hang Gliding," are trying to accomplish at Bicentennial Park and/or Virginia Key. All correspondence between Miami Hang Gliding and Kevin Smith, who is the Assistant Director of the Parks Department, has been sent to you. Kevin and I believe a first-hand presentation would be.invaluable in answering questions that the City might have. Recently, we have discovered another site where our activity could be accomplished. The site is located on the northeast tip of Virginia Key. It is an old sludge pit that we could transform into a beautiful training site. I have enclosed a second drawing of this area (Exhibit 2). The site is not presently in use. We could apply the same rules and procedures here as at Bicentennial Park. Please, take just a few moments to read through the material. I cannot understand why the City of Miami would not want this activity to be available to its citizens. We are currently on the City of Miami Tourism Tape, shot by ASHTA. (Note: Letters of Recommendation) I am confident that you will not find one negative letter about this sport from any of the 100 or more sites where it is currently available. Hang Gliding has generated tens of thousands of dollars in permit fees and donations to selected charities-tihroug s ows and demonstrations. With most of these sites located in the northern climates, Miami would be one of the few winter flying sites; thus, generating tourism dollars for the City and the Parks Department. Box 561732 Miami, Florida 33156 June 2, 1989 Mr. Kevin Smith Assistant Park Director City of Miami c/o Albert Ruder 1390 N.W. 7th Street Miami, Florida 33125 Dear Mr. Smith: I am writing on the recommendation of your Bicentennial Park Rangers, to obtain the Parks Department's permission for estab- lishing a limited access, foot launched, non -motorized, flexible wing hand gliding training site within the Park. The site location is located on the hill between two baseball diamonds, as shown on my enclosure (1). This recreational activity can be accommodated without detracting from the Park area, and the areas normally used for other activities. This activity will supply the reason for people to visit Bicentennial Park, either as students or spectators. This can only lead to a gradual upgrading of the Park area. As shown by the enclosure (1), the site has a hill with excellent potential for the training of pilots. With just a slight grading and refacing with sod, the site would become the only training area south of Atlanta, Georgia. The Miami Hang Gliding Association would be willing to undertake the cost and responsibility for the landscaping of the hill. Expanding the Park's recreational facilities for this purpose would not be unique, although it would be new to the Florida area. Hang gliding is presently allowed at many municipal, state, and national parks (Torrey Pines, CA; Yosemite, Skyline Drive, CA; Kitty Hawk, NC; Lookout Mountain, GA; Dunlape, TN to name a few that I am familiar with). Hang gliding has matured and achieved recognition as a legitimate recreational activity, with well over 40,000 enthusiasts throughout the United States. We have a nationwide regulating organization, the United States Hang Gliding ,Assn., Inc. (USHGA), which establishes pilot proficiency standards, issues and controls licensing, and administrates a member pilot liability insurance program. There is also a manufacturing organiza� t o , the Hana der Manufacturers Assn. (HGMA), which establishes certification standards for glide products. (7 Mr. Kevin Smith Page 2 .June 2, 1989 The key to the successful use of the Park is a•good set of administrative ground rules similar to those used in other parks, such as: --only students with instructors allowed on the training hill; --boundary markers designated with orange coned possible flight paths; --all sutdents signing release waivers and joining USHGA; --no more than five students per lesson; ---only instructors rated by the USHGA to train students. This site truly does have the potential to be a very active training site. With its southeast facing and view of Miami, it would be a very pleasant Park in which to train. I hope that you will take positive action on this request. As a resident of Dade County and the City of Miami, I have looked very hard for a feasible site. Bicentennial Park is by far the best choice, both for the Park and the participants. As a member and instructor of the USHGA, I can obtain their assistance to work with you in establishing the detailed procedures and limits on the use of this site. Along with those statistics I have enclosed several documents of insurance showing that they are currently insured. Also enclosed are more letters of recommendation for your review. Please note that all of the people involved at these sites can be contacted by phone if you have further questions. It is also important to note: all of the incidents have occurred at advanced flying sites. There have been no suits filed against any training centers in the United States. It is very -important to understand the simplicity of what we are trying to accomplish. There will be no long duration flights, just the simple launch and landing of gliders after a 5 second flight. I am confident that a demonstration at the hill currently available will more than ease all of your concerns regarding safety questions. Mr. Smith, I truly believe that the scope of this activity needs to be explored. Just to give you an example, Kitty Hawk Kites, which is located in a city park, trained 7,500 students last year. With a park fee of $5.00 per student, $37,500 was contributed to the park's budget. Can you show me any activity currently that gives this kind of return to the park? Also, unlike the current activities that use city funds to build, we are willing to fund ourselves. All we are asking for is the use of the land part-time. Can you imagine everyone's surprise when Bicentennial Park becomes the most popular park, instead of the least used one. The off -shoots from this activity are tremendous. Silent Air Shows are held each year in Milpitas, California to benefit crippled children. About 10,000 people attended the last show. If the site that I have shown is unacceptable, maybe we can reclaim the site just south of the park where the barricades for the Miami Grand Prix are currently being stored, offering absolutely no benefit to the surrounding area. Please try to allow some time to meet with us, even over lunch will do. This can only be accomplished with your help. When it does become successful and the park is heavily used, it will be your name that gets the credit for it. Director 1945 Adams Street San Diego, California 92116 Dear Steve: In response to your letter, I hope the following will answer your questions about our hang gliding program in Yosemite, Hang gliding in Yosemite is entering its tenth season as an accepted activity due to the excellent safety record and cooperation of the members of the United States Hang Gliding Association. There have been over 5,000 launches with only 16 reported accidents. of which only a few resulted in minor injuries. The hang gliding community has proven to be a responsible group, not only while participating in their activity, but also while participating in other park activities. There have also been several occasions when I utilized their willingness to assist the National Park Service in searches of lost hikers. Through trey contacts with the members of the U.S.H.G.A. I see a competent organization that has a uniform standard of rating its pilots and a dedication to safety practices. Hang glider pilots from every state visit and fly our site, and one thing they all have in common is a professional level of confidence toward hang gliding and an attitude conducive to a safe working relationship. In Yosemite, launching from a 3200 foot vertical cliff, with 200 foot evergreen trees on both side of the launch demands a demonstrated degree of precision. This has been exhibited time and time again. Once the pilot has cleared launch, they are confronted with controlling the glider amidst 3200 foot granite cliffs and thundering waterfalls. Landing requires bringing the glider in between 200 foot trees surrounding a small meadow. All of this impresses upon me the absolute control a hang glider pilot has over their glider. My own observations at flying sites outside the Park, that do have aerial towers and power lines, proves to me that the presence of either creates no more of an obstacle than a tree of the same height. With the amount of control exhibited by the hang glider Pilots, I see this as a minor concern. I hope this information proves to be useful to you, and I would like to thank you on behalf of the National Park Service for the support and cooperation the hang gliding community has continually extended towards us. The fact is they have been a benefit to our unit in that they are generating revenue, they do volenteer work on a regular basis such as road and trail mantinence. They are very safety minded and they police themselves. The park mantinence crew never has to clean up after a day of flying. Since 1974 I have written only one citation to a hang glider pilot and that was for improper parking. I am sorry I could not be present at this meeting because I am sure it would bring forth more pertinent information. My fears involved invasion of privacy, increased noise. litter and fire hazzard. Also, 1 felt their presence would interfere.with the reproduction of calves and their welfare. 1 envisioned damage to roads, gates and fences due to the increase in traffic. Not one of my fears has materialized. The Wings of RZogallo hang gliding club has its own rules regulating the care of the property regarding litter, fire, noise, etc. and these rules are strictly enforced. The cattle are flourishing. The pilots have formed work parties to repair rain -damaged roads. They have also cleaned out the cattle guard whenever necessary. They even saved the life of a cow unable to give birth to a breech calf by notifying me of the problem. The club members, in general, demonstrate a willingness to assist whenever they can. SITE OPERATION The Florida Free Flight Association is designated by the city of Miami Parks and Recreation Department through special use permit to administer hang gliding activities within Margaret Pace Park. Hours of operation will be half an hour before sunrise to half an hour after sunset, Monday through Sunday. (Hours may vary depending on conditions.) II. SITE LAUNCH AND LANDING AREAS Margaret Pace Park contains one launch area, one landing area on land and one alternate water landing area. Pilots will immediately clear these areas after landing. Train- ing is not allowed at Margaret Pace Park; a training area is directly east of the Park on a spoil island in Biscayne Bay. III. PILOT SKILL AND IDENTIFICATION A. All pilots must display an identification sticker on their helmets while using the site. -The purpose of the helmet sticker is to permit easy identifica- tion of qualified pilots to other pilots and to Park authorities. Stickers will be available from FFFA club officers. A nominal fee of $3.00 will be charged for each sticker to help defray printing costs. Be- fore obtaining a sticker it will be necessary to: 1) present a valid USHGA membership card 2) fill out and sign a waiver of liability form. 3) read the Margaret Pace Park Operations Plan 4) pay the sticker fee B. Pilots must be rated by the USHGA and possess an Inter- mediate or Advanced rating. Novice pilots may fly with supervision at the discretion of the Beach Coordinator. C. Blue sticker designates Intermediate and Advanced pilots. Yellow designates Novice pilots. Red designates Beginners. IV. SAFE PRACTICE A. All pilots must wear protective headgear at all times during launch, flying and landing. B. All flight equipment is subject to inspection and approval by the Safety Committee. C. All landings within the Park shall be restricted to designated landing areas except for emergency landings dictated by obvious safety considerations. _ D. Pilots shall not use the site for high risk and low altitude, aerobatics, testing experimental gliders, deliberate parachute deployment, or any hazardous operations. E. Maximum flight altitude shall not exceed 2000 ft. due to the proximity of site to aircraft airways. F. The Beach Coordinator or Safety Committee members may, on the basis of adverse flying conditions, close the site to all flying for the duration of the adverse conditions. This does not relieve any pilot from his responsibilities for using good judgement to determine when it is unsafe to fly. V. VIOLATIONS No individual FFFA member site monitors will be designated. The Beach Coordinator, Safety Committee members, and FFFA 'club officers are responsible for ensuring that site pro- cedures are followed. Pilots who violate this Operations Plan may have their flying privilege at Margaret Pace Park suspended or revoked by FFFA. VI. SPECTATORS Spectators will be encouraged to enjoy gliding activities while visiting Margaret Pace Park. For their safety, a placard will designate the landing and takeoff areas and spectators will be discouraged from entering these areas while flying is taking place. Two individuals shall super- vise the areas and keep spectators clear of the landing and takeoff areas. Should the area become hazardous, glidinq activities shall. be suspended. m0-: M PARK USER'S AGREEMENT o ;a R, ca O 0 This Agreement, entered into this daV-0f lL0 , 1980, between the FLORIDA FREE tiGHT SSOCIATION, INC., a Florida Corporation, (herein- after called the USER), and the CITY OF MIAMI, FLORIDA, a municipal corporation of the State of Florida, (hereinafter called the CITY). WITNESSETH: WHEREAS, the CITY will allow the USER use of Margaret Pace Park, Miami, Florida, for the purpose solely test of hang gliding activities for the following 90 day period of TANuAxN J7 , 198e through 4AX14_ /1 , 1981. The USER agrees to vacate and/or cease said activities upon demand by the CITY at anytime after the period as specified in this Agreement. The following express stipulations and conditions are made a part of this Agreement, subject to the following terms and conditions, and are hereby consented to by the USER: 1. The USER agrees to provide public liability insurance in an amount of one -million dollars, $1,000,000, Per each occupance for bodily, injury,. and $50,000 per oceurancer for property damage. The CITY must be named as an additional insured on all policies. A certificate indicating that said insurance is in force must be presented at the time of execution of this Agreement. The policies of insurance shall provirie that the CITY be given at least 30 days advance written notice of the cancellation of any policy. t • The USER will supervise and furnish security in order terd protect the landing area, takeoff area or any area under- going activities, as outlined in the USER'S operations plan, attached and incorporated herein by reference. 3. The USER will keep the grounds in use free from trash and debris clue to its occupancy or use and further agrees to restrict any alterations of land form. 4. The USER will confine its use to designated areas and not interfere with other activities or events. S. The USER shall strickly enforce nationally recognized hang gliding rules and regulations and -further restrict the USER'S use to solely members of the United States Hang Gliding Association. n -6 t 6. The USER agrees to cooperate with the CITY in the conduction of surveys, to provide reports of visitor - contacts and to respond to CITY inquiries about the USER'S activity. 7. The USER shall adhere to all CITY, County and = Federal laws relating to the park's usage and said activities. 8. I£ the USER fails to comply with any of the terms hereof, or if the CITY receives complaints of said use of park by its citizenry, the CITY may cancel this Park User's Agreement and revoke the privilege of the USER to come upon the CITY'S property for purposes for which the Park User's Agreement was granted and may oust and remove all parties who may be present upon any part of the premises for the purpose of exercising any rights allegedly arising hereunder. 9. The USER may, within fifteen (1S) working days prior to the termination of this Park User's Agreement, request an extension of said privileges for a defined period of time; however, this extension may be granted at the sole option of the CITY. - 10. Both parties, either the CITY or the USER, shall have the right to terminate this Park User's Agreement capon a - ten (10) day written notice to either the City Manager or his designee, the Director of the Department of Leisure Services, ur the President of thev-Flarida Free Flight Association, Inc., or his appointed designee, respectively. 11. It is the intent of the CITY, concurred in by the USER, that this Park User's Agreement shall not, as against the CITY, vest any rights in the USER; and shall be deemed only the grant of a privilege to the USER to carry out the term of this Park User's Agreement on property of the CITY so long as such privilege shall be in force. 12. The USER assumes all risk in the operation and activities under this Agreement and shall be solely responsible and answerable in damages for accidents or injuries to persons or property, whether direct or indirect, arising out of the operation under this Agreement, or arising by virtue of the carlessness, negligence or improper conduct of the USER or any member, agent or employee of the USER, ,and hereby covenants and agrees to indemnify, defend and jOrve harmless the City of Miami, Florida, and its officers and employees from every such claim, suit, loss, damage or injury, which responsibility shall not be limited to the insurance coverage herein required. 0 0 IN WITNESS WHEREOF, the parties herein have executed this Agreement, the day and year first above written.
